Is this just coincidence???

We were listening to the song Lucky off Jason Mraz's new album, and the tune sounded instantly recognizable. Eerily familiar, actually.

A duet with Colbie Caillat, Mraz's Lucky sounds just like David, a gem from little-known yet adored Nellie McCkay, who released her song FOUR YEARS ago.

The chorus of Mraz's Lucky sounds IDENTICAL to McKay's David, and the song structure for both songs are very similar as well.

Check them both out below!

Pop princess Kylie Minogue has received France's highest cultural honour, the Order of Arts and Letters.
Culture minister Christine Albanel said the Australian star was a "Midas of the international music scene who turns everything she touches into gold".
Minogue begins her latest world tour in Paris on Tuesday, three years after she was diagnosed with breast cancer.
"I want to publicly salute the courage you showed by revealing publicly that you had cancer," Ms Albanel said.
"Doctors now even go as far as saying there is a 'Kylie effect' that encourages young women to have regular checks."

    YAY Kylie is amazing!

  5. ItsMe says – reply to this

    It's different lyrics anyways

  7. jb says – reply to this

    i don't think so

  8. Nina says – reply to this

it does sound similar but mraz and that other twit could never touch nellie. i love her.

  9. madsy22 says – reply to this

    I think it is coincidence

  10. Tom N says – reply to this

I don't hear any real similarity at all…and I am not a Jason Mraz fan either.

  11. dasd says – reply to this

no. you're stretching to get that

  12. blah blah says – reply to this

Don't sound the same, Jasons is better..much better.

  13. robbie says – reply to this

damn…i'm a fan of both and hopefully it's not plagiarism. i'd be sad if it was…

  14. rachelshavon says – reply to this

    Ummm who are those people?

  15. Shelly H says – reply to this

You're so right… but I still do like the Lucky song.
P.S. - You are showing so much progress already.. before you know it you'll be as hot as Teddy.

  16. Lisa says – reply to this

I think you are on crack. I don't hear it at all.

  17. roryj says – reply to this

    they sound exactly the same

  18. McG says – reply to this

They don't sound too similar to me except that they both suck and the new one sounds like Jack Johnson (AKA Easy Listening Crap).

  19. blah says – reply to this

jason mraz is the shit. they sound nothing alike. wrong.

  20. ashlea says – reply to this

i don't hear the similarities at all. both songs are equally boring tho!

  21. E. Lo says – reply to this

Sorry - similar song styles does not plagiarism make.

And BTW - if you're gonna hurl those accusations toward these mildly similar songs, you should really think about hurling it at all those brit wino-rae songs that all sound EXACTLY THE SAME

  22. HEREZ says – reply to this

Maybe it was sampled… have you seen the liner notes. HOW DO YOU KNOW PEREZZZZ YA DON'T KNOW.

  23. solmal says – reply to this

I think the songs are different.

  24. Melisa says – reply to this

  25. tmoney says – reply to this

You are not musically inclined, Perez. Stick to gossip.

  26. amber nicole says – reply to this

I love Nellie Mckay and "David", which is a much, much better song than Jason Mraz's

  27. stephanie says – reply to this

    it DOES sound alike.
    but what doesnt nowadays?

  28. just saying says – reply to this

    your an idot

  29. jazz says – reply to this

Both are uninspired and unoriginal but they're not identical.

  30. h says – reply to this

    hmmmm just a coincidence?????

  31. Common. says – reply to this

Its a common melody; especially from the Sinatra era etc. Michael Buble has similar songs as well. Not exactly stealing. Thats a hefty accusation.

And really, do you know how much of this pop shit sounds the same these days anyways? I think both songs are great… esp Mraz's!

  32. dillion says – reply to this

DUDE… YOU are sooo off… you really are looking for something here… they sound NOTHING alike.

  33. ultrapunch says – reply to this

    i don't hear it perezy

  34. evylex says – reply to this

it look similar but it's sure not identical !!!! There is so much things more important to look at in life…… like how the US gonna kill the planet really soon!!!!!

  35. J_Brisby says – reply to this

No resemblance. Perez is muckraking as usual, knowing his fans rarely rise above the usual tropism.

    Tropism? Look it up.

  36. dan says – reply to this

I hear a slight similarity…as the songs play out they sound nothing a like…stick with being assholes, not reviewing music, you guys SUCK at that.

  37. CU says – reply to this

He sucks, the original version from the chick is better

  38. Clark says – reply to this

They do not sound fimilar at all. Usually Perez is dead on, but this time I think he is reaching for a story. Jason Mraz is FAR better than that random chick.

  39. Sophia says – reply to this

I think its just a coincidence. There are loads of songs that sound like this,
    it's a musical style.

  40. Bubbua says – reply to this

    no…sounds nothing alike!!!!

  41. carmen says – reply to this

i think that jason mraz's song doesn't sound exactly like the other one, in fact i think it's better.

