Madge isn't gonna let this one go down without a fight!
After a Malawi court ruled against the material girl adopting 4-year-old Mercy James on Friday morning, Madonna has put the wheels in motion for an appeal of the ruling!
"I just filed the notice of appeal this afternoon on instructions from my client," said Madonna's lawyer Alan Chinula.
The judge believed in Madge's ability to be a loving mother but refused to break the rules for the pop diva!
"It is necessary that we look beyond the petitioner … and consider the consequences of opening the doors too wide," the judge explained on Friday. "By removing the very safeguard that is supposed to protect our children, the courts … could actually facilitate trafficking of children by some unscrupulous individuals."
How will Her Madgesty's legal team get around the problem of the "residency requirement" of Malawi adoptions???
Will Madonna be able to sweet talk her way out of the requirements???

All hail the Malawi judge who was wise enough to put a stop to this nonsense. Madonna can no longer satisfy her ego by making Malawian children her souvenirs. She’ll have to take home t-shirts and woven baskets, just like everyone else.
And it’s not like Madonna isn’t a good mother. One look at teenage Lourdes and you can see she’s done a good job. Same for Rocco, her son with Guy Ritchie: he’s described by friends as a “great kid.” Of course, Lourdes and Rocco each have active fathers – Carlos Leon and Ritchie, respectively. Madonna’s adopted Malawi son, David Banda, lost Ritchie to divorce a year after meeting him. He’s also endured her reported affair with Yankee baseball player Alex Rodriguez and has since spent time with Madonna’s 21-year-old Brazilian boy toy, Jesus Luz.
It’s not that Madonna’s “stable” family has changed since she acquired little David. Some kind of disconnect has occurred in Madonna’s thinking when it comes to the country of Malawi and its orphans. Taking them home to America or Britain isn’t going to solve the problem of poverty.
Most of us have never been to Malawi, a country that Madonna has depicted as so poor that she must remove its children for their safety. She’s burnished this image so completely that yours truly was surprised to meet a group of Malawi businessmen on a flight in Zambia two years ago. These well-spoken gentlemen were on their way to a weekend retreat – just like businessmen all over the world.
I asked them, What about Madonna and her adoption of little David Banda?
The man sitting next to me said, “We wish she’d stop kidnapping our children.”
The fact is, as the linked document from the Malawi HRCC shows, Madonna could just as easily help Mercy and even David not by taking them home, but by writing checks to help them and all Malawi children on the spot.
Good for her. David's father said that if Madonna hadnt saved his son that he would have buried him. Living in a crowded orphanage ravaged by AIDS and malaria the same fate may awate Mercy if she does not get the help she needs. Her charity Raising Malawi has helped over 25,000 kids in Malawi and she has been trying to adopt Mercy for a year and a half.

She then lived the rest of her childhood bouncing between 2 states (2 families who were "trying her out"), before settling in (at age 9) a OK foster home. She was never actually adopted by a family, do you know why? Because she wasn't an infant and because she was thought she was better off than the children in developing countries. I'm not saying that it's alright to let all these kids live in poverty, but why can't these rich people adopt from their own country and help out the other countries? Why can't she help these orphanages by providing more staff, more medical equipment, and just better overall conditions? Why must she take one child out of these conditions and leave the rest to rot? If she sponsors more than one of these kids, many of them will have a great chance at survival. Why not make more people aware of the conditions via the media?
She could do all of that AND save a child let to rot in this country. You think that because these parentless children live in the United States they are less needy, this is far from the case. I have met men and women who grew up in despicable environments, whether it be in a foster home and/or a group home. Why can't these people help those who need it right here at home?
