Boycott Facebook! Here's Why

| Filed under: Icky Icky PooTech Talk

We're so glad we've never uploaded any of our stuff onto Facebook!

You Facebook users are SCREWED.

Did you know that everything you've loaded up into your profile (personal pictures, etc.) belongs to Facebook, even after you've closed your account?

That's what it says in the Terms of Service you agreed to when you opened your account, apparently.

The Consumerist recently uncovered this disturbing info and it's causing quite a stir.

So, what does this mean?

Basically, Facebook can do whatever the hell they want with YOUR STUFF.

And, they can do so WITHOUT your permission.

For example, they can license your personal pictures out to companies, make a shizzle of money and don't have to give you a dime.

Sounds really, really shitty and sooo shady!!!!!

That really sucks. Totally shady. I'm not super worried, but it's still creepy. Don't talk smack about people, post personal info or slutty pics and you should be ok. I'm going to delete all my daughter's pics right now though. BOO!

  2. 102

    You only just realised?

  3. aj says – reply to this

    103

and by stuff do you mean your kiddie porn stash?? fuck, who's dumb ass enough to post stuff you could get in trouble for anyway?? boycott facebook, YEAH RIGHT stoopid

  4. 104

And why would they want to do that? Paranoia!

  5. 105

    .
    .
    .
    FACELESS CROOKS!
    .

  6. 106

Obviously if there are young people from Canada that are suing them for copyright infringment then they are actually being creepy and doing shit like this. I think that the worst part about it is that they know that people don't read the "fine print" and that they are duping a million people over into giving them their crap without them really knowing what is really going on. Even if this is old news there are plenty of people that were not and are still not aware of the terms that they agree to. I dont have anything on there that could cause problems for me but it does make you think twice before you just agree to terms in the future. I never even thoiught about them USING anything of mine. Which is fine really cuz I don't have anything on there that is worth anything. I will just be sure not to open any other accounts similar to FB or MS.

  7. 107

    not a surprise at all.

  8. 108

Ok did not know that….that's just wrong! They shouldn't have the rights to YOUR photos. That's just creepy and wrong. I'm thinking of deleating my account but is there any point when they already have info and pics on me????

  9. 109

thanks god.. I don't have a facebook account. I hate these kinds of websites. Also I don't need to find my old friends we're meeting all the time. Facebook sucks!..

  10. Theo says – reply to this

    110

I don't care. I have nothing on Facebook that is marketable enough to sell to anyone.

  11. 111

Like facebook is really gonna publish anything about you unless you're a famous human being. And if they do its your fault for putting too much info on your site anyway. What could facebook really get from any of us? Do you really think they can get any money from our everyday normal non interesting lives?

  12. 112

wtf!!!! grr no wonder my name and pic was floating around some website i had never been!!!!! so0o upsettingh!!!

  13. 113

shit i am obsessed with facebook!!! i spend most of my day on it, why the fuck do they want to keep pictures and shit that we have loaded onto the website? what do they intend to do with that?

  14. 114

myspace does the same thing. it sucks.

  15. 115

Not just incriminating photos but music, poems, anything you post is they now own and can use anyway they see fit think about that. As someone who post alot of writtings on myspace I am so glad I never got facebook. I won't be doing it now.

  16. 116

Wow, that's f***ed up, and just plain weird. I presumed something was "out of place" with them when I tried to configure my cell phone so I could upload pictures directly from it. In MySpace you have to create like an account within an account to upload, so you send your cell phone pictures to a MySpace e-mail account you create, so that seems more "private", but in Facebook you're given a very generic 5-digit number, that, I'm presuming, everyone uses, to upload your pictures. When I saw that, that had me way too paranoid. =S

  17. JMFS says – reply to this

    117

who cares…nobody would pay for pics of most of us anyway!

  18. 118

    That's great, I don't have a facebook. It's all about myspace!! lol

  19. 119

hmmm good thing i hardly have any pics on my facebook lol unlike others who have hundreds

  20. 120

Like anyone gives a crap about my pictures….who cares?

