Ok you can tell by her breathing she wasn't lipsynching and she has no control over how the cameraman films the show–a lot of times when artist perform on Jimmy Kimmel there are not a lot of close-ups big deal.

Yeah she was lipsyching. If you've seen any of her other recent live performances, you would know that her voice is crap now. On top of that, you never hear her breath, there are NO pitch problems, and she is not even out of breath at the end of the performance. If you payed attention to these things, you'd know she is *attempting* to pull the wool over our eyes yet again. FAIL.
well, if she was lipsynching, they did a good job at having her re-record the songs. usually it's obvious when people lipsynch because they use the exact same track you hear on the CD… this is not the case.
It doesn't have that "polished" sound that usually happens with lipsynching… perhaps with the whistle tones at the end.

nope, not lipsynching. If you just listen, you can tell, because it's not pitch perfect and identical to the track on the CD. Yeah, there are backup vocals doubling her (and they were louder than her mike at the beginning), but that's common practice these days.
This video is deceptive because the video part is actually slightly behind the audio. Just watch the dancers, they're hitting slightly behind the beat, which we know they definitely don't do!
I say no! for one, she is flat here, which she would never be in a recording. Also, if you listen to the album version, her voice sounds different than this.
