The California Supreme Court has voted to uphold Proposition 8.
Gay and lesbian residents of this state will continue to be treated as second-class and not have access to the same rights, privileges and protections that married heterosexual couples have.
Sad. Sad. Sad.

Update: The one glimmer of good news is that the 18,000 gay marriages that took place while it was legal in California will continue to be recognized and remain valid.

Webster's contemporizes their definitions to suit new useage. It is not the legal definition in most states and in most countries. Prior to the last few years, it has not been the social definition either. You can use recently changed laws or definitions all you want. It will NOT change the history of the word OR the way that people view it. Feel free to state your own opinions. I actually want homosexuals to have the right to have a bond as binding and defined and with all the rights as straight people have. I am making the point that there is a long history of the word marriage and it has been a hetero word. And some people, including myself, believe it should describe a hetero union. Not everyone has to believe what you do.

For those of you with no concept of how courts work… Prop 8 AMENDED the State Constitution. The State Supreme Court CANNOT disregard it even if they find it discriminatory - which is what they said today (and why the 18,000 married gays get to stay that way). The Court expects, as do all California voters, to be asked to vote on yet another amendment that would overturn Prop 8. It's stupid and wasteful but this is the process in California. The question of gay marriage is by no means a closed issue. Just look how many times we've passed, then overturned, then passed, then overturned, then passed, then overturned parental notification for minors seeking abortions. The gays will prevail eventually. It will just be a slow and expensive process.
well i have to say honestly i am glad they uphelp this decision for 2 reasons. 1) the majority of the voters voted on this and that should be the main reason. you can not take away the voice of the people just because it does not fit in your beliefs. 2) i am someone who believes that marriage is a union between a man and a woman. i do not think it should be for same sex couples. now i am willing to concede and give the same sex couples civil unions. while i dont agree with the choice of lifestyle (yes it is a choice, and nobody can convince me otherwise) they should not be treated unfairly IF they have been building a life together and debts together. i think of the victims of 9/11 who had partners who lost their other partner and couldnt defend their assets from families,etc.. from taking away from them because they had to "legal right" to stand behind. for this reason only i think civil unions should be allowed. i have no personal issue against gay people but i just dont agree with their choice. on a side note, perez you make it hard for any straight person to take your side or be willing to fight with you because of how cruel and demeaning you are to people who oppose your view. the way you treated Carrie Prejean was tasteless and low class.

Divorce wasn't even an option back in the day. If there's one thing that is certain, it is that the human race and all of our superstructures are always in flux. as a californian i'm horrified that prop h8 passed, but i'm happy that the supreme court is at least still recognizing those 18,000 marriages (which means a dear friend of mine and her wife can stay happily married =])

Marriage has always been between a man and a woman. Changing that is wrong. Discrimination is wrong. Why can't people be gay and not get married? Make up your own gay marriage…call it a gayrriage and throw rice and exchange rings and all that…invent your own gay marriage…

I don't discriminate. I think all people should be treated with the same EQUAL rights.
This is disappointing.
They let the people vote. It's the people that voted this time. The court in San Fransisco previously went against the constitution by making the decision without the people's vote.
This time, it's the people that spoke out.
I'm not saying that I don't support gay marriage. Personally, I think what people do with their love lives should be left out of politics.