  21. 121

    ughhh that sucks

  22. 122

didn't people already knows about this?
am i the only person who reads the TOS?! :o
    haha…ok, not really.
…this is why i never made a facebook
account, because a while back someone
told me about facebook owning everything
you upload…so i was like, "eh, not for me" :)

  23. 123

I use Twitter & Myspace. I don't use Facebook anymore. It's ugly, colorless & boring. No one over there has ever had any privacy. That's old news. Paris Hilton's private pictures were somehow made available to everyone last year.

  24. 124

How stupid to panic over this. They aren't gonna use anything personal. Give me a break.

  25. 125

Glad I didn't go the facebook route either now. That's really bad, though, since people are uploading stuff for their infants to chronicle their growth and now that'll be with them (the infants) forever.
What about the others? twitter / linked in etc.

  26. Fuego says – reply to this

    126

Yeah yeah so you posted photos of yourself doing a keg stand at a frat party. The real worrisome part is for ARTISTS, WRITERS, MODELS.
A lot of people network (duh!) and try and get word about themeselves through Facebook. Now facebook can gank model's photos, photos of artists' works, photographer's works, even ideas posted between friends and sell them or use them!
Before the change in the Terms you could safely and freely share your work! The parent company of Facebook FOX NOW OWNS EVERYTHING!
And believe me, I bet they have a whole crew of people stealing ideas and photos. It's now FREE art!

  27. 127

    HAHAHAHAHAHAHAHAHAHAHAHAAHA!!!

    myspace uzer!!!!

    SOMEONE SUE FACEBOOK!!!!!!!

  28. 128

Umm whats the big deal?? I dont have any pictures on my facebook i'm assamed of. There all boring pics of me and my friends. if they can find some idiot sucker that wants to buy them i guess go for it. There already on a website that millions of people can see anyways.

  29. 129

advice: read the conditions. then again, who has the time? good thing i don't have one!

  30. 130

Well, what would they want with our pictures anyways?

  31. Fuego says – reply to this

    131

Re: katgoddess – WHAT? Read the conditions every single day? They JUST changed it without notice.

  32. 132

    It's not true…

Except for User Content and Applications/Connect Sites, all materials, content and trademarks on the Facebook Service are the property of Facebook.

  33. 133

    Oh Perez,
You're full of shit, as usual. FB does not own USER CONTENT (which would include pictures). Do you believe (and falsely publish on your blog) EVERYTHING you hear?

  34. 134

    thats so fugged up!!!
    Boycott Facebook!!!

  35. 135

Yes, but you do realise that ANY website will do that?
MySpace does it as well as does most website. This website probably does it as well.
I really doubt that Facebook is the website you need to fear. You just have to make sure you don't information on it such as where you live, phone numbe etc… The government has more information on you than you want to know. I think you ought to fear them more than facebook …

  36. 136

the TOS also says that it is also subject to your PRIVACY SETTINGS that they may use your so called stuff. i personally have almost zero to worry about unless they want to release information about what school i attend. make sure to set your privacy settings so that the public cant see everything on your profile and you should be fine

  37. Fuego says – reply to this

    137

"You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your Privacy settins or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof.

    138

Re: Moluver – DID YOU READ THE NEW TERMS OF AGREEMENT??? THEY DO!!!
    ANYTHING YOU'VE WRITTEN OR POSTED.

  39. Fuego says – reply to this

    139

    THIS WAS REMOVED!!!

"You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content"

  40. Gen says – reply to this

    140

I doubt that would hold up in court if they got sued over it (which is only a matter of time, now)–it's unconscionable. So now they'll have to pony up a chunk of change for attorneys AND their "contract" will be held unenforceable.

  41. 141

Once again, I question your intelligence Perez. Perhaps you should try a little something we in journalism call "fact checking". This is straight from the Facebook page: "Except for User Content and Applications/Connect Sites, all materials, content and trademarks on the Facebook Service are the property of Facebook and/or its licensors and are protected by all relevant IP laws and other proprietary rights (including copyright, trademark, trade dress and patent laws) and any other applicable laws."
What does "Used Content" mean? It means: ""User Content" means any photos, text, link, audio, video, designs, ads and anything else that you Post on or through the Facebook Service."
So there you have it Perez…wrong AGAIN. Facebook does not own your personal stuff…seriously, don't post unless you have done at least five minutes of research.

