Is this just coincidence???
We were listening to the song Lucky off Jason Mraz's new album, and the tune sounded instantly recognizable. Eerily familiar, actually.
A duet with Colbie Caillat, Mraz's Lucky sounds just like David, a gem from little-known yet adored Nellie McCkay, who released her song FOUR YEARS ago.
The chorus of Mraz's Lucky sounds IDENTICAL to McKay's David, and the song structure for both songs are very similar as well.

Culture minister Christine Albanel said the Australian star was a "Midas of the international music scene who turns everything she touches into gold".

They definitely both sound similar. Unfortunately in today's world, a lot of music is similar sounding, especially if they are in similar genres…it can be argued that every single one of Nickelback's songs sounds like generic rock music from other bands…in fact, I think all of their songs sound exactly the same too…

All three of their voices are so high. I don't personally hear enough similarity to say it is plagiarism. Perhaps because of the minimal instrumental and focus on the voice? I'm not hearing it and I love all three artists especially Colbie Caillat.

it does have a very similar song structure - THATS BECAUSE ITS A SIMPLE AND COMMON STRUCTURE. if i had a lack of a life i would find about 5 more examples to give you. and the actual choruses are nothing alike you are just chiming in on the first verse of LUCKY and the chorus of DAVID having a phrase is common. theyre both amazing songs but it isnt anything worth screaming plagarism too. perez i love you but dont make it harder on three amazing artists!

I work in the record industry. It's called an interpolation Perez. Artists pay a license fee to use to use a melody from another artist's copyrighted work. Record labels are generally over cautious about ensuring that these kinds of licensing agreements are signed to avoid lawsuits. I image that it is the case with this song. No need to spread accusations of plagiarism. You should take a good look at the liner notes before making such a statement.
This is no Bowie vs. Vanilla. I don't think any similarities would hold up in court, plus we don't know yet whether or not anything has been licensed. I don't think it's exactly responsible to make such a huge claim without the liberty of access to liner notes. Because of this, he's guilty until proven innocent, and that sucks!

the song is such a standard pop melody that to be honest, it's probably a coincidence. structure is similar yes, but if you were to disect it down into time signature, length of verses vs. chorus vs. bridge etc. you would find it's a very common format for almost ALL pop songs. there is certainly not enough similar here to call it plagiarism

Newsflash, this jason mraz song sounds like every song of his off of Mr. A-Z and even stuff he released in 2003 on his debut album. They've got similar style but I think Jason prides himself way to much to "copy" someone else's song.
There's no way that Nellie would win a copyright infringement suit against Mraz based upon these two songs. They might be similar, but that's not enough - they're required to be "Substantially Similar" - legal term of art, with some big tests to prove infringement.. it wouldn't fly.

Sounds similar…but there have been millions of songs written, and only 13 different notes. It's not a surprise that every now and then something will sound like something else.

Well, they don't sound too similar… i can see the likeness, but i don't think its obvious.
Its a popular choice of melody that - you might find there are more songs out there like that. There's only so many times you can recycle a melody… thats why theres no copyright on the melody.
