Brandy And Deceased Woman Get Sued

We're not sure how we feel about this.
Brandy was involved in a fatal car crash back in 2006, resulting in the death of a woman. The singer was not charged with a crime in the case.
Well, now a man that was injured during the accident is fighting back.
Donald Lite is going after Brandy and the deceased woman, Awatef Aboudihaj, who was married with two kids.
Lite is suing Brandy for allegedly causing the accident and suing Aboudihaj for allegedly contributing to the chain reaction collision that took place.
The 83 year-old claims that their obvious disregard for the rules of the road caused the multi-car pileup that has left him with extreme physical damage and pain.
Well, if Brandy was the one who caused the accident, why not just go after her?
The suit claims that the ladies "failure to keep a safe distance, mixed with their inability to travel at a safe speed, caused Brandy to rear-end Awatef, which sent Awatef's car smashing into his."
Lite goes on to claim that he's suffered some "serious and permanent injuries" that have resulted in several hospital bills.
Lite is suing for an undetermined amount.
This is Brandy's second suit from the crash as Aboudihaj's family is pursuing a $50 million civil action for wrongful death. The civil trial has been set for April 2009.
Does Brandy have any money left????

Okay — as an attorney, I can explain what's going on here.
There's a 2 year statute of limitations in California. What probably happened is this old guy has been working with the insurance companies for both Brandy and the lady who died. If he's still treating for his injuries (and thus, his medical expenses are not definite) then he wouldn't settle until he's finished going to the doctor. But as the statute of limitations approaches, he has to file a lawsuit or the insurance companies won't pay for his medical expenses because he blew the deadline. Filing suit before the statute runs is called "preserving the statute" and it's how you keep your claim open. Trust me, if you don't, the insurance company will NOT pay you even though their insured is at fault.
As for suing both Brandy and the dead lady, a jury would decide how much fault would be apportioned to each driver. Brandy would probably get the lion's share, like say 95% for causing the accident (it could even be 100%). Depending on how much fault gets assigned, that's how much each insurance company has to pay towards this guy's final bills.
This is actually totally legit. Don't feel too bad for Brandy. This is what insurance is for, and most likely she has insurance.

If you look at the police report it tells what really happen and that is why she was not charged. No one talks about how the women who died had drugs in her body.

Hey, Perez. What the guy is probably seeking is what's called contributory negligence. In many states, even if you partially contributed to an accident you would owe the apportioned amount of the total of damages. Even though deceased, there is likely an insurance policy and/or an estate where these funds can be collected from. Especially since Brandy has previously been "cleared" of negligenge legally, what insurance companies will pay out is decided amongst themselves. Also, she may have previously been persued criminally but is now being persued as a civil matter. Basically, what could wind up happening is if all the parties can sort it out, the injured guy will get his portion from each party separately. In other words, bummer there are deceased parties-but the living one still needs to be made whole and that's not going to happen unless he takes this type of action. It's very common.