  42. 142

Like i didn't knew that before. You're quite late. I heard about this yeeears ago, and you didn't knew about this till now? Gaaad, follow the time, man.

  43. 143

did you know that's basically what happens any time you put your pics on the internet? morons.

  44. 144

Duhhhhhhh!! Everybody knows that but WHO FUCKING CARES????

  45. 145

Like i didn't knew that before. You're quite late. I heard about this yeeears ago, and you didn't knew about this till now? Gaaad, follow the time, man. This is ooold information. This is why i never gonna make me a Facebook prof. I'll be trusting myspace.

  46. 146

I don't have a Facebook account and I'm proud of it. I am strong enough to resist all my friends trying to presuade me to open an acount.

  47. 147

Hi Perez! Hopefully I can put the Facebook issue in better perspective for you.

The operative language under the terms and conditions of Facebook to which you are referring is as follows:By clicking accepting to conditions of the contract when you register for Facebook:"You… grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof. You represent and warrant that you have all rights and permissions to grant the foregoing licenses."

  48. 148

Sooo? no one reads the terms & conditions.. so if it's problem you've should have read it.. why do people always need something to cry about. get over it!!

  49. 149

    allready knew

  50. 150

    Re: MackAdocious

"Don't talk smack about people, post personal info or slutty pics and you should be ok. "

That's 90% of the Facebook user base gone right there :P

But DO be careful what you put on there…and I'm not talking about the pedos and stalkers. My idiot friend uploaded pics of me with another guy, and my boyfriend saw them in his photos. Oops :S

  51. 151

well just deleted all the cool photos that loved to share with my family and friends :( hope facebook people never find them and make profit out of them!

  52. 152

LMFAO @ this!!! This is just the peak of the iceberg, you guys should dig a little deeper and learn why FB has become so popular almost overnight. Research it and you'll find your info is collected and ….. well, check for yourself with Google.

  53. Fuego says – reply to this

    153

Re: usoidioticRe: jimena – Me too. So sad :(

  54. 154

What people should learn is to keep their personal life private and no post shit on the web!!!!! Anyone can see this stuff. If you want it to be private keep it that way!

  55. 155

perez you need to open your eyes. the same terms of service are in google & yahoo & photobucket with those pictures & emails and everything.

  56. 156

    sux

  57. 157

good lord you will print ANYTHING

  58. 158

hey Perez this time you are wrong. U are usually a trustful source but not this time. in the Fbook agreement it says User content is still owned by the user. I think you should retract youself, otherwise you loose credibility, ant it is very important to have it since I and millions of people trust you as their sourse of news.

  59. 159

    boooo. what do we dooooooo??

  60. 160

Heh, that's why you should always read terms of agreeement and shit.

  61. 161

Stop worrying. Facebook doesn't give a rats ass about us "ordinary people". Now if were were famous like Perez……….

  62. 162

Nothing new!!! This can happen anytime you post a picture online!

  63. 163

Doesn't surprise me. I'd like to know why every time I try to get on Facebook it freezes my computer.

  64. 164

Fucking figures, I just signed up this morning after months of resisting.

  65. 165

A boy passed away a while ago, and his girlfriend tried to deleted his account but facebook denied that, even though he's dead!!!

    That's sick.
And it's not the first time that happened i'v heard.

  66. 166

If anybody who has a Facebook profile actually read the terms and conditions at the outset, they would know this. If you were too dumb to read them then that's your problem. Every networking site does this…

It cracks me up how all the sheep just follow whatever Perez says. If next week he posts a blog that Facebook is the greatest, you'll all be agreeing with him then too.

  67. 167

the way i look at it is if u dont put any embarrassing photos like idiots put on of them drinking or doing drugs or being naked then who cares if they have access to my normal pictures with my friends…..o well.

