Polanski Victim Wants Case Dropped

There's just something odd about the whole case surrounding director Roman Polanski.

Polanski was drugging and raping 13-year-old Samantha Geimer during a modeling shoot back in 1977 and was then indicted on six felony counts to which he plead guilty but later fled the country the night before he was scheduled to be sentenced.

Years later in 1988, Geimer sued Polanski for $500,000. Money helps, but it doesn't heal emotional scars. But does time heal all wounds?

It seems that Geimer wants to drop the lawsuit against Polanski and wants it dropped now!

In fact, her attorney Lawrence Silver is asking a California appeals court to dismiss the criminal case against Polanski. For reals!

According to Silver, Geimer is suffering due to all the recent media attention, claiming she's received almost 500 calls seeking comment since Polanski's arrest last month.

Silver adds that Geimer is being stalked by journalists from different international news outlets and has even received interview requests from big shots like Oprah Winfrey! She turned down Oprah?

The suit claims that "The pursuit has caused her to have health-related issues. The pursuit has caused her performance at her job to be interfered with and has caused the understandable displeasure of her employer and the real possibility that Samantha could lose her job." Adding at the end, "Leave her alone."

It's a tough one. We understand Geimer doesn't want to be in the spotlight and we're sure the media hounding her isn't helping any, but what message does it send to release a rapist without any punishment?

What do U think? Should Polanski be set free or brought back to the US to face sentencing?

    It shouldn't matter if she wants to drop the charges or not. When someone commits a crime they should be punished for it rather the victim thinks so or not. Think of all the other young girls he could of raped by now being free all these years? it's just sickening to think about.

    NO THE CASE SHOULD NOT BE DROPPED. If Polanski is set free then it shows other rich famous people that they can essentially rape a 15 year old child and walk away from it. The victim needs to stand up for other future victims! OTHER VICTIMS MIGHT NOT GET BIG SETTLEMENT CASES.

    I can understand why she wants the case dropped. But by doing so, she is sending the message that what happened to her is ok, and its not. People like Polanski think they are above the law, they think they can get away with anything because they are rich and powerful!! It is not fair to all those people out there who were raped or molested and never got any justice (not even half a million dollars). At this point, im sorry, but it is no longer about her. Its about setting an example that if you take advantage of children you will be punished. He needs to face justice, even if it is painful for everyone involved. And Oprah is a hag, I would turn her down too. I think the media needs to be more sensitive, but of course, journalists have no soul and will do anything to get their story!

    I sympathize with Ms. Geimer's situation, but the fact of the matter is Roman Polanski committed a crime, then fled the country. He should be prosecuted. I wish people would leave her alone and let her try to live her life in peace.

    He should be sentenced. She does not have the right to decide whether or not he is prosecuted. That is up to the government, not her. He is a pig and deserves to spend the rest of his life in prison.

    i feel bad for the victim, however, had polanski not gone on the lam, this matter would have been done with 30 years ago. we cannot allow pedophiles to escape justice because the victims are hounded by oprah winfrey. file restraining orders against the press, however, the victim cannot have a criminal case brought by the state thrown out, just as a wife cannot have the state drop charges of battery once her husband has been charged. whether she forgives him or not. finally, from a practical sense, if she's wanting media attention to die, letting polanski off the hook will NOT solve that problem.

    It isn't about the victim. Just like with spousal abuse, the State is the one who presses charges. The criminal committed a crime that broke the state and country's laws, it doesn't really matter what the vicitm thinks. For the sake of children who are 13 now, this needs to be prosecuted.     Sorry but as a litigator, this case is no longer about him raping her, but rather the act of rape against a minor child and whether or not we tolerate that in the States, which btw we do not. Plus she holds no water in this one, this isn't a civil case, it's a criminal case at this point. This is a state matter not a personal matter, and she's already resolved the personal matter by taking money to silence the ordeal…

    I think the case SHOULD BE DROPPED! If you dig deeper Perez, Polanski did serve 3 months in prison under a plea agreement made between his lawyers and the Judge at the time. It turns out the Judge got so much media attention, he backed out of the plea deal leaving polanski high and dry which led to him fleeing the country on TOP of paying the monetary settlement to the victim. This case has holes in it, left and right and I blame the California Judicial system!

