Devo are cracking that whip!
The 80's rockers are suing McDonald's because the burger chain allegedly used the band's likeness in a Happy Meal toy.
They're angry at the fast food chain's decision to use them as a marketing tool.
Apparently, the golden arches produced a toy called New Wave Nigel, who looks a lot like the Devo boys in the music video for the song Whip It, for some American Idol-themed Happy Meals.
The band member who came up with the iconic jump suit look is quoted as saying, "We're in the midst of suing them. They didn't ask us anything."
Will the Devo boys whip it good and walk away with lots of bucks?

Devo are a bunch of washed up has beens, looking for another moment in the spotlight. My daughter got that toy and I didn't for one minute think it was a devo lookalike, what came to mind was a lego toy. They haven't come out with a song in decades. I doubt anyone of this generation even knows who Devo is.

The band does have a trademark for their look,however,as a lawyer who used to work for their label when I was a lot younger, they have to still prove that it was done intentionally, with malice.is the likeness exact or just similar.Its not a slam dunk. my son got that one in his happy meal. i instantly thought of Devo. it played really annoying music. i "accidentally" threw it out.
I saw that toy around my house and instantly thought of Devo too. Since they haven't been heard of since the 80's, I'm thinking they are way out of money so suing Micky D's will be like hitting the lottery for these guys.

My sister got that toy in her happy meal. When i first saw it I told her it looked like Devo. The only difference is that the toy has an orange hat instead of a red one. They'll probably win because of likeness rights.
The people telling Devo to "get over it" are on the same level as ones that told David Bowie and Queen to get over Vanilla Ice stealing their hook 17 years ago.
