Guess when you have a lot of daddy's money to spend, it's easier to waste it.

Rudy Giuliani's son is suing Duke Univeristy and the men's golf coach.

Why?

Turns out Andrew Giuliani was kicked off the team.

Really!

And he's suing because of that!!!!!!!

Andrew, a senior at Duke, claims in the lawsuit that he was illegally terminated from the team this past February without any warning.

Uhmmm, who says you need a reason to be terminated from a college sports team????

It's not like you signed a contract!

According to the lawsuit, the men's golf coach, O.D. Vincent "announced to the team that he was unilaterally canceling Andrew's eligibility to participate in the University's Athletics Program immediately and indefinitely. Andrew and his teammates were shocked. Andrew had no prior notice of what was about to happen. At no time was Andrew ever given an opportunity to defend himself; instead he was summarily dismissed."

Poor Andrew.

Did he suck at golf or was it just his attitude?????

Well, according to the coach's rules, the only way Giuliani can get back on the team is to have written letters of support submitted by each team member.

But obviously that isn't happening!

So instead, he's going to sue.

We're guessing maybe the whole team doesn't like him?

The claim continues, "Andrew's suspension would become a permanent cancellation of his athletic eligibility at Duke unless every single one of his twelve teammates wrote a letter to O.D. Vincent that O.D. Vincent deemed 'satisfactory' supporting Andrew's reinstatement to the team and explaining the reasons why."

The document also alleges that coach Vincent "strong armed other team members to not support Giuliani's return by threatening to kick them off the team."

The suit continues, "It was plainly obvious to each team member that their own personal interests were directly in conflict with Andrew's reinstatement to the team. They feared that O.D. Vincent could unilaterally dismiss them from the team without warning or notice."

Riiiiight.

As for daddy's help, Andrew said he's asked not to receive any.

He says, "I love my father very much. I just decided not to ask him to get involved in the situation."

    The part of the story you missed, Perez, is that they were contracting the team from 13 players down to 7. That is why he was dismissed and the coach picked what players stayed and what players went.

I think that experience more than qualifies him to defend his son in his dispute with the Duke University golf squad. Somebody has to do it!     I've actually met Andrew and he was really nice. He would come to a public golf course by me and he was nice to all the staff, his mother brought cookies for everyone around the holidays. His father was a 100% douche to EVERYONE.

    Andrew was a good kid, he loves golf. This kid would stop and ask the guy who gives you the cart how was he? how is the family? His dad? 100% asshole, all but pushed people out of his way.

    Clearly Perez is not educated or athletic in the least, or he would know that not only would this mean he is off the golf team, but he would lose his scholarship to the school (and likely free boarding that also comes along with most NCAA collegians). I think it is perfectly legitimate to sue over this, as it affects a lot more than what he is doing on Saturday afternoons.

    I am not for frivolous lawsuits and I am actually FOR tort reform. However, if Guiliani has no other recourse (since the coach allegedly threatened the other team members) than I am for his suing the coach and/or school.

    If he deserved to be kicked off, then I hope he loses the lawsuit. If he didn't deserve it, however– if it's a personal dislike from the coach or a political move by the coach, then I hope he wins the lawsuit and gets reinstated. Obviously, something went down here– it certainly doesn't seem as if it was on the up and up, since everyone was stunned. So, let's wait and see what happens before judging the kid. Maybe he actually has grounds here and a reason he's suing and maybe that reason isn't just sour grapes.

    You DO sign a contract…. So unless rich boy broke the law or a team rule, the coach is the one that is breaking the contract. And for that he can sue- athletes and teams do it all the time when an entire men's or women's team gets cut from an athletic program, but its usually due to budget cuts and reduced athletic spending. But I wonder why he wants to remain on a team where the coach hates him and perhaps even his teammates do too??

    As others have said, he'd have to sign a contract to play intercollegiate sports. Because of the inordinate amount of time playing a college sport requires & the restrictions it places upon you as far as not working elsewhere, etc., LOTS of athletes (not necessarily saying it's the case here) depend on the benefits of that contract to be able to eat & sleep on campus. Tons of student athletes would not be able to go to the college they attend if it weren't for their athletic involvement. If they hold up the end of the bargain, they should not lose those benefits summarily.
    If he were cut without warning and no substantial reason without a meaningful way to restore his place on the team as he claims, he would likely have a decent case–especially given that he's a senior and depending upon his career goals.
    I realize his dad is a Republican, Perez, and that's why this story is even here, but for God's sake, stop making yourself look like such a dumbass and THINK before you post.

    Just wanted to let you know you actually do have to sign a contract before you engage in intercollegiate athletics. You become a representative of the university and as such are expected to maintain a certain level of behavior. I doubt he lived up to that and that's probably why he was terminated, but it is certainly something you could argue in court.

    Well, we don't know the reason for him being kicked off the team, so we don't really have a place to be commenting on this particular subject. If he was in fact kicked off just because the coach didn't like him, then yeah. Let him sue. Athletic eligibility is a huge deal to athletes. Whether or not he was a "good" athlete, I don't know. But, lets not jump to conclusions since we don't know the whole story.

    Yes, college athlete's have contracts - some even have agents that help them land the contracts and scholarships!! You seriously need to stop being so stupid, Perez.
    Also, he could loose his scholarship and chances at going pro after college. When huge financial decisions are up in the air like college and all of a sudden you find out a month before school starts you lost your scholarship then you would be pissed too! Perhaps he should have added notice and explaination so many days before he's kicked off the team.
    Let this be a lesson to athlete's going to college: 1) Don't go to Duke 2) make sure you're contract includes notice of termination so you can prepare financially for school.

    Actually, you do sign a contract to play college sports. And it sounds really suspicious…usually, an athlete would not be kicked off a team entirely for their first offense. He probably was on academic probation or failed a couple of drug tests…who knows? Most D1 teams will go to great lengths to baby their athletes and keep them playing!

    Perez, when you play college sports you sign a Letter of Intent to play. This is a contract that is renewable after each year. Most schools honor the LOI for 4 years, Duke almost always did. By kicking the kid off the team he technically looses his tuition, room and bored and has to sit out a year if he wants to play Golf at another D1 school. As long as the kid didn't break any rules he should sue the University. He made a commitment to them and they didn't honor there end of the deal.

So unless the coach can confirm that Giuliani violated his contractual obligations, he is violating his own obligations and is therefore in the wrong.

    Just because he signed a contract doesn't mean that the coach didn't have the right to kick him off the team. You have to look at the TERMS of the contract — a lot of contracts often reserve the right for people to be removed for various reasons, or for no reason at all. And I'm going to guess that Duke University has a pretty competent team of lawyers drafting their contracts.
