this woman was awarded $1,000,000 her lawyers recieved $583,000 of that while the other $417,000 was put in a trust fun for her, why should walmart donate more money to her than what they have already paid from the lawsuit. if her lawyers cared they would donate some oof their $583,000 since they got more fucking money than she did! the real crooks are her lawyers not walmart

Wal-Mart is doing the right thing! If they don't get that money and don't go after it, ALL of Wal-Mart's insurance premiums will go up! And how ethical is it of that woman to keep double the money? That money is not rightfully hers, so she should not have been spending it. There are people in shittier situations. The family should have been smarter and sued for more. Plus, they have good insurance, WalMart's insurance never asked any questions and keeps paying out to them for her medical bills. Also, if WalMart does not go after the money, it will open a flood gate and other employees in similar situations will think they can sue and get the money PLUS have their insurance pay in on it. Shit happens. This lady's lawyer should have known to 1. SUE FOR MORE and 2. THE CLAUSE IN HER INSURANCE!!!!! (As almost ALL insurance agencies have this clause!!!)

Look up "subrogation". If the insurance company stated you cannot "double-dip" than they are legally entitled to ask for that money back. My question is why did the family sue the trucking company even after they got money from WalMart.
Their lawyer obviously didn't read the fine print as lawyers should do in cases like that. Emotional story? Yes. Unfair and unethical? Nope.

They *are* doing the right thing. Their contract specifies if the victim is awarded money from a lawsuit, then they get nothing from Wal-Mart's health plan. I think this clause is there for a reason, and a very good one at that. The woman will be quite fine living off the $417k she was awarded.

This is how most insurance companies are. After an accident, they expect you to pay them back with what you got from whatever settlement. Both of my parents worked for the State of Ohio and both of them were in separate accidents where they got a pay-out by the other person's insurance company. Their medical insurance then turned around and wanted some of that money. That's how the world works. Leave Wal-Mart alone!
