Custody Battle Begins At Birth

Gossip Girl's Kelly Rutherford gave birth to her second child with estranged husband Daniel Giersch on Tuesday.
Daniel has yet to visit his new daughter as he is in the midst of negotiating how much time he is allotted in the hospital. The kid isn't even a day old and she already has to deal with the craziness of her parents.
Daniel reveals: "We are currently negotiating how often I am allowed to go to the hospital. The only thing the judge said in court last time is that I can see my daughter three times a week for one hour."
But of course, he is going to fight the ruling to gain some more time and he has some ammo this time. For one thing, he was barely informed of his own daughters birth, receiving a call at 8:45 Tuesday morning, when Kelly was already way into labor.
And, on top of that, Kelly left her young son, Hermès, at home to have the baby.
“Kelly is not allowed to stay away from Hermès more than three hours. If that's the case she has to call me so I can take care of him.That's what the judge said," Giersch explained.
Boy, the judge sounds like the real parent in this scenario.

WAIT A FUCKING MINUTE… "On top of that, she left her young son at home to have the baby". Well what the fucking hell was she SUPPOSED to do? Drag her tiny toddler behind her while she mopped up amniotic fluid, leaned over to have a huge epidural needle inserted into her spine, and scream through agonizing pain as she pushes the new baby out?

Parents generally leave young children at home in the care of a relative or other trusted person when they have another child. Why would you drag along a toddler, who will get bored, unruly, and probably upset and confused when they see their mother getting wheeled around in a hospital, in pain, on drugs, bleeding, etc?
There is something wrong with this guy if he only gets 3 one-hour visits a week…the judge is protecting the kid from something.
And hey, maybe…just maybe…the birth wasn't planned and she may have had to rush off to the hospital. Pardon her LABOR…she should have stopped the contractions to give you a phone call so you can watch the kid instead of the sitter. Talk about nitpicking…what a jerk!

some of you people are just idiots. it's very rare that you find someone that gives birth in a matter of two hours after the water breaks, please! i think the whole custody on these children really shows how much of a vindictive bitch kelly is. i mean, unless he's molesting the children, their failed marriage shouldn't come between a parent/child relationship.

Sometimes labor gets hectic. Maybe it took awhile for her to let him know she was in labor. Sorry, but her medical condition isn't his business anyway. He should be informed after the birth. And as to the custody issue…she might have been BUSY having a baby…a little too busy to think through her custody arrangement, stop contractions, stop all the medical staff surrounding and scream 'Hey, somebody get me a phone! I can't believe I left little Hermes with a sitter while I raced to the hospital in labor…damn me to hell! Stop the contractions…I need to call his father pronto.' Hey guess, STUPID, medical emergencies…like the sudden onset of labor…usually trump a custody agreement for ONE night. Things happen. That's life. He'll get over it. And by the way, maybe she DID do this on purpose. Maybe she does think he's a danger to her son, and she didn't want to go through the agony of labor while worrying about her son's safety. Point is…you don't know. But there are many plausible explanations for her behavior. So shut up.

He is referring to right of first refusal. If the custodial parent has to be away for a specified length of time, they are obligated to offer the care of the child to the other parent.
The battles have only begun between these two. These feuding parents are going to look back several years from now and be worn out and exhausted from the custody fights and the time they spent on them. Ridiculous. The children will feel the negative vibes because children aren't stupid.. They of course will feel the tug of war between these two warring parties…it will affect them for the rest of their lives.
What an Asshole. I think she probably had other things on her mind…She doesnt need to be dragging her small child to the hospital to wait out the birth of his sibling. What an inconsiderate piece of work.
She is lucky to be rid of him…too bad he wont be far off for the next 18 years.

3 hours a week for the dad and 165 hours a week for the mother. That certainly does not seem equitable. Didn't you read the article - he's supposed to have custody of the son when the mother has to leave him for more than three hours - either to go to work OR to give birth to a new baby which would certainly take more than 3 hours.

And even if she didn't have time to call the father she should have told the babysitter to call the father to come get HIS child.
