This band is off to a terrible start!
When three ex-Evanesence members and Idol finalist Carly Smithson formed The Fallen, they should have at least done an internet search!!!
The Fallen is already a band…and they are pissed!!!
Legal papers have been sent to the new band demanding a cease and desist order!
It seems that the new band has re-branded themselves We Are The Fallen.
A real leap from the last name!
We bet Amy Lee would never have had this problem!

The other "The Fallen" is likely a bunch of nobodies, so who cares? They should be flattered that at least their name became famous. Besides, I doubt they have a copyright on the name as an amateur band.

Re: jlenoconel – Evanescence is a whole seperate band, with Amy Lee. Amy Lee isn't in the "we Are Fallen' band or whatever it's called, three ex-members of Evanescence are.
Oh lord. I mean, they should have known that this would happen. Evanescence (Amy) owns the rights to their stuff now because everyone else officially left. They need to become more creative and not create a band to diss Amy.
No one can compare to Amy Lee, least of all some Idol alum, as important as the rest of the band is Amy was the voice behind them. I mean this new band has practically ripped Amy off as well as the original band "The Fallen", wasn't the name of Evanescence's first mainstream CD "Fallen"??? talk about unoriginal! All I have to say is I will be buying Amy's next CD and "We are the fallen" can suck my left nut.

The reason they got together is because Amy was reportedly a bitch to them. Infact, MANY band members have quit on Amy with reports of her being the biggest bitch in her universe. So another question comes up, why if they can't stand her would they want their name to remind people of Amy Lee?
That being said, they should have done their homework.
"The Fallen" is a pretty common name… They should have done their research before they named their band that.
Oh well, everyone makes stupid, little mistakes..
1.) They have always been We Are The Fallen. Check back to the earliest press releases. The Cease and Desist filing has no merit.
2.) Actually, you're wrong about the bad start, just like you were wrong when you first reported on the band last week! The buzz on this band and the new song is insane! The people in this band are former-Evanescence members, except for Carly Smithson and bassist Marty O'Brien. Amy Lee was NOT replaced. They weren't TRYING to replace her because you can't!
3.) The new SONG is fecking GREAT!!!
4.) Has it occurred to anyone that the people who co-wrote the Fallen record, which sold over 15 million worldwide, have just as much a right to play the songs as Amy Lee does?
5.) Why don't you listen before you judge? And start reporting your stories correctly. Or maybe I'm just expecting too much diligence from a bunch of green ghost writers.

Re: Devastatia – I absolutely love Amy Lee, but I will say that I had the pleasure (?) of meeting her once after a show, and she wasn't as sweet as I thought she would be. In short, I also walked away thinking, "Bitch". But I still adore her and her music, so I guess she wins.
