Sir Elton John, who married his Canadian partner David Furnish the first day civil partnerships were allowed in England, spoke to etalk in Canada about the ruling today, saying:

“That's just awful. I mean when you see places like Iowa saying yes and there's now five states [in favour] in America…and California is supposed to be a progressive state it just defies logic to me and I’m very disappointed with that."

    Religious people: You are hateful. Gay marriage is a civil rights issue that should NOT be subjected to people's opinions.

    The STATE is secular and should NOT discriminate (not on the behalf or homophobic, religious and cultural groups). It's the tyranny of the majority.

    Would the state ask Christians to decide on whether Muslims should be allowed to practice their religion, vote or hold government offices? No!

    In the 1970s, 70% of Americans thought laws banning interracial marriages should be upheld. The state, rightfully so, did not listen to the public because it was a Civil Rights issue.

    You know, the state supreme court was not deciding whether or not gay marriage was a good thing or a bad thing, they were deciding whether or not Prop 8 was constitutionally sound. The idea that they're being close-minded or backwards is insane, they were judging the issue without bias. Which is obvious since in 2007 the same court decided to legalize gay marriage.

    P.S. Marriage is absolutely a religious issue. Since the beginning of civilization people have been going to their religious leaders for marriage, not their government. I have no problem with gay marriage, but I do have a problem with mixing chruch and state. So let's keep them separate, shall we?

    P.P.S. Everyone keeps complaining that President Obama hasn't said anything about gay marriage in California. Good for him! This is not only completely beyond his jurisdiction, it is also a state issue.

    anybody with half a brain knew what that decision was going to be before it came out. why is anyone surprised or outraged? the only thing it was about was whether the proper procedures were followed with prop 8 (they were) and what to do with the marriages that happened before it was passed. in fact, it was a good result on that point. the judges can't just make up the law- the people spoke, a law was passed, and they have to respect it whether they like it or not. if the gay community wants to overturn that, they just need to convince a few more voters and get another prop on the ballot— the law is all about due process and procedure. procedure was followed. that's all this decision was about.

A civil and religious contract for LIFE? Why are people able/allowed to divorce then? Securing the maintenance and education of their children? How about couples who get married with no intention of having children? How about hetero couples who are in no way religious, but allowed to be married in a church…'before god'…what a big joke that is!
    The definition of marriage is antiquated.

    California WAS one of the first states to support gay marriage! The Courts allowed it- the voters just took it away. With all of the gay celebrities, I don't see how they can't just mount their own campaign to get a new prop that repeals prop 8. It was such a close vote, they (gays- hollywood gay celebs with loads of money- all supporters of gay rights) just need to put their money where their mouths are and get a new vote! This is not rocket science- they just need to get people to care and to vote… that's how the other side beat them, and that's how they need to turn it around. Simple as that… and if they can't, then they should move to a more accepting geography. (I know that's not fair, but I think it'd be a bold statement if all of the gay celebrities left town.)

    This is about a Biblical word that defines marriage. Stop acting like it's a fight for equal rights. You can have the same rights just call it something different. A marriage is defined as btwn a man and woman. If all these gays really cared about their 'rights' they would use a different word and put an end to all this.     no they didn't what? you mean the voters didn't take anything away? i don't think the gay community would agree with you, even the ones that are well-versed in the domestic partnership act. i don't know all the specifics between the differences in california's domestic partnership act and actual marriage— but melissa etheridge's comment says stuff about getting to have an alien spouse become a citizen, tax benefits, etc. in any case, regardless of all that- the voters did take something away from the gay community that the courts had granted them. that is indisputable. i see your point, that you can legislate around this and the dpa gave them ALMOST identical rights- but i think most gays find that insulting that they have to take a separate bus. i don't think equating gay rights with racial discrimination is 100% fair, but yes, it is quite similar to forcing them to take a different bus. they might end up at the same destination, but it's not the same thing. they're still being treated differently- and the law does say that different is not equal. and i agree.

    Re: lovernotahater – You bring up a good point, but we have to remember that laws are not just voted on once then thrown in to action, it's an ever changing process that includes things like legislation, court rulings, bills, props, etc. So even though some people might have a difference of opinion with issues, the American government is set up so corrections, amendments, changes in general can be made if need be. Gay marriage is now banned from the state of California, but in ten years that might change. People who are sooo angry about today's ruling are forgetting that there's a future, and that's what's most important. Long term consequences will shape us all. Maybe our grandchildren will call us bigots, maybe not. It really depends on where we lead our country.

    Also, the country already voted on an interracial president and said "Go for it!" Majority rules!

    i agree with what you're saying in principle- but it wasn't exactly like that. the COURT enterpreted the laws to say that they allowed gay marriage b/c the laws weren't explicit (i.e., they didn't say, "gay marriage is allowed"). then, b/c it wasn't explicit, the people that are anti-gay marriage started their movement to get it explicitly stated that it was NOT allowed. it's probably more complicated than that- but it's not like the court said one thing, and then another. the court said one thing, then the people demanded a law that says something else. the court has to respect what the people said.

    Someone should explain to Mr. John how our country works. The voters have the final say on issues. Unless you live in MA where judges legislate from the bench and don't give people a chance to voice their opinions. It comes down to states' rights.
