Jon Gosselin's Lawyers Sounds Off! He's Got A LOT To Say!
Here come the fighting words!
Jon Gosselin must be pretty pissed that TLC is intending to sue him for his ATV all he's got, so he put his lawyer, Mark Heller, right to work in making TLC look like the reasonable vicious, evil company they are!
Mark took to the Internet bloggers-sphere to file his complaint with the company that apparently has yet to serve them with legal papers. He and Jon had to read about the news on the Internet. (First of all, pot meet kettle. Second, if you have Jon in hiding, it's kind of hard for the company to serve him papers. Yeah, we know that trick - don't try and fool us.)
Anyway, here is Marks LONG statement about the lawsuit at hand and what he and Jon plan to do about it:
“Apparently, TLC has elected to initially litigate this case in the Court of Public Opinion, rather than the Circuit Court for Montgomery County Maryland because neither Jon nor I have been served with legal pleadings or informed by TLC of the instant litigation.
Remarkably, instead, I read the alleged Complaint on the internet, since it would appear that Discovery and TLC chose to pander and publicize their weak, feeble and baseless claim to the media rather than providing the Defendant with appropriate notice through the traditional judicial process.
Jon will vigorously defend against this baseless action, assuming Discovery and TLC choose to go forward with their claim by legally serving him with notice, and we are confident that through the course of litigation it will clearly be evident that Discovery and TLC exploited, manipulated and abused the Gosselins’ vulnerability and financial hardship.
We believe that the contract will be unenforceable in light of the fact that Discovery and TLC initially had Jon execute a complicated, complex and sophisticated agreement at a time when he had no legal representative. In any event, when TLC and Discovery ended the program Jon & Kate plus eight they also effectively terminated the purported contract and accordingly, any rights or obligations they perceived existed concerning Jon’s conduct or actions, rights or privileges from that point forward were also terminated.
The contract was against Public Policy because we believe Discovery and TLC violated Pennsylvania Child Labor Laws, failed to seek appropriate State and Municipal Permits, failed to pay the Gosselins fair consideration, and intentionally circumvented their responsibility to specifically designate legal and lawful compensation to the eight infant children, which is now the subject of an investigation by the Pennsylvania Department of Labor and Industry and could result in summary Criminal Proceedings.
The purported Contract was also grossly overreaching and restrictive attempting to abridge the most basic Constitutional Right that all American citizens have of Freedom of Speech. Discovery and TLC has treated Jon Gosselin like a dog by attempting to keep him on a leash and muzzle him and deny the father of eight the opportunity to earn a livelihood to support his family.
All of the aforesaid, clearly, in our opinion, renders the alleged contract as null and void, unenforceable and unconscionable.
Clearly, this litigation has heralded in the battle of ‘David’ against ‘Goliath’ and Jon Gosselin fully intends to stand firm, protect his family and defend against TLC and Discovery who have been rumored to have enjoyed over $186 million dollars in revenue for one quarter, purportedly attributed to the success of the program Jon & Kate plus eight.
This litigation is clearly a tactic that Discovery and TLC have initiated in furtherance of their hunger to jump back on the gravy train, but Jon Gosselin has decided to put the breaks on the Discovery and TLC trainwreck.”
Jeez, that was a mouthful! And it seemed somewhat repetitive, no?
So, now the prosecutors have read your opening statement, Mark. They'll be much better prepared when you all go to trial! Good job!
But isn't that what you all want anyway? A trial means media coverage. Media coverage is what get Jon's rocks off these days. So you all should be thrilled. Everybody wins!

It's no surprise that TLC has been waiting to file this lawsuit. Heller can scream and bang on the desk all he wants. They keep lying about everything. No one believes a word either of them says. I'm sure that TLC has the legal requirements all tied up nicely, they would not file if they didn't have the evidence. Jon may be living in a card board box very soon.
Couple things.. one, he did have a job before all this happened, and now that they have some savings he could try going back and doing that? two, they're darn lucky their kids are so oblivious to this media coverage. they must not be allowed to watch any tv in their home. my boss's son is in their class at school and he saw jon gosselin on tv the other day and asked his mom (my boss) why he was on tv.. she quickly changed the channel. all the parents at the school obviously see the news and are probably snickering behind jon's back. he's such a mess.. hopefully after their divorce we won't hear anything about them.

The best thing would be for ALL parties to go their separate ways. CLEAN BREAK!! TLC and their 50 lawyers had Jon and Kate sign a contract that they didn't truly understand other then the check they would be getting. I understand why a young couple with 8 kids would have jumped at that opportunity. I think Jon earlier on started to realise that TLC wanted to own him. That's why he wanted out of the show. On the other hand Jon and Kate made ALOT OF MONEY that they obviously have squandered. They didn't need a huge 1.2 million dollar estate to raise their kids. They could have bought and paid for a less expensive home. Now they are fucked - out of work and in debt. It didn't need to be this way.
Not understanding a contract does not give rise to a cause of action against it. Didn't you go to law school, Mr. Heller? You've already lost your case…. you'd be better of filing a FRCP 12 (b) 5 motion to dismiss for insufficient service of process. DUHH
I think that a parent has the right to withdraw themselves or their family from the public eye. Even if there is a TV contract…even if they feel treated unfairly…even if they decide to quit at a moments notice.
It seems more like TLC's family/cash cow then it is Mr. Gosselins' and that's sad.
The first rumors I heard were about Kate doing the bodyguard and it seems Mr. Goselin went rebound/down hill from there.
Perez, this is a not a criminal trial. There is no prosecutor, just two lawyers fighting for money in civil court.

But,…..if the contract for the TLC Show Jon and Kate plus 8 was nullified when the show ended, then what right does Jon have to halt production on Kate pule 8 since he was siting the initial contract as including a clause for either himself or Kate to stop production at any time for any reason?
If I was TLC's lawyers I would have a field day on that statement since it will be worth way more for TLC to keep production going on the show vs this lawsuit against Jon!

Both of these "parents" are complete idiots. Nothing like ripping your family apart and embarrassing your kids for money. I hope they both go broke after these lawsuits. They can both get regular jobs to support their kids, like most people do. I'm sure Kate will try to pull her "feel sorry for me" speeches again to rake in money. The legal teams will squash that, they are not even in court yet, and the first move that lawyer defending the party that initiates the divorce always takes X amount of dollars suddenly from a large account. sure it can. you have heard of unconscionability, haven't you?!?! might be a stretch, of course, but it's a typical lawyering strategy to word vomit initially and then hone in on the stronger arguments once the case develops more thoroughly. looks like they're playing a public policy angle. makes sense they'd at least go for the unconscionability/contract against public policy aspect.
ALSO, posting notice on the internet could be considered proper service under certain circumstances. a judge is unlikely to uphold an improper service motion if TLC's took the proper legal steps to serve him, and upon failure, posted the service publicly, knowing john would read it. considering you're throwing out FRCPs, i'd assume that you know that in certain cases, service is proper when posted in a newspaper (no matter how obscure or unlikely the defendant is to see it). i highly doubt any judge would take seriously a 12(b)(5) under these particular circumstances. in my opinion, such a motion would be lucky to pass "the laugh test."