  42. Julie says – reply to this

They definitely both sound similar. Unfortunately in today's world, a lot of music is similar sounding, especially if they are in similar genres…it can be argued that every single one of Nickelback's songs sounds like generic rock music from other bands…in fact, I think all of their songs sound exactly the same too…
So, we'll see if Nellie does anything about this…

  43. ugh says – reply to this

oh shush. jason mraz is mad talented. He has over 100 original songs. why would he plagorize one?

  44. Shannon says – reply to this

    ummmmm…they don't sound anything alike,sorry.

  45. JDnyc says – reply to this

I'm a big Nellie McKay fan and do not hear anything similiar between these two songs. Go buy Nellie's CDs!!!

  46. kat says – reply to this

    i dont hear it. sorry.

  47. robio says – reply to this

All three of their voices are so high. I don't personally hear enough similarity to say it is plagiarism. Perhaps because of the minimal instrumental and focus on the voice? I'm not hearing it and I love all three artists especially Colbie Caillat.

  48. notnecessarilythesame says – reply to this

i dont think that the are the same… many songs used the same basic structure actually… have you seen that youtube comedian who sings about how many pop songs all sound like pachelbel's canon in d major?
How about Backstreet's back and NSync's I want you back kinda also sounds the same???

  49. Antonio Nalid says – reply to this

Perez, you don't even know the definition of Plagiarism. Besides, the songs' lyrics are different and even the beat/tempo and the sound are different. The approrach may be similar but not identical. Stop making shit up. Mraz is certainly more talented than McKay.

  50. shanny shamrock says – reply to this

Sounds like Jason should be put in a time out. You are very right Perez….eerily familiar.

  51. SJ says – reply to this

What the hell Perez??? THEY SOUND NOTHING ALIKE.

The McCkay song is great, so if the point of this stupid assertion was exposure for her, thanks. Other than that you are just losing credibility

  52. homie slice says – reply to this

you're a moron! for someone who "knows music" your WAY off with this one.

  53. MISTER.MILLER says – reply to this

  54. hmmmmm says – reply to this

I have to start listening to Piggezelle's Picks. I am not too high and mighty to think maybe he may have a musickle ear.

  55. lala says – reply to this

they do not sound remotely alike.
    Jason is better. wayyy better.
    end of story.

  56. Ana says – reply to this

it doesn't matter……..Nellie's is sooooo much better!!!!

  57. liadee says – reply to this

it does have a very similar song structure - THATS BECAUSE ITS A SIMPLE AND COMMON STRUCTURE. if i had a lack of a life i would find about 5 more examples to give you. and the actual choruses are nothing alike you are just chiming in on the first verse of LUCKY and the chorus of DAVID having a phrase is common. theyre both amazing songs but it isnt anything worth screaming plagarism too. perez i love you but dont make it harder on three amazing artists!

  58. heffa says – reply to this

no surprises here, that's mraz's MO.
just like when he covered that bright eyes song but called it by the wrong name.

  59. YOU'RE STRETCHING PEREZ says – reply to this

Yeah they are similar but different enough that I don't think any plagiarism, intentional or otherwise, is there.

  60. booshdag says – reply to this

Who cares? They are both terrible. Losers with shitty careers.

  61. smle doc says – reply to this

Not really - I like both songs - like the duet bettet.

Stuff is bound to sound similar - how much longer can keep changing up songs. Eventually, we'll run out of original music.

  62. bubbles says – reply to this

I work in the record industry. It's called an interpolation Perez. Artists pay a license fee to use to use a melody from another artist's copyrighted work. Record labels are generally over cautious about ensuring that these kinds of licensing agreements are signed to avoid lawsuits. I image that it is the case with this song. No need to spread accusations of plagiarism. You should take a good look at the liner notes before making such a statement.

  63. Matt says – reply to this

This is no Bowie vs. Vanilla. I don't think any similarities would hold up in court, plus we don't know yet whether or not anything has been licensed. I don't think it's exactly responsible to make such a huge claim without the liberty of access to liner notes. Because of this, he's guilty until proven innocent, and that sucks!

  64. Kelly says – reply to this

    they dont sound alike

  65. francie says – reply to this

you are really stretching it with this and you should apologize to jason mraz

  66. musicgeek says – reply to this

the song is such a standard pop melody that to be honest, it's probably a coincidence. structure is similar yes, but if you were to disect it down into time signature, length of verses vs. chorus vs. bridge etc. you would find it's a very common format for almost ALL pop songs. there is certainly not enough similar here to call it plagiarism

  67. k says – reply to this

sounds nothing alike, get a music degree.

  68. Girl says – reply to this

Little known and yet adored by whom? You, Perez? We all know that you have your favorites and are willing to write some amazing stupid ass shit to justify it. Jason Mraz is an amazing talent and has managed to write many many songs that don't sound like …..blonde bitch who.

