Britney Thumbs Her Nose At The Court
Briney Spears spent a mere 14 minutes being deposed on Thursday.
Why???
The trainwreck was almost TWO hours late for the court-ordered deposition.
By the time Brit Brit did arrive, K-Fed's lawyers, Mark Vincent Kaplan, was only able to grill her for 14 minutes before the deposition was scheduled to end.
Kaplan described Spears as "cooperative" and said, "I would've preferred it had gone on longer. [But] there has been no change in anything. It will be continued to another date, which I will not say at this time."
Asked at a press conference outside his offices if he got information he was looking for, Kaplan replied sarcastically, "In 14 minutes?"
No excuse has been given for Spears' almost two hour lateness, but it probably had something to do with the fact that she thinks she's above the law and her kids don't matter that much to her.
Kaplan said he hasn't decided whether to pursue court sanctions against Spears for being late and her repeated disrespect of court order.
But we hope he does!

Yo. Depositions do not take place in court. They take place at a lawyer's office. Here, it was K-Feds. There is no judge there. That being said, I would file a motion for sanctions and request that she pay for the stenographer and attorney fees for the all the fruitless waiting around, both on this date and the others that she missed. I would also move that the court again order her to appear for her deposition for at least seven hours on another date and if she fails to attend, she will be held in contempt.

Can someone post a link to a site that has any legal documents related to this deposition? I am curious to know if there is an actual court order signed by the judge regarding her attendance today (or yesterday). I practice family law in PA, not CA, so I don't know exactly what the procedure is regarding notifying a party in a custody case of the intent to take their deposition. In PA, you send a "Notice of Deposition", which is not signed by a judge and therefore not a court order. You can only be in contempt if you are specifically violating an order signed by a judge. Even then, you will likely be slapped with a fine and posible further limitations to her visitation. In PA, they don't throw people in jail for these kinds of things; they simply restrict visitation and issue a fine.

A deposition is not court ordered and it doesn't take place at court. It is an agreed meeting between parties. A "Notice" of Deposition stating time, place, etc. is filed with the court just to have it on record. The court has nothing to do with it. She is not blowing off a court order but K-Fed's attorney - who cares?

He's probably considering it because he's aware that they have to be careful in how they present their case. They've maintained all along that they don't want to "punish" Britney, just get her to get help, to get better, etc. He's probably weighing up whether it would hurt the perception of the case if he presses for her to be punished.

Given her blatant violation of other actual orders in this case, there might be a court order stating that she must give her depo within a certain amount of time. I would certainly HOPE that Kaplan would have tried to get some type of order in place so that he had the ability to seek sanctions if she continued to screw off. A subpoena, while important, does not generally have the same legal implications as a specific court order in this type of situation.
The only reason that she showed up is that she heard that there would be bariistas and photographers there. When she discovered that the room was filled w/ barristers and stenographers, she bolted!

At some point these temporary orders are going to become permanent. Visitation will be based on her behavior and it's not looking good for her. I think losing your kids is a lot worse than spending a few days in jail. But I agree with you. Who really cares if she loses her kids?
