As you probably recall, Richie Sambora was charged with DUI late last month. The idiot was driving, while intoxicated, with his 10 year old daughter in the car!
According to new reports, Sambora has just plea-bargained his DUI case and plead No Contest to driving drunk.
Luckily for him, the DUI charge was dismissed and prosecutors did not file child endangerment charges.
Why Not?!?!
Apparently, the cops and prosecutors felt that the evidence they had didn't support the child endangerment charge.
Yea right. If you're driving with an alcohol level above the legal limit, you ARE endangering that child, yourself, and everyone else on the road!
When Sambora was pulled over, he had a blood alcohol level of .13, way over the legal limit of .08. And his charges were dismissed?
Luckily for Sambora, he had one of the most effective criminal defense lawyers with him, Blair Berk, who has represented several celebs such as Lindsay Lohan and Mel Gibson. And, also in his favor, the judge (who is probably related to the judge that sentenced Nicole Richie to jail for only a day) wasn't trying to get publicity or teach celebs 'a lesson', like the one who put away Paris Hilton for lesser charges.
Sambora will be placed on informal probation for three years and will only be required to pay a $390 fine, plus penalties. The total will come out to be less than $2,000. He will also need to attend an alcohol education course.

Everyone says: Money can't buy your way out of everything. Well, ya it can. Well, almost everything, certainly not extremely heinous crimes like murder, rape and armed burglary. But with that said, his money (aka his very well connect, high powered attorney) got him out of that. I got arrested for DUI approix 1 1/2 years ago. I wasn't even driving my car. The police never even saw me driving. I hadn't driven for 2 days. I was upstairs in my loft with the car keys no where in sight when they arrested me. All because some stupid dumbass neighbors's testomy that I was driving when it was really my "so called" best friend driving (of course she didn't own up to it) But the moral of the story is: I spent 5 thousand dollars on an attorney who did jack shit. If I had 10, 20, 30 thousand dollars to spend on an attorney, that would have been dismissed in no time.

Drunk driving is the same as DUI. Furthermore, it looks as though he was sentenced to the standard penalty for a first DUI conviction - 3 years of informal probation, fines + penalty assessments and an alcohol education class. CA law only imposed 48 hours of mandatory jail time for a first time DUI that is usually satisfied through credits incurred when a defendant is arrested. You also mentioned a BAC of .13, in order for an enhancement for a high blood alcohol content to added a defendant's BAC must be .15 or above. Sounds like he was handed exactly what he deserved. As for a minor's presence in the car, the standard to prove child endangerment is higher than you might think. . .
BTW boys and girls, you can get to a .13 failrly easily - 3-5 mixed drinks depending on ones hight, weight and gender.

DUI means driving uder the influence. The criminal case filed against California DUI / DWI defendants consists of two different statutes: California Vehicle Code Section 23152 (a), and Vehicle Code Section 23152 (b). The first count focuses on whether the driver was under the influence of alcohol or drugs to the extent that they are "unable to drive their car with the same caution characteristic of a sober person, of ordinary prudence, under the same or similar circumstances." This is the legal standard for being considered under the influence of alcohol or "DUI" in California courts

The only major difference from a DUI is no community service and a way lower fine. It is still priorable.. so if he gets arrested again it woud be 2nd DUI.

I don't know about Richie Sambora's legal history, but Paris had a repeated pattern of ignoring court orders. She had her license revoked, then went driving and got caught. Not once, but a few times. After ignoring court orders to go to mandated classes, she got caught again. So she went to jail. If it were you or I, or anyone else, this is what would have happened. No, wait. We wouldn't have gotten nearly as many breaks as Paris. Besides, she became a saint while in prison so we should be thrilled that she was incarcerated.

In the real world people do not go to jail for 1 DUI, all that happens is they get probation, a fine, and their drivers license suspended. He did not get off easy- this was his first offense and he has a problem. Richie is a great dad and made a mistake– are all of you PERFECT?!?!? I think not!!
