Sandra Bullock Part of Husband's Custody Battle

Sandra Bullock and husband Jesse James have been taking care of James' 5-year-old daughter Sunny from his previous marriage to porn star Janine Lindemulder.
Lindemulder has just been released from prison after serving six months for tax evasion, but now she's looking to regain custody of little Sunny.
Sounds like quite an unstable environment for a child!
Lindemulder is currently living in a halfway house until the end of the year - at which time she can pursue custody of her daughter. In preparation for this, dad Jesse has already asked a judge to rule on whether or not Lindemulder is fit to raise their child.
He explains in an official court statement:
“Good cause exists for the court to conduct a review to determine if [the girl] will be safe with [Lindemulder]. She should be restrained from allowing the child around pornographers, drug addicts, guns and firearms, felons and other unsafe environments.”
James left Lindemulder back in 2002 for Sandra when his wife was 7 months pregnant with their daughter. Lindemulder is blaming the stress of that situation on her inability to pay her taxes.
No doubt it was stressful, but you can't avoid the IRS! Janine now owes nearly $300,000 in taxes!
In all likelihood it will come down to their respective incomes and James undoubtedly wins that battle with his motorcycle empire - not to mention he's married to one of the highest-paid actresses in Hollywood!
Good luck, Janine, but we don't see this one swinging in your favor.

What an upstanding guy: left his wife when she was 7 months pregnant, began an affair with his current wife before divorcing his previous wife, had absolutely NOTHING to do with Sunny until she was almost 4 years old, and ratted his ex out to the IRS to wiggle through his own tax quagmire. And now Janine's career is questionable…even though he knew full well what she did for a living when he married and impregnated her.
And by the way, Janine is not a felon; she was convicted of misdemeanor tax evasion.

Maybe - maybe not. If she finished her sentencing and completed all court orders and she is willing to provide a stable home she might get her back. A judge does not like to see the child away from their mother if possible. If the courts do rule in her favor she will be under a microscope from DCFS for a long time. If you notice the way this arrticle was written he isn't saying he will get custody or even is going to try to get it. He is saying he wants her evaluated and watched and checked out throughly. Just because she has tax problems is not enough to keep her from her child. As long as she provides for the child that is what the courts will look at of most importance. That's the way it is rather you or I or anyone else agree's. The judge can use some discretion but they still have to follow the law they can not make it up as they go along. Believe it or not they have guide lines and limitations they have to follow themselves.