    I'm sorry, but the time element here really bugs me. If The State waits 40 years to prosecute I think that can (and should) negate the State's case. Calif. vs. has turned a criminal case into a constiutional law case. It's the right to a Speedy Trial thing that bugs me. They've known his location the whole time.

As a lawyer, I can tell you that although the DA can draw up a plea bargin the judge is never required to go along with it or follow through with it.     Roman Polanski WAS sentenced and WAS in jail. He spent 90 days and at the time the judge commuted his sentence to time spent. The judge LATER changed his mind and tried to RESENTENCE the man. THis was gross misconduct on the part of the judge. Did Polanski get the Correct sentence for the crime committed? No. But you can't go back later and change that-it is like being tried TWICE for the same crime-can't be done.

    Sorry. She has no say in whether the case is pursued or not. We can't have people who've fled the country go unpunished. Yes, she probably had a resolution to the case that suits her. I'm happy for her being able to move on, and I sympathize that she's being bothered now. However, in the name of justice we as a society cannot let people run away from the law that way.     I think he should be sentenced. The poor girl needs to be left alone so she can keep fighting, or the state should fight for her. No one wants to have this type of attention on themselves.     Re: Queen mab – He was not sentenced. You have your facts wrong. He was observed in a mental facility prior to sentencing, he negotiated a plea agreement, he fled before sentencing.

And, once the criminal complaint was filed against him the statute of limitations stopped running, so until the case was tried and a final judgment entered, and that sentence (if there was one) was fully served, the state can continue to pursue the defendant. If he has new defenses, including misconduct of the judge, he can present those at trial. He should not be rewarded for hiding out in sympathetic countries for the past 30 odd years.

    Now what I am about to say is not an endorsement of Polanski and his actions. But Perez failed The judge and prosecutor made a deal and told Polanski he was to serve time in a mental hospital in jail and once complete, it will end the case. Polanski agreed and was locked up for almost 2 months. Grant it, for a crime like raping a child, 60 days is not enough. Either way, a deal was struck and all [parties agreed. Once he completed his time, the judge had a change of heart. Mainly, he wanted the publicity to continue, so he decided he was goin to change the deal and make Polanski do time. It was after some discussion and the realization that they were going to back out of the original deal after he did the time agreed upon is when he fled.. Again, I do not condone perverted pigs who abuse children, but we have a justice system in this country that if you do the time agreed upon, you do no go back and change the deal. it is called double jeorpardy. being punished for the same crime twice. I would have cut his balls off, but he did his time. It could be you or me who is tried, convicted and agree to a deal, we keep our part and all of a sudden the judge and prosecutor decide they want to change it. just giving you a look at the other side of teh story.

Roman Polansky HAS indeed served time for this crime. Polanksky made a deal with the Judge and it was okayed by the prosocution, after he was released early from his 90-day sentence (not a sufficient sentence obviously but that was the deal madein the chamber), the media bashed the judge in question (who requested the case and was known to have a major infatuation with hollywood stars and young women himself).

    The judge then went back on his word and the defense and PROSECUTING attorney were going to start a case against him, because he was vilating so many laws. Polansky fled hours before he was due back in court bc he kept up his end with the judge, and the judge was not to be trusted, the prosicuting attorney even says in a documentary, "I would have fled as well." Nothing makes this situation right, but it just goes to show you how fucked up and corrupt out justice system is. The nother of that girl should be in prison along with Polanksy for allowing her daughter, 13 and already a fan of qualudes, alone with a dark brooding unstable man who had a repuation for dating much younger women and whose wife was brutally murdered along with her fetus(can you say unstable?) to be alone with such a person. It's not all black and white, and people who dont know the entire story should do some research before they start blah blah all the fucking time!

