The pop starlet no longer has to make an appearance in court for the showdown between Daddy Spears and Osama Lutfi!!!
Daddy Spears is seeking permanent restraining orders against Lutfi as well as Jon Eardley, the lawyer who is said to be helping B. Spears have the conservatorship void!
So why doesn't Britney have to show???
A Los Angeles Superior Court Judge has found that Spears "lacks the capacity to testify" and will not be required to go under oath.

Brit Brit has the capacity to take on a world tour but not a courtroom judge???

She didn't commit a crime, but she is accusing someone else of committing one. If she really agreed with the charges, she would be there to face this person her estate is accusing. Especially since evidence has been presented that she reached out to these people to represent her, while her estate says otherwise, I think her clarification one way or the other would be necessary to make a ruling. I also think that she should not be touring if she isn't well.

Daddy Spears is trying to hide the fact that she is a cookoo bird. She runs on autopilot when she has to, otherwise she's not fit to babysit a rock.
She can lip sync and semi dance, but she doesn't make ANY business decision regarding her tour. Even a crazy person can lip sync and dance. The woman/girl can't even make sound decisions about her personal life and the creeps she brings into it. She needs and has a keeper. Poor Jamie, it's a life sentence. As for all the crazies who think Britney needs to be in control of her own life, the decision is made bye the COURTS based on MEDICAL information, not just what Jamie says. At the least she's bi-polar and they tend not to take their meds if no one is watching. I don't want to see her coochie again.

You aren't given a conservator without psychiatrists saying your not mentally stable enough to control your own life. You can't buy that kind of diagnosis. You see it even in her tour with the crap she's yelling out and not dancing much. It's the people around her putting on the show.
Re: Shakermaker – That's not true Shakermaker. If you are even a witness to a real or purported crime, you can be subpoenaed and required to appear in court. You don't have to be a criminal to be required to appear in court. Lawyers *canNOT* testify in the place of a witness to a crime.

"Lacks the capacity" doesn't sound good. I think the doctors found she is stuck at a child's age mentally, which means legally you are not an adult. She's bipolar, and I bet she's a borderline, too. Throw in heavy substance abuse and stressors (Kevin, babies #1 and #2, divorce), and we have a mess. I don't think they will be able to squeeze much else out of her after this. She'll just have enough money to go on a permanent vacation, in all the resort looney bins all over the world. All the people who want her to go away may not have long to wait. Chances are that under the conservatorship she is deemed incapable….a legally descriptive term for how she is currently viewed by the legal system as a whole. Therefore, it would follow that in any subsequent legal proceeding she could be deemed incapable. It would seemtaht she probably can't be deemed "incapable" in one legal arena and then found "capable" in another- especially while the conservatorship is still standing.
