Michael Jackson is claiming ignorance when it comes to the lawsuit filed by his former publicist, Raymone Bain.
Bain is suing for $44 million in unpaid publicity and management services, receiving a default judgement after she was unable to serve Jackson. In one attempt to deliver the papers, a security guard told the process server to "get the fuck out."
Jackson claims to have never been served nor to have any knowledge of the lawsuit.
But we imagine that Jackson is aware of very little these days!

michael only became aware of this lawsuit on june 7th and not by way of summons but from his former manager frank dileo. mj quickley appointed his legal time who are now in charge of it.
michael happens to have a very strong case.
on december 27th 2007 both michael jackson and raymone bain both signed something called a payment and release scheme, and by doing so raymone acknowledged that she was NOT OWED ANY ADDITIONAL MONIES UNDER ANY OTHER AGREEMENT FROM THE BEGINNING OF TIME UNTILL DECEMBER 27TH 2007.
not surprisingly, this payment and release form is absent from any of raymone bains filings with the court.
as part of the payment and release agreement raymone bain signed into in 2007, she was paid $488,820,05 and was fully satisfied, with total acknowledment that NO OTHER MONEY was owed to her under ANY past agreements.
this makes it clear why she avoided mentioning this release agreement in her complaint against michael.
it seems she just wants a piece of the THIS IS IT tour…
michael owes her nothing and she knows it.
This lawsuit is bogus.. Ramone Bain ( the women suing Michael) had already received her last payment from Michael in 2007 and signed a document stating that he was thru w/ her. Now she's coming back for more, like all the other people after his money.

And the papers were supposedly given to Michael's manager Dr. Tohme Tohme wo was fired in May. He only found out about this crap after his manager heard about it in the media.

Major Court Update June 18, 2009
Today, several key motions were filed by Michael's defense to both respond to and oppose Raymone's claims. A summary of the VERY REVEALING claims as made by Michael's attorneys is included below:
- On December 27, 2007 both Michael Jackson and Raymone Bain entered into a "Payment and Release Agreement" whereby Raymone acknowledged that she was "not owed any additional monies under any other agreement from the beginning of time until December 27, 2007." As such, Michael's team claims that "any monies allegedly owed under the May 30, 2006 agreement between the parties were extinguished under the Payment and Release."
- The defense notes that this Payment and Release form is, not surprisingly, "completely and conspicuously absent from any of Plaintiffsâ pleadings and filings with this Court."
- More legal jargon which ultimately reiterates their stance that Raymone's claim is legally "not only without merit, but is frivolous."
- A deposition from Londell McMillan confirmed that Raymone Bain, as part of the Payment and Release Agreement she signed into in 2007, was paid $488,820.05 and was fully satisfied, with total acknowledgment that NO OTHER MONEY was owed to her under ANY past agreements. This makes it clear why she avoided mentioning that release agreement in her complaint.
- The actual payment and release agreement states, in part:
Mr. Jackson shall render a payment made payable to you [Plaintiffs] in the amount of four hundred and eighty-eight thousand, eight hundred and twenty dollars and five cents ($488,820.05) as full and final satisfaction of any and all monies, known or unknown, to be owed to you by the Jackson Parties with respect to any and all agreements whether verbal or written that you may have entered into with the Jackson Parties from the beginning of time until December 27, 2007 (the "Payment").
This agreement contains the entire understanding between and among the parties hereto and supersedes any and all prior understandings, agreements, representations, covenants, warranties, and releases, express or implied, written or oral, between any of the parties.
The defense argument goes on to describe how the court will have to uphold the agreement put in place by Raymone and Michael Jackson in 2007, and how her claims exist based on "hearsay lacking any evidentiary support." Also, information and past court cases are cited as to why she cannot freeze any of Michael Jackson's assets or accounts without first obtaining a judgment, which again would be very unlikely given the release agreement acknowledging that she was owed nothing more regardless of any past agreements.
The defense argument goes on to describe how the court will have to uphold the agreement put in place by Raymone and Michael Jackson in 2007, and how her claims exist based on "hearsay lacking any evidentiary support." Also, information and past court cases are cited as to why she cannot freeze any of Michael Jackson's assets or accounts without first obtaining a judgment, which again would be very unlikely given the release agreement acknowledging that she was owed nothing more regardless of any past agreements.
In conclusion, with this BINDING AGREEMENT now revealed and on the table, Raymone has "no viable case against the Jackson Parties and are therefore unlikely to succeed on the merits."
In addition, the lawyers state that "because of the existence of a valid and binding payment and release agreement between the parties, this action came as a complete surprise to [Michael Jackson]… Despite rumors and innuendos that may have surfaced before that date, Mr. Jackson did not conceive any lawsuit would be possible based on the payment and release agreement executed by Raymone K. Bain."
Michael Jackson submitted a signed declaration to these facts.
The defense is also calling for the dismissal of Raymone's complaint based on the agreement she signed into which prevents her from profiting any further from Michael Jackson and contradicts her very claim.