    Re: Queen mab – your facts are wrong. the judge NEVER commuted his sentence, he was NEVER sentenced. it is alleged that the judge informally agreed to accept the recommendation of the prison evaluation. he was never legally bound to agree to that, by the way. after he found out polanski bribed the prison evaluation board, it is allged that the judge was annoyed by this (as well as a pic of rp in germany with underage girls) and threatened to renege on his previous agreement to adhere to the prison recommendation (agian his legal right to do so). we will never know whether the judge would or would not have reneged on his "deal" (which - again - he was legally entitled to do) b/c polansky fled BEFORE he was sentenced. there was NO TIME SERVED because there was NO sentence.

    There is so much with this case so PLEASE research before you make unwarranted, uneducated opinions. It’s actually very interesting and sad. Polanski has served his time. In jail, in a psych ward and the court NEVER upheld their agreement that’s the only reason why he fled. There's also a really great movie that you can watch about it as well.

    It’s also very interesting because this happened soon after Sharon Tate was murdered - - who was pregnant with Polanski’s child - -

    Very high profile for the courts and this was during an election year – the Polanski trials (yes plural) not the Manson trial.

    I really think he didn't know she was 13 when he fucked her. I think he thought she was much older because she liked to drink and smoke pot and her mother let her go alone to a house in the hollywood hills with this old guy. And she said she faked the symptoms for which he gave her that pill. Why would she swallow it?     The justice system is a clusterfuck of contradictions and total crap. She wants the case dropped, then drop it. Besides, he did his time. I'm not condoning rape, not by any means but, get over it.. It happened ages ago, it's a bit late to all of the sudden decide to re-convict him.

    why was her name published? why did she allow that back in the day or currently or whenever … i thought victims name stay unpublished unless they consent, and him being famous, i have little sympathy that she consented to her name being plastered all over the very media that is hounding her.
    I do think he needs to pay the time for the crime. There are people out there that had consensual sex with a g/f or b/f a year or two younger than them and were convicted because one person was a minor, despite the consenting partner pleading and crying.     And now, for the actual facts of this story: Samantha Geimer's mother allowed her to spend the day with Roman Polanski, the mother's friend. 13 YO Samantha wanted to become an actress and Mr. Polanski had just finished a little movie called, "Chinatown." Whatever transpired took place at Jack Nicholson's home with Anjelica Huston also present in the home. Samantha's mother knew exactly where her daughter was and with whom. This was also 1977.

    When statutory rape charges were pressed against him, Mr. Polanski spent two months in jail being evaluated for trial, etc. He then agreed to a plea bargain with the LA prosecutors' office to plead guilty in exchange for time already served. Mr. Polanski plead guilty and the plea bargin was reneged, so he left the USA. Most involved with the case agreed with Mr. Polanski's decision as the judge and many of the others involved were so corrupt. Mr. Polanski was a VERY famous movie direc tor, whose late wife, Sharon Tate, had been brutally murdered by the Charles Manson gang, also in LA a few years prior. The whole situation was extremely emotionally charged. BTW, Ms. Geimer has wanted these charges dropped for almost 20 years now.

    Do watch last year's HBO documentary, "Wanted, Dead or Alive" about this story as it covers all of the actual facts. Dear, you might want to research the facts before you post these stories as so much of what you say is inaccurate.

    RE: Bukowski #45 Polanski has become a hero in THIS country. At the Academy Awards, when he was nominated for best director and won for The Pianist, the ENTIRE hall stood for an ovation. EVERYONE stood in solidarity. Think about that for a while, folks. Some of you may write that they were standing up for his film and it is a good film, but it appeared more than that. The ovation went on and on (a point was being made and oddly, Mr. P wasn't there but I will bet you he smugly watched that and somehow felt vindicated). Check out Dame Angelica Huston's comment on the little girl so you can get an idea of how they stick together in H town.

And with Jack being a womanizer than I could see why Angelica is sticking up for Polanski. She feels it's her fault somewhat but blames the girl as well. Look it up before making statements when u dont' know what u talking bout!
