DJ AM's Estate To Sue For Wrongful Death

We're not really sure what to make of this.

DJ AM's estate is suing for wrongful death Clay Lacy Aviation, the company that chartered the plane that crashed in South Carolina carrying both DJ AM and Travis Barker.

Additionally they are suing Goodyear Tire, Learjet and the estates of both pilots who were killed in the crash.

According to the documentation, they're suing for wrongful death because "the crash ultimately caused Adam Goldstein's death."

The lawsuit makes note that Adam was forced to take drugs as a result of not only the burns he suffered from the crash but also to deal with the emotional distress. Adam became incredibly afraid of flying and began to take drugs to calm his nerves whenever he had to fly after the crash.

DJ AM's death was directly caused by a combination of the various prescription drugs and cocaine and in this case they are claiming that the drugs were a result of the crash.

We just don't know.

      It's gonna get thrown out. He was an addict prior to the crash. He shouldn't have taken pain killers. Maybe the doctor who gave them to him should be sued…unless somehow the doctor didn't know and he never revealed he had a drug problem.

      I think it's really lame and pathetic. NOBODY caused Adam to take drugs other than Adam. I was in a HORRIFIC car crash - my car rolled of an overpass and over two other cars and nobody knows how I escaped with my life and for YEARS I panicked whenever I had to drive a car and almost peed myself when I had to go over bridges. But I NEVER even thought of resorting to drugs. I just made it through my sheer force of will. Also, NOBODY made Adam a drug addict but himself to begin with so insinuating his return to drugs (legal ones) for his pain led to his return to illegal ones to which he was addicted is just fucking stupid. HE was a drug addict before the accident. THAT is the cause of his death. However twisted the road that led him back to drugs, he was the one to put himself on it to begin with. Let's hear it for some good old fashioned sense in this fucking country.

      From a legal standpoint, no. AM's intentional ingestion of illegal drugs serves as a superceding cause, which breaks the chain of causation and cuts off the defendants' liability. However, his estate may be able to get the companies to settle to avoid more bad publicity.

      that's completely ludicrous. should they win, a precedent would be set in which all doctors would fear prescribing drugs to patients, particularly those with a history of substance abuse. and, let's face it, some injuries and conditions are severe and cannot realistically be approached without medications. as an absurd example, would you have a tooth filled without novacaine?

      aside from that, the aviation company is not responsible for a crqash unless they were fully aware of some malfunction, etc of the aircraft and knowingly, willingly allowed people to use it in the face of such.

      When people grieve, they look for people to blame. He was an adult who made the wrong decisions and it is sad. What if he had relapsed after breaking up with a girlfriend? Do you sue her? What if he relapsed because he was sad about the death of a friend. Do you sue the friend's estate? Again, it is sad but his fault - no one else's.

      His family is either a) trying to make money off his death and/or b) completely stupid. This lawsuit should be thrown out and their attorney disbarred for filing such a frivolous action. Additionally, the pilots' families should file malicious prosecution charges if applicable.

      After the crash he had to take meds for the pain caused by injuries which may have caused him to relapse. This wasn't by choice what other option did he have. The pain and anxiety caused by the horrific crash put him in a fragile state. I wouldn't be surprised if they go after the doctors…didn't they see the depression this caused…someone should be held responsible. The poor guy wasn't in a normal state of mind after this. I see these types of cases all the time at the firm I work for and you'd be surprised what comes of them. Also the documentary of DJ AM helping other drug addicts may prove that his life was going in the right direction before the crash. I think there will be some sort of settlement out of this no doubt.

      Considering the autopsy, and the amount and type of drugs in his system, I can't believe the lawyers want to sling this out in Court. Bombardier and Goodyear are big companies, the can take it, Clay Lacy Aviation is a 1st Class operation, and the families of the deceased pilot - it very sad that the lawyers are going to drag this out. Where were all these people when this guy needed help, now there in for the greed. Very, very tragic all around, sad.

      Unless there was GROSS misconduct on behalf of the airline company, then it, sadly, very sadly, looks like his estate (prob parents) is trying to make money from his death. The fact that it's suing the tire company as well, does not bode well for the estate. Either the pilots were negligent, and the airline company by hiring them were negligent, or there were faulty tires. The fact that the parents are suing all parties shows that they don't really know who was negligent, if anybody, but are looking for deep pockets. One can NEVER know until all the facts are known, but it really looks like the estate is trying to get some cash. It's pretty effed up. And to sue the "estate" of the pilots (meaning the pilots' respective families), when they're obviously greiving as well, is VERY VERY messed up.

      I think it is completely valid. Unless you have been addicted to drugs or have witnessed someone recover from addiction you have NO IDEA how trying it truly is. People go YEARS without taking a drink or drug. When a serious accident occurs you have NO CHOICE BUT to TAKE THE PAIN MEDICATION. And there goes those YEARS of sobriety you worked so hard for. He got addicted to the drugs, no one force fed him the pills, or the coke and we all suffer from depression from time to time, to some degree.       Ridiculous. It is a matter of personal responsibility and this is making a spectacle of DJ AM's death. Not all who die from a drug overdose have someone to sue for their use.       Travis Barker was the sole survivor of that plane crash. DJ AM survived his physical injuries, but couldn't survive his psychological ones and the resulting relapse. The lawsuit isn't that much of a stretch. While it is unlikely to make it in court, I can see it settled. It is, to some degree, a wrongful death. As always, sympathies to those who lost a loved one.

      I am really fat. At one time, doctors put me on a pill that allowed me to lose weight. Then, I passed McDonalds after McDonalds. When I ate it, it made me fat again. Should I be able to sue? It is an addiction just like anything.

      honestly, im not a big component for taking your responsibilities out on someone else, but in this case im siding with dj AM. it would be so hard for a recovering drug addict to be forced to take more severe drugs to deal with the pain of the accident. in his show, he is so committed to helping people get off drugs and make their life better. i couldnt imagine being a recovered addict and then being forced to take percosets, vicodin, and morphine in order to cope with the pain. ultimately, i think its what put him back off the wagon. what would you do in his situation??

      Obviously he was a very empathetic soul who wanted to help others live clean and sober and reach certain goals in life, which he sadly couldn't achieve himself. Reading up on AM, it seems that his entire career was full of praise for not only his talent, but also for being a genuinely nice person. I think it's selfish of his family to not only blatently go against his wishes, but to send such a horrible message to those who are suffering like AM. His death was sad in nature but it did carry a beautiful message; it showed his humanity. He neglected himself and ultimately sacrificied himself trying to save others. Addiction doesn't make someone a bad person and we have to stop this stigma dead in it's tracks. Maybe if his parents took the time to try and understand addiction, they would know that it's not something that comes suddenly out of trauma from a plane crash. You are wired to be addicted basically, some of us can handle our drugs and others can't. Some of us need them and some of us don't. I know I've rambled on forever, forgive me for that, but this posting made me sick. They need to let his soul rest and carry his name on in a positive light. Suing anyone is not going to bring him back, and unless you sue the drug dealers, or the pharmaceutical companies (the real drug dealers), you will not have closure. All this will bring is more pain and a whole lot of bad publicity.

      Everyone please take a minute to visit AM's official website, you can see a message he posted after the crash and before his death where he vehemently denies having any intention of suing anyone but the plane's insurance provider.       I can understand wanting vindication but to sue to pilots estate who died in the crash is beyond my understanding. I do not believe that they sat there and thought "oh well" that they did everything in their power to keep themselves alive along with their famous passengers.
