Texas judge allows collection of dead son's sperm
A judge has granted a mother's request to have someone harvest sperm from her dead son's body, so she can have the option of carrying out his wish to have children. Nikolas Colton Evans, 21, died Sunday at a Brackenridge hospital after being punched and falling outside an Austin bar March 27.
His mother, Marissa Evans, told the Austin American-Statesman newspaper that he wanted to have three sons someday and had even picked out their names: Hunter, Tod and Van.
"I want him to live on. I want to keep a piece of him," she told the newspaper.
Travis County Probate Judge Guy Herman ruled Monday in an emergency hearing requested by the mother, because of the urgency of collecting the sperm intact.
Court documents said the sperm had to be collected within 24 hours of Nikolas Evans being removed from life support unless the body was cooled to no more than 39.2 degrees.
Herman ordered the county medical examiner's office to continue storing the body at the proper temperature until the sperm could be collected.
Other organs and tissues were already going to be harvested from Evans' body, the judge noted, and there would be no other remedy for the mother if time expired.
Evans and her attorneys were trying on Tuesday to find a urologist or other medical professional willing to collect the sperm for a possible surrogate pregnancy in the future.
University of Texas law professor John Robertson, who specializes in bioethics, said state law gives parents control over a child's body for organ and tissue donations but its use for sperm "is very unclear."
"There are no strong precedents in favor of a parent being able to request post-mortem sperm retrieval," he said.
No arrests have been made in the assault on Nikolas Evans. Investigators said Evans hit his head on the ground after he was punched during an argument with a group of men.

Very slippery slope, Not that this is so much a moral thing but we aren't God and things can spiral out of control, creating more Octomom scenarios. I dont think something is right about this. I mean tons of parents have lost their kids in untimely deaths (May they rest in peace) but I think mom is acting a little loca la cabeza. The mother claims that her son always looked forward to having kids. I'm sure his goal was to have kids that HE raises. As a mother, I could never fathom giving up my eggs and allowing someone else to decide their fate. It's just wrong. It's also a highly selfish act on the mother's part. I would never wish to be in her position, but she's trying to hold onto whatever she can of him. She needs some help, seriously…grief counseling would be a good start…not the courts to obtain sperm.

This is wrong on so many levels and this judge is an idiot.
I live in Austin, and this has been a really big topic on conversation. Personally, I think it's kind of gross that the mom would want his sperm in order to create a baby. It just seems like she doesn't want to let go, which is really unhealthy. At the same time, I guess it's her right to do what she wants in order to cope. I think a bigger issue is that this kid was beaten to death outside a popular, crowded bar in that area. Austin has never been typical Texas, but it seems like it's going that route more and more these days. THAT is sad.

it is a little strange…but i think she's just really devastated at his sudden death and this seems to be a solution. who knows if she will go through with it…she probably just wants it to be an option. i have one child, a son and if he died so young and unexpectedly, i dont know how i would feel. we shouldnt judge her so harshly. i cant imagine losing a child.

I've never heard of such a thing and honestly such a scenario would never have occurred to me. This just seems like another case of someone desperate to hang onto any piece of their loved ones because they can't let go or accept their death. It's like those parents that want to have their dead kid cloned. They're not thinking clearly. What kid would want to grow up without parents because they were conceived in this manner? I don't think it's ethical.
That kid was 21, NOT AN UNDERAGE CHILD. That mother has no claim whatsoever to her son's sperm, and I hope to God she doesn't try to use it for herself. How would she find an egg donor, or a surrogate? It's the SELFISHNESS this country has come to. It's disgusting.

oh, i forgot to mention, and there's no difference between this post-death than guys juzzing off in little cups at the sperm banks or women undergoing hormone injections to donate their eggs. so yeah, kudos to the judge, and this gives hope to other people, especially those that may have lost a spouse. i wonder if this is available to harvest a female's eggs? i can't remember if eggs can be frozen. i'm sure they can since embryos can be frozen. so yeah, give it a rest people. it's all okay.
