DJ AM Fights Back

As we mentioned last month, plane crash survivor Travis Barker is suing the companies linked to the tragic South Carolina accident that killed two of his friends and injured him and DJ AM.
Travis is suing the plane's owners, Goodyear Tire and Rubber Co., and an airplane maintenance company and is seeking just a bit more than $25,000 in damages.
Then, earlier this month, Otilia Villar Baker, whose husband Chris Baker died in the accident, also sued several aviation companies and the deceased pilots' estates. The suit is on her son's behalf as well.
And now it's DJ AM's turn.
The celebrity DJ just filed suit yesterday afternoon in the Los Angeles County Superior Court.
According to the suit, DJ AM claims that as the plane reached takeoff speed, the pilots became aware of one of more of the tires blowing out.
The suit states that "Rather than proceed to takeoff, they decided to abort and/or reject the takeoff in a negligent manner."
That's when the plan apparently overshot the runway and burst into flames eventually killing everyone except for Travis and AM.
DJ AM is also suing the estates of the two pilots as well as Clay Lacy Aviation, Global Exec Aviation, Inter Travel & Services Inc, Goodyear Tire and Rubber Co, and Learjet.
He's suing for "pain and suffering, lost earnings, property damage, past and future medical and health-related expenses, and punitive damages."
Wonder what the judge will decide. We're hoping he sides with Travis and DJ AM (although not sure about suing the estates of the people who died).

Yes I'm sure the pilot crashed the plane ON PURPOSE b/c he wanted to die and take everyone on board with him in a fiery mass of metal. Sounds like this accident killed the wrong two people. Fucking talentless losers.
They should be ashamed of themselves for suing the pilot's estates. Those pilots lost their lives, isn't that enough!
I am a paralegal and it common practice to sue everyone (including the decedent's estates) just to cover all the bases. The pilots' families do have a recourse; they too can sue the makers of the plane and tires just like everyone else is doing. The pilots that weres sued will get out the case and the only ones that will be left is the manufacturers. Dont blame the passengers for suing the dead pilots. Thats the way the law is written and they are within their rights.

It's a shame they had to sue the families of those who died- the pilots, but they do deserve compensation from the companies. Unfortunately, when it comes to money, people make decisions with their heads and not their hearts…..
REALLY????? What were the pilots supposed to do then you ungrateful sob??!!!
The poor pilots were also trying to save their own lives! It was NOT their fault what happened to the tires, and I'm pretty sure that landing with with blown tires would have been far more disastrous than aborting take-off.
Now you are suing the deceased pilots families, who already had to suffer their loss, unlike YOUR family, and probably have way less money than you do.
I pray the judge won't let you go on with this insulting lawsuit. America is better than this.

This was a tragic and horrible accident, but what good will come from suing the families of the pilots??? They have also endured great pain and suffering and lost earnings.

Sueing the pilot's estates is just throwing salt in the families wounds. God… they're treating the pilots like this was intentional. No respect left for those who are suing. Dumbasses and heartless bastards…. just be thankful you are alive…. it's more than what the pilots can say at this moment.
Like Borg Queen said, when you file a lawsuit, you typically name everyone and anyone who might have had a hand in what you're suing about. It does make you look like a greedy pig when you do it and it makes lawyers look bad but you have to make sure every legal loophole is closed. But if you think this is distasteful, check out the recent decision in California that allows you to sue the Good Samaritan who might save your life some day.
This makes me sick. Obviously the pilots did not want to die and did what they thought was best at that moment. No human being is perfect. I think it is terrible that they are going after the money that should go to the families of the pilots. They are suffering and now have to deal with a law suit? What did they do wrong? Not to mention the money that will be wasted in court costs. He should be spending his time being thankful that he survived the crash and doing something positive with his life.

This was a horrible accident that may or may not have been the result of an emergency decision to abort a flight that had gone wrong and you make an ignorant statement like this.
Suing the pilot's estate makes my stomach turn. What kind of awful human being do you have to be to go after a grieving family like that. Grieving and likely guilt ridden knowing that they're husband, father, whatever was responsible for the crash. AM should be ashamed. Merry f*cking Christmas.
The suing has to stop. This was a tragic accident, but that's what it was, an ACCIDENT. Suing is for negligence. Leave the poor pilot's fatherless kids ALONE. The last hting his family needs this Christmas is another lawsuit.
I have completely lost all respect for both of these two uneducated, spoiled losers. How can they claim the pilots are responsible; I don't recall any of the crash reports being completed yet. Isn't it enought that they survived a freaking plane crash? Those pilots probably make less in one year than these two make in a show or two; what is suing the family going to do? Plus, the pilots were just doing their jobs, flying two spoiled rockers in the middle of the freaking night so they wouldn't have to sleep in a hotel. What a disgrace! Screw it being common legal practice, it's still scummy!!!

So why should it be the Aviation and Goodyear being sued as well? In instances like this… why aren't people grateful for their lives and mournful for others? Its disturbing to think that the US people feel the need to sue regardless when in all actually, all aspects from pilots to tires regarding this plane crash was non intentional.

The only good thing that I think could happen would be bringing to light whatever caused the crash, and forcing the company responsible to fix it, be it a maintenance issue or some sort of faulty part. And, the companies have insurance companies that will cover it. THe families will loose their personal savings. I'm not justifying it at all though; the whole thing is pathetic. Couldn't these guys just be happy they survived?
The design on the plane seems flawed. At higher speeds it is safer to take off. Pilots can then have time to declare an emergency, have fire trucks and ambulance standing by, have fire retardant foam on the runway etc. LOTS safer. But apparently when tires on that particular plane blow, they can take out a badly placed brake control. Pilots could have thought they had a lot of runway to stop on but NO BRAKES… Design flaw.
WTF? Seriously, I have lost all respect for them. Suing the dead people's estates? Don't Barker & AM have enough $$ and I doubt anyone else who lost their lives had anywhere near the amount of $$ they have. It's disgusting. Let the people who lost family members grieve and not worry about being sued. I know it's said its the "American way", if that's the case, I'm not too proud to be an American.

Didn't the plane crash end up saving DJ AM's life because when he went to the hospital they found a blood clot that could have killed him later on? He should be the LAST person to be suing…the plane crash was a blessing in disguise for him…

Okay I think what is really sad is that none of the legal teams seems to be consulting with aviation pros. I'm a pilot and from I know about the accident there is very little chance of winning any of the suits…. What happened was an unfortunate accident that happens… I feel bad for those who lost family in that accident but suing everyone like that only hurts more then it helps…
