Elderly Gay Couple Stripped Of Their Rights And Belongings By Sonoma County!

This is possibly the most heartbreaking, nauseating thing we've read in quite some time.

Absolutely unacceptable.

An elderly homosexual man is pressing charges against Sonoma County in California for separating him from his partner and auctioning off their belongings!

Clay Greene lived with his partner of 20 years, Harold Scull, and apparently had protected all of their legal rights by naming each other in their wills, medical directives, etc.

Despite this, when Harold fell down the stairs and was taken the hospital, the county and health care workers chose to acknowledge Clay as only Harold's 'roommate' and refused to let them see each other. The courts appointed the county access to Harold's bank account to pay for his medical expenses!

The county then forced Clay against his will into a separate nursing home from his partner, and then took all of their belongings, AUCTIONED THEM OFF, and terminated the lease on their home. Harold apparently passed away three months after his accident.

Clay was never able to see him and will never be able to recover any of their belongings or property.

Thankfully, a team of lawyers managed to get Greene released from the home and together are building a case against the county, the auction company, and the nursing homes.

They will be going to trial in July.

We sincerely hope that everyone responsible for this travesty is exposed and punished accordingly for such a hateful, despicable display of cruelty. We can't even imagine the pain and heartbreak that poor man must be going through - to not only lose his partner, but to be separated and completely stripped of his legal rights without merit!

Nobody should have to endure that.

    yes… our county officials at their finest. how sickening. this is in part ELDER ABUSE. But unfortunately having gone through the county for help myself on a matter; Adult Protective Services IS USELESS.

    i sincerely hope this gets straightened out. NO ONE should have to endure something like this… no matter what age.

    The sad sad sad part is that what they did was probably legal. THIS is precisely why there needs to be equal protection under the law. Certain groups of people may wish you to believe that it's ok that the law does not apply equally, because another groups' rights are "well enough" protected. Well clearly they're not.

    This is truly heartbreaking to hear. I'm at loss for words over how cruel "mankind" can be. Not only is the whole legal thing awful, but Clay never got to be there for Harold before he passed away, I wonder what monsters could deny people such a basic human right?     I live in Sonoma County, have for 21 years and this does not reflect everyone living here. I have seen nothing but support for the gay community from a very high % of people here. This is very very sad and makes me upset and I hope this man finds some sort of justice for the wrongs done to him and his partner and that this never happens again. That being said this county is broke, I mean billions in the hole, so hopefully this is more justice driven then cash. God knows the schools can't afford anymore cut backs.

    How senselessly tragic! Hopefully this court proceeding goes to trial with HUGE coverage by the media. Laws need to be enacted to clearly give all rights and privileges to a life-long partner! A copy of the will should be presented to the rest of the family, so they know not to step on the couple’s toes. A copy should be provided to the local authorities, if necessary. This tragedy should become a textbook case.

    Indeed a tragedy when partners are forcibly separated at any time, but especially so at the end of life. I am wondering where the lawyers where when this was happening? Something tells me there is more to this story than what is published here, not saying that it makes it right. Perhaps there were homophobic kids or siblings involved who were driving these proceedings. I hope for justice and I hope this story doesn't get buried.     I think this is sad but it doesn't just happen to same sex relationships. My Great Grandma had a boyfriend (10 years younger LOL) and when it was time for her to go into a nursing home they were going to go in together. They had been together for around 40 years but they would not allow unmarried couples to be in a room together and she had to go in alone. I think in this day and age that people should get to choose who they are with and not have lawmakers and figure heads do it for them.

    Even if he wins the case, the hole in his heart is not going to heal.