  69. J says – reply to this

I definitely agree but I went to the MTV Campus Invasion concert at UMD this weekend and heard the new Simple Plan single "You're Love is a Lie" which sounds so much like "Are You Happy Now?" by Michelle Branch

  70. Molly says – reply to this

Newsflash, this jason mraz song sounds like every song of his off of Mr. A-Z and even stuff he released in 2003 on his debut album. They've got similar style but I think Jason prides himself way to much to "copy" someone else's song.

  71. KT says – reply to this

There's no way that Nellie would win a copyright infringement suit against Mraz based upon these two songs. They might be similar, but that's not enough - they're required to be "Substantially Similar" - legal term of art, with some big tests to prove infringement.. it wouldn't fly.

If you want similar, check out Sweet Little Sixteen and Surfin' USA.

  72. Bootsy says – reply to this

Jason Mraz is such a douchebag. I'm not surprised he stole somebody else's song.

  73. Doug says – reply to this

It doesn't sound alike at all.

  74. WHATEVER says – reply to this

I don't have a fucking clue who those people are, it must be a gay thing but it sounds to me that the songs just have a similar style. I mean how many rap songs sound the exact same? This wasn't worth pointing out.

  75. greentea says – reply to this

I don't think it is similar but good try though. Also, how did you get this song if his CD is not released yet?

  76. jk says – reply to this

mraz's song is in major while nellie's is in minor… interesting. probably has similar chord structure but is apparently in a relative minor.

  77. mj says – reply to this

I adore Jason Mraz, and always thought he was so original?? They sound a little bit alike…

  78. IloveNelly says – reply to this

    I love love love her!

  79. ERIC says – reply to this

um, Mraz, is bubblegum, top 40 trash trying to be all chill and stuff.. Not much talent there.

  80. Patrick says – reply to this

Jason is an unbelievable song writer - he can improvise better music than most performers can write over the course of months (which he does often). I really believe any similarities are coincidental - he just doesn't need to plagiarize to make beautiful music, so why would he?

  81. ben says – reply to this

check out brandy's I TRIED from AFRODDISIAC and Madonna's new DEVIL WOULDNT RECOGNIZE. Its the same.

Timbaland song from 03-recylced in 08

  82. Allie says – reply to this

I don't hear it either, must be a slow day huh?

  83. ted says – reply to this

    1. doesn't sound that close at all.

    2. its impossible to write anything half decent that doesn't resemble something else in some way, shape, or form.

    3. get your bloated pumpkin head out of your fat ass. it doesn't sound that close at all.

  84. Mila says – reply to this

    Sorry I don't hear it.

PS: that flawed blog is such a wannabe! QUIT Spamming comments to try to up your hit count.

  85. lilly says – reply to this

I don't hear similarities at all.

  86. winnypie says – reply to this

    I triple love Jason Mraz!!!!

  87. Pickledjo says – reply to this

    Sound completely different to me.

  88. K says – reply to this

just coincidence - they don't sound that alike…

  89. marc says – reply to this

i don't really hear that much of a similarity. it is funny that jason's new album is called "we sing, we dance, we steal things" now that you're accusing him of this.

  90. dramaqueen82 says – reply to this

Sounds similar…but there have been millions of songs written, and only 13 different notes. It's not a surprise that every now and then something will sound like something else.

  91. char says – reply to this

definitely the same chord progression - but considering there are only 7 different notes a scale…it's not that surprising. jason mraz has enough talent to not have to copy anyone else. have you seen this guy live? he's so crazy it's like he's on crack.

  92. Laura says – reply to this

They do sound similar… but I find them both a bit annoying.

  93. JenD RN says – reply to this

okay, both songs were crappy, so why should i care if they sound alike. i mean seriously. what has jason maraz done recently, and who the hell is the other person. and why should i give a shit? seriously!

  94. Jeff says – reply to this

Don't hear it at all…but go ahead and finish your bong anyway…

  95. lisa says – reply to this

i totally disagree that these songs sound similar.

and even negative publicity is publicity! go jason!!!

    new album 13may2008!!!

  96. Emmy says – reply to this

Well, they don't sound too similar… i can see the likeness, but i don't think its obvious.
Its a popular choice of melody that - you might find there are more songs out there like that. There's only so many times you can recycle a melody… thats why theres no copyright on the melody.

  97. Love Mister Miller says – reply to this

    Love Mr. Miller's comment!

By the way, doesn't sound like each other AT ALL! Perez, you should do crack so early in the morning!

  98. Erinn says – reply to this

Jason is so unbelievably talented and has many original songs, this is just a coincidence, besides they don't sound much alike at all. Lay off Mraz, he is the shit.

  99. Anth says – reply to this

That's your exclusive?!?! They sound nothing alike. Why do you insist on stirring shit up when it's not even valid?

  100. robert says – reply to this

they sound nothing alike other than they are in a similar style - the 'song structure' (LOL!) is not at all similar, nor is the melody, although they both bore me equally.

    tone deaf much Nasty?
