"I'm scared. I'm scared," a dazed and confused Britney moaned to the paparazzi late Monday night as she drove around aimlessly. Yeah, scared of being deposed - so she didn't show!
Sources reveal exclusively to PerezHilton.com that K-Fed's lawyer, Mark Vincent Kaplan, is "going to seek court sanctions against Miss Spears."
What does that mean?
It means that if Britney misses her deposition when it is rescheduled, she could be held in contempt of court and ARRESTED!
"It's really astounding that she did not show up to her deposition Wednesday morning," an insider tells us. "It was ordered by the court!"
Additionally, sources tell us that K-Fed's team is expecting Unfitney's shady friend, Osama Lutfi, of trying to pull a similar stunt. However, we hear that steps are being taken to ensure that he too is deposed, as he's been ordered to. Lutfi has already been missing in action once.
Britney is soooo going to get arrested in 2008 for contempt of court.

Ooops, Perez, your comments about the ramifications of Britney missing her depo are not correct. First, in a civil action the deposition notice is served after the parties' lawyers agree on a date. If the deponent fails to appear without the parties' prior agreement to reschedule the proceeding, the noticing party can move the court for an order commanding the deponent's appearance, as well as monetarily sanctioning the deponent for her failure to appear. If she fails to appear again, the court's sanctions, if sought, may become more stringent, including issue preclusion and even default. But no jail time.

I've gone from being a fan to being disgusted by her behavior to now feeling sorry for her. This girl so obviously needs serious professional intervention that it's no longer funny to sit by and watch. We are truly watching someone in a downward spiral who is more out of control than Lindsay ever was and it's really sad, especially because there are kids involved in this mess. Why doesn't the judge order Britney into a live in facility for at least 90 days so she can get the help she so clearly needs? She's so young to be in this kind of state. There are meds out there that could turn her life around and she could go back to being productive again and learn how to mother those poor boys while they're still young enough not to remember their mother like this. I don't think that Britney has no respect for the law; I think she doesn't have a clue of what is really happening around her anymore. She's only going through the motions of getting through the day. This is all so very, very sad. If she was my daughter I'd have had her committed long before now.

Each time she fails to appear, the judge will ratchet up the punishment. In a divorce case, the worse that will happen is the judge will find certain evidence or issues against her. In other words, she'll lose the case or, at best, she'll get hosed. Since she doesn't seem to care about the kids or her money, she won't care about the outcome.

a sanction is a court punishment. she may be barred from bringing in some evidence of her own. either way, she definitely has to pay for all the lawyers and court employees were ready to depose her yesterday. the judge will most likely hold her in contempt which means that she will NEED to show up or be given criminal charges.

Perhaps a court forced Form 1 action on britney is required - she obviously needs inpatient full time psychological counselling and medication for her more than obvious mental health, behaviour, cognitive, and poor decision making issues. Britney, like Anna Nicole, may never get to that decision on her own without intervention or consequences and will most likely continue to spiral down with her money and enablers assisting her.
she could have easily hired a driver, bodyguard, and blacked out SUV to get her to the deposition to manage the swarming media, and taken 1 dose of minimal non-drowsy medication to deal with her anxiety - as people who are nervous to fly do.
based on decisions she is making, clearly her children will go to k-fed full time as the outcome to the court process and parenting capacity assessment by children's services, which is also no prize for the children, but at least safer.

First, the judge isn't going to hold her in contempt. The judge is going to reschedule . . . and reschedule . . . and reschedule. Second, even if she's held in contempt and a bench warrant is issued, that doesn't mean she goes to jail. A bench warrant for a recalcitrant litigant just means that they send the sheriff to pick her up and bring her to court or to the deposition, not to jail.

That's correct. She won't go to jail. A bench warrant just means that the sheriff has to go bring her to court to explain herself, or take her to the deposition to make sure she shows up. At which point, she answers one or two questions, like her name and her address, and then "feels faint", and they excuse her to seek medical attention. Then she can go drinking at the Chateau Marmont.
Sanctions are very rarely imposed, and when they are, judges almost always only give a small percentage of the actual legal fees, which vitiates the imposition of the sanctions. As an example, I had a case in which the other side's lawyer's behavior was absolutely outrageous. She must have the worst case of pink eye ever diagnosed. She's been wearing those glasses at night for months now. I believe there must be a law that states you need a doc's note saying you have medical needs for wearing dark glasses to drive (i.e. cataracts, etc).
