The courts are still dealing with Janet Jackson's wardrobe malfunction at the Super Bowl back in 2004 when she performed with Justin Timberlake!
Need we remind them it is now 2010?!
An oral argument will take place on February 23 in the re-hearing of the $550,000 indecency fine against CBS-owned stations.
Each side gets 30 minutes to say their piece, which is a lot in these cases according to one of the attorneys involved. "The order shows that the court takes this case seriously."
But why?
The FCC is defending their $550,000 indecency fine against CBS and is asking the court to continue an investigation that would prove their theory that CBS could have blocked her boob and did not.
CBS thinks it's ridiculous that the proceedings are continuing to drag out this way and we tend to agree!
Who cares? Get over it!

The lower courts found the FCC's indecency findings were arbitrary and capricious, but the Supreme Court disagreed and remanded the case back to the lower courts.
It is the FCC that continues this fight.
CBS even likened the FCC to an obsessed sea captain and essentially asked the court not to hand it another harpoon.
CBS said one potential good thing is that this court could embrace the Supreme Court's invitation to assess the constitutionality of the indecency rules given current REALITIES and find that most applications can no longer survive FIRST Amendment scrutiny.

I agree with the FCC on this one. That was really tacky - especially when you know kids are watching. They should get in trouble and Jackson should be fined as well. We need to quit lowering the bar on what's acceptable on normal stations. You can find all the boob you want on Skinemax. It should stay there.

Blame the person that made the clothes, as it was their workmanship that was the problem. Also, how can you expect them to do the pixellating thing so quickly when it was on live tv?

No, i swear to god. I was so excited to know she was performing and I would read about it before hand. One of her dancers was quoted as saying something like… "watch til the end" there will be "shocking moments." Now if you look at that performance, nothing about it is very exciting. They planned that shit. Their reaction was so fake… Janet had been trying to push the envelope for years more and more. Even in her "All for You" Concert DVD, you see her Tit in the beginning when she goes into the Waterfall (tell me I'm not a fan…). Beyond that, listen to her song lyrics since the JANET. album.