She is NOT claiming that she never was paid because MJ paid her. Her lawsuit is for three different things that she claims she must be paid for.
She claims that she is entitled to be paid for stuff that occured after she was fired.
So, what Raymone is saying is, as the President/COO of the Michael Jackson Company, she wants.
* 10% of what MJ may be making from the album Thriller 25
* 10% of what MJ received from the refinancing of the loan on the SONY/ATV music catalog
* 10% of the AEG agreement, his upcoming shows in London. It have been rumours saying MJ will get $400 million for his shows. He has NOT yet been paid so why can she even claim that? Its BS:

Exactly… It's just like a former owner of a home putting there house up for sale, someone else buys there house, and then the past owner's get upset at the new owner's b/c they no longer can gain any assets from the home's value since the new owner's bought what they sold. lol Michael was not the only person who bid on that catalogue, but in the end Michael's savviness, as well as the savviness from Michael's lawyer, and Michael's good fortune helped him earn that catalogue fair and square. And like you said that was so long ago…. some people just can't get over it. Heck if Paul M. did own the catalogue still, he wouldn't be sharing the profits with "Zombabe" anyway.

Re: MJ ROCKS!!! – Hi I was hysterical yesterday. This was one rumor that I wished over every other would have been a big fat lie. I didn't want to wake up this morning b/c I was scared that I would get up and see that all this really wasn't just a dream. I can't believe Michael is gone. He was an angel here on earth who was called back home. All my heart goes out to Prince, Paris, Blanket and the rest of his family. Michael was under stress his whole life, alot of that stress coming from people who got a thrill out of bashing his name. It's no surprise that Michael had an issue w/ prescription drugs in the past and he had acknowledged that. I think his doctor could have possibly overdosed him. I am so sad, and shocked and I feel for all of us fans as well. This world will never be the same without Michael Joseph Jackson. I miss him already. I'm glad that he is now in a place where he doesn't have to encounter so much hate anymore. He know's that his fans, family, and children adored him. I hope he did not suffer in the end, that is my worst fear. Love you more Michael. Forever our King.

well im not sure about the USA but tonight here in the uk michael is no.1 on both the album and singles chart, its his no.1`s album and his man in the mirror single. its such a shame he is not here to see it, how ironic though, everyone wants a piece of him now, i wish he had the love and respect he so very much deserved when he was alive as he is getting now. thats all he ever wanted, was to be accepted but the damn media wouldnt leave him alone.

Michael always said that he couldn't understand why the media deemed him to be so weird etc. He knew who he was and that is why he didn't feel the need to constantly defend himself against the media bullies. It's so hard looking at people speak so highly of him now, but just last week people were dogging him out. I can't believe how some people can be so cruel to such a sweet, caring, and very misunderstood man. The fans knew who he was, b/c we took out the time to get to know who he was. You also did a wonderful job on defending our King and yes I will most definitely be in L.A. for the memorial and or funeral when they have it. Re: MJ fan59 – great, i take comfort in the knowledge that you will be attending his funeral, there is noway i could get to LA as much as i would love to attend. if it was just me then i could possibly afford the airfare etc but i have 2 children so is not possible. i will be watching the coverage on tv though along with the rest of the world.
also there is a vigil being held at the o2 arena in london on what would have been his opening night so at least i can easily get to that.
im really glad you will be there, you deserve and need to be there, i hope you get through it as best you can.
