eBay is in some deep trouble!

Yesterday, a French court ordered eBay to pay almost $40 million euros (over $60M US) in damages to Louis Vuitton for allowing the sale of fake LV items.

The court has now stopped eBay from selling four kinds of perfumes, which are Givenchy, Christian Dior, Guerlain, and Kenzo.

They will also not be allowed to sell six LVMH brands.

The court determined that eBay had committed "serious errors" by allowing the sales of fake LVMH goods.

They also said eBay violated the perfume sales distribution network, which was setup by Louis Vuitton and Christian Dior Couture.

Of course, eBay said they are going to launch an appeal, believing the court did not uphold copyright law.

A spokesperson for eBay has said, "This decision is not based on combating counterfeit material. It is based on LVMH's desire to protect its commercial practices and exclude competition. This is being done at the expense of the consumers and sellers to whom eBay is always offering opportunities."

Hmmm. They have a point!

The case, which started a year and a half ago, stated that eBay knowingly allowed the sales of counterfeit products on its site.

The court also issued eBay a cease and desist order preventing it from running ads for the perfume and cosmetic brands. If they don't oblige, they'll face a fine of 50,000 euros per day, over $78K.

Gosh. Why can't they run ads??? That seems a tad excessive, no???

A rep for LVMH says, "It is a major first because of the principles that it recognizes and the amount sought."

    serves eBay right. If you have been keeping up with their news lately, they are slowly trying to drive out smaller sellers with their new "feedback" and policy changes. Supposedly they want to only keep the power sellers, and a lot of those power sellers sell knockoffs. A lot of people are leaving ebay, and they are now trying to get everyone to come back by sending email after email with all these "deals" and "specials." They are not above the law.

    I actually bought one of these fake LV bags thinking it would be authentic. It was a complete fake and advertised as real. It makes me question a lot of things on Ebay. I'm not really sure where I stand on the issue but just be aware that things aren't always what they say they are.

    My e bay account was ruined after someone posing as me was trying to sell bags under my name. I wasn't alerted by e bay - but by some poor person who was trying to obtain the bag. I alerted everyone I could. So This is not a new issue for e bay Unfortunately, I will not , never look to buy another item from their site again because of it's troubles and lack of security

The purchase of these items supports child labor, illegal drug trade, weapon trade, and violence in a vicious cycle that we don't see with our own eyes when we head to canal street for a pair of knockoff Chanel earrings. If you are unable to afford a real designer handbag, buy a less expensive one. It is a better choice than supporting a truly malicious way of commerce.

    First of all…LVMH is an amazing corporation that holds MANY high end companies. Just because you can't afford an expensive bag does not mean you should automatically find it stupid and excessive seeing as unless you are some monk living in the hills of nowhere I'm sure you have vices as well.
    These companies make a living by coming up with the latest styles and trends…its the only thing that seperates them from the top and the middle. If you can't afford to buy a real expensive bag then you should go buy a real less expensive bag. Whats the point of carrying some cheap knock off? Not to mention the cheap knockoffs are usually not made with real leather and you end up paying hundreds of dollars for vinyl and fake canvas…which is pretty stupid to do…
    They are not made in China. The people who make these bags and even worse, at times steal the canvas bolts out of the back of trucks, are theifs. By buying a bag that has been stolen or knocked off, you are only allowing for criminals to make more money which can feed into many other illegal doings.
    E Bay should be held accountable…they aren't allowing people to bid and sell on their site for fun…they are making money while doing so and the knockoff industry has made them very rich…if they cannot watch their business practices to make sure they are following code then they should not be allowed to sell those items. Its only fair.

    I used to work for LV and I am so happy to see this finally happen. LV does not have a problem with anyone selling their used, REAL, product. They DO have a problem with people selling fake crap and trying to pass it on as the real thing. Most of the LV product on Ebay is so obviously fake, I don't know why anyone would purchase luxury items from that website in the first place.

    I love all the people who think they are super cool and super stylish by carrying louis vuitton. These bags are butt ugly. Do people's eyes even work? How could an LV bag possibly make you look classy or even just nice? It reminds me of those stores in the mall like American Eagle with AEO all over the bag or Hollister with "Hollister Co 1922" spread across the T-shirt. Abercrombie and Fitch with A on one side of the zipper of a jacket, and F on the other side. What is it with people wearing this shiz? Do you think you are so awesome because you can wear this crap and show to the world "Ooooh look at me! Look what I'm wearing!" No one gives a crap where you shop or where your clothes are from. I think these stores should be paying YOU to wear this fugly piece of garbage clothing they sell. You're a walking advertisement.

    LV all over a purse is so ugly. Seriously, it looks like something a 5 year old would want, because it would be their initials all over the purse they used to play house. I've seen nicer purses at Charlotte Russe or Forver 21 for only $15. Nicer bags that really make an outfit look good. Not with words or drawings all over them, which is so unclassy and childish looking.

    AT LAST! Someone needed to put a stop to the eBay imitation designer sales. Almost all of the bags on eBay are imitation claiming to be authentic, and some for hundreds of dollars. I saved a friend from spending $1,500 on a bag by urging her to go to the designer's website and look at the real thing in detail. She couldn't believe that eBay would allow sales of phonies but believed when she saw the real thing. eBay knows they are ripping people off and don't care.

    Oh p.s. Jet Washington- if you steal a penny you are still considered a theif. The people who make the fake bags are criminals…if they want to make bags and sell them, then make your own brand, spend millions in advertising and try to make a fair buck…selling your own creations. And it hurts the exclusivity of the brand…so yes it does hurt LV and LVMH.
    If the poor wants to buy a handbag I am sure they are having a sale at Wal-Mart. Dont try to carry something in the hopes to look like you are someone you are not.

    I think its absolutely ridiculous its like an online flea market, we should be able to sell what we please on it, within reason. Hell didn't just somebody sell their life in ebay. Who is going to sue that guy? Where is Amnesty International on that one.

    This is the STUPIDEST thing I've ever heard. It's not Ebay's fault that people sell counterfeit items. Suing Ebay puts them in the position of having to somehow authenticate every item that people list for auctions, which is ridiculous considering how large the site is! The companies should go after the people who are listing the fakes, NOT Ebay. Oh yeah, that's right… the listers do not have enough money to get from a lawsuit, that's why they're suing Ebay instead.

    I hope Ebay appeals and wins.

    Yeah they have agreements with officials in NYC, if anyone is caught selling them out of their business ir home they get evicted. And LV pays the court costs so the city prosecutes to the fullest extent.

For people who buy authentic bags; it's not to say you have one. We buy them for the quality and the design. You can tell they're authentic if you have a clue, but especially after you've had them for a few years.

    I honestly believe LV does not want anoyone but the rich with their brand. Fakea are not huring their sales. I would say that 95% of people buying fakes would never be able to afford the real thing anyway. If I could afford a real one myself, why would I buy a fake, right? So its free advertising for them. I think they are more afraid of their image more then anything.

    i am defensive because i work in the industry and have seen the effects of this black market/underground knockoff industry. Also, I studied hard in school, made my own money and have been able to afford to buy real products…so when arrogant, classless, and obviously people with no clue about fashion or style, like yourself, make comments about how "stupid" it is to have these nice things it sort of gets under my skin. Funny that you dont enjoy my lack of punctuation but obviously are "intellectual" enough to mention my cock sucking in order to afford a bag. Welcome to America. Most of us around here enjoy aspiring to afford a nice house, a nice car, a nice retirement and HAH get this…maybe a nice bag.
