A Date Is Set, Fighting For Mercy
As we've mentioned before, Madonna is trying everything she can to adopt little Mercy James from an orphanage in Malawi.
And what her Madgesty wants, she usually gets!
The appeal case to her failed adoption has now been pushed to May 4th and will be heard by a three-judge Supreme Court of Appeal panel in Malawi.
According to Joseph Chigona, the registrar of the High Court and the Supreme Court of Appeal, he said today that "As with all court cases involving infants, this one will be in chambers, not in an open court." Though you know someone will definitely be leaking the new$ to the media about what happens behind the closed doors.
Madge is not required to be present during the appeal process, which is good considering it can take up to two weeks.
Her attorney seems hopeful, stating that "We believe the lower court judge erred by basing her judgment on an archaic law of over 50 years ago."
Again, Madge is willing to offer this little girl a great life. Why deny her of it?

Um, a 50 year old law is not archaic. As a matter of fact that is considered a new law. It's a law that was created to protect children from child traffiking and when you start chipping at laws it no longer serves it's purpose and puts other children at risk. Africa is a very corrupt conitinent that is why it needs such stringent laws. The judge in David's adoption should have considered this. She also has a father who wants to be a part of her life and his rights should be considered.

Every other couple who is looking to adopt a child needs to comply with the adoption laws and regulations. Madonna included. Bitch needs to realize that money can't buy everything.

I think Madonna should be allowed to adopt Mercy if she follows standard legal procedure in foreign adoption. I heard a lady talking recently about trying to adopt abroad and it was going to take 4 years before she would be able to actually bring a child home. While this time period is excessive, I think all interested parties should be treated equally. I would also have concerns regarding Madonna's ability to parent this child properly as she seems to be away on tour a lot and no longer has a husband who would be at home with the children. Also I wonder whether Madonna would go the way of Tom Cruise and Nicole Kidman and lose interest in her adopted children.

No. She should find a child who doesn't have extended family who love her and visit her but can't afford to care for her but also don't want to never see her again. There are plenty of children all over the world with absolutely no one. If her heart is open she'll adopt one of them.

Perez, you are defining a great life by material possessions and a western mentality, which absolutely does not fit in with the African culture. Yes, she is in an orphanage, but Mercy has family in Africa. She is visited and loved. Disregarding the laws to let this go through absolutely sets a precedence for child trafficking, the very offense the law was designed to stop. As a rule, Milawi doesn't want moneyed individuals from around the world shopping for poor children in their country, which, unfortunately, they have TOO MANY due to poverty and sickness. Of course, having health care and education from Madonna's resources would be better for this child, but then why doesn't Madonna just donate those resources?! Support her African life and culture with her existing family?? Why does Madonna need this little girl, when it is not consistent with the laws of Milawi for her to proceed with the adoption - there are children all over the globe she could easily adopt. I don't understand Madonna's pursuits in Milawi; they aren't right, legally or morally. I'm so in favor of adoption, but not in circumventing laws designed to protect children, and not in imposing our western culture on other people. If this legal aberration is set, it will be abused… and far more children will be hurt than your (mis-)perceived "saving" of Mercy.

I'm pretty sure I have worked harder in my entire life then Madonna ever has. Raising childeren with the help of nannies and millions in the bank is a piece of cake.

You know, the judge was upholding a law to stop illegal adoptions. The requirement was for Madonna to live in the country for 1.5-2 years. Why is she above the law? If it was just one us of 'average' people we would never be able to adopt a child from that country. There are laws and I understand why the judge ruled the way they did. Madonna thinks she's above the law. Not good for the rest of the adopting world.

It can't even be called adoption because she is using money to push her way through the system and adopting children who still have living family members (who would probably rather keep their family member in Africa and just have her support). It's because of celebrities like her that the number of children with living parents/family being given up to orphanages in Africa is rising…what she is doing is wrong and I hope the deny her appeal as they would any other under these circumstances

The father has not been around- EVER! The girl has been in an orphanage since BIRTH! Of course he comes crawling out of the woodwork now that M's money is involved.
The Grandma (who apparently is to have custody after the child is 6??) has not been involved with the child either. THE GIRL HAS BEEN ROTTING IN AN ORPHANAGE SINCE BIRTH!!! Why is it ok for the grandma to resume custody after age 6, while all of the child's formative years are spent ALONE WITH NO ONE?
This situation is sickening. This is a young girl's life that is on the line.
