This is gonna get ugly!
Even though Larry Birkhead is the biological father of Anna Nicole Smith's daughter and she is in his custody, Howard K. Stern thinks he should have control of little Dannielynn's money.
And he's taking it to court!
Thursday morning, Howard filed papers asserting his role as the executor of Anna Nicole Smith's estate.
Stern, Anna Nicole Smith's former attorney and companion, asserts that he "has at all times been the duly appointed acting and personal representative of the estate."
In a new petition to determine distribution rights, Stern claims the 2001 will Smith signed before the birth of Dannielynn, which gave all the money to her deceased son Daniel, now applies to the little girl.
Further, Stern claims he is the sole person responsible for holding Dannielynn's money in trust, even though she is in the custody of her biological father.
How will Larry respond to this????
Or did he and Howard already come to some sort of "agreement"?????

Howard K. Stern is named as executor in the will, and is simply asking to be appointed trustee of any trust Anna Nicole intended to be set up for the benefit of her children. As trustee, it would be his responsibility to see that the money be kept for the benefit of Dannielynn, and he would not have any personal interest in or right to the funds, except that he would receive some compensation for his role as trustee.
No need to exaggerate things. Larry will likely have no qualms with this arrangement, unless he would prefer that he be appointed trustee.

People that don't know anything about the law shouldn't make such stupid and ignorant statements — PEREZ. Being the executor does not mean he has access to her money, furthermore he's waived the executor's fee. Being adminstrator of the trust is NORMAL and part of the probate process. Furthermore, adminstrator's have to give reports to the court. It's part of the fiduciary duty.
