A federal appeals court has thrown out a $550,000 fine against CBS for the 2004 Super Bowl halftime show that ended with Janet Jackson's "wardrobe malfunction."
On Monday, a three-judge panel in Philadelphia ruled that the Federal Communications Commission "acted arbitrarily and capriciously" in issuing the fine for the fleeting image of nudity.
We think all the puritans freaked out for nothing.

Sadly, the judges didn't actually side with CBS on anything important — all they said was that the FCC hadn't given enough warning on a new policy change (i.e. that a nip flash is too much). But if the FCC makes the rule and publishes it, the courts will let them censor whatever they want, especially as Our Dear Can't-Depart-Fast-Enough President keeps packing the federal courts with puritanical neo-cons who will be sitting there for years to come.