  68. Fuego says – reply to this

    168

Re: Lulustre – THEY CHANGED THE TERMS, IDIOT

  69. 169

wtf are they gonna do with my pics? do you know how many people are on there?? maybe celebs should be worried but not us..

  70. 170

    wtf
    that is some sneaky shiz

  71. 171

    i thought everyone knew this!?

ITS IN THERE FINE PRINT! Just look at the information about the site…THEY TELL YOU THIS!

  72. 172

that's old news and not really a big deal. when you put something on the internet, you can't expect it to be private–it's on the internet! perez, you're getting a little too sensational.

  73. 173

Shame. Facebook is the only social networking sites that I can stand. I'm sorry but if you own a myspace page you should have to take a graphic design class before they let you touch the coding!
I blew off myspace a long time ago, and everytime I try to visit on of my friends on there, I DON'T MISS IT! No one wants to hear your music, see your flashing glitter graphics, and WTF CONTRAST people, LEARN IT, USE IT. :)

  74. Fuego says – reply to this

    174

    Re: o0xali
A lot of artists, photographers, models and writers use facebook to network and share their work. Technically, facebook owns all of it under the new Terms of Service.

  75. sof says – reply to this

    175

it's the same thing with myspace. What else do you expect with putting your stuff online, for the world to see?

  76. 176

they keep your stuff when you close your account so you can reopen it later because they know no one can stay away. And if you're stupid enough to put extremely personal shit on there then it's your own damn fault. GET OVER IT leave facebook alone!

  77. 177

Myspace used to have that policy. They quickly changed it after it became public knowledge.

  78. 178

    DAMN IT! WTF

  79. 179

For those of us who DO READ (!!!) old news. They can show my hot (spread) ass all they want!

  80. Fuego says – reply to this

    180

  83. 183

    well then. lol.
tooo bad whatver you put on the internet expect it to be shared everywhere.

i guess i'll just figure out what to do with my facebook. lol

  84. 184

haha. thank god i only have 1 picture on facebook & i only get on like once a month.

    eh, that sucks.

they should've put it in BIG LETTERS.

  85. 185

I've been on myspace for years and am extremely dismayed that ALL OF A SUDDEN - everybody I've ever met is now on facebook! I've been looking and looking for my friends on myspace - which is a much cooler site for a graphic designer like me… but the geezers never joined! Wow, with this new knowledge, I might close my facebook account!

  86. 186

oh boy. i can't believe facebook anymore. i'll just use it to stalk.

  87. 187

You do realize that EVERY online service has a form of this agreement, right? Myspace, hotmail, gmail, yahoo, EVERY online service.

  89. 189

My post on facebook - informing users of these SECRET TOS - has been deleted!!!! scary!!!!

  90. 190

NO SHIT SHERLOCK!!!!! THAT'S WHY i RARELY UPLOAD ANY PICTURES OR INFO ABOUT MYSELF!!!DUH!!!!!

  91. 191

    That is fucked up.

I'm glad I never started a page to share work. I have a few artist friends who have. Oops.

  92. 192

    this is scary…

  93. lena says – reply to this

    193

Does anyone have ANY record of Facebook actually USING someone's pictures and passing it off as its own?

Probably not. Because then Facebook would probably lose its user base, along with its advertisers. Just because it technically owns your photos does NOT mean it's going to sell it around for millions of dollars. Think about it realistically, people.

  94. 194

PLEASE……Could somebody tell me the EXACT paragraph and line that states the pictures I upload on Facebook gives them ownership rights to my pictures? There's a lot to read in the Facebook TOS, and I'm a bit deficient in the comprehension department…… What if I DELETE pictures from any of my Facebook photo albums before I make the decision to close my Facebook account? So they still own copies of my pictures after I've deleted them from my albums?

  95. Low says – reply to this

    195

Dang… I was just going to put all my business and non-profitts on facebook… not now until they fix that.

  96. 196

Oh you mean kinda like you do with other sites' pictures and content Mario?

  97. 197

    yes, that is shady indeed!
