MTV's Real World Sued For $5 Million!

A woman filed a major lawsuit against MTV this morning for "invasion of privacy, false light, disclosure of private facts, and intentional and negligent infliction of emotional distress."

According to sources, the woman was recently featured on an episode of The Real World: Washington D.C. and she wasn't exactly seen in the best light. But Golzar Amirmotazedi alleges that what was shown on TV wasn't how things actually went down. She says she was served "several alcoholic beverages, then humiliated and thrown out of the house when she refused to have sex with one of the cast members."

How awful! That maybe how things are done on The Jersey Shore, but certainly not on a television institution like The Real World.

Anyone who appears on the show must sign a waiver so MTV can avoid being sued, but Golzar says that she was too intoxicated to lawfully sign it and the producers know it. She is now seeking $5 million in damages for her humiliation! Her official complaint states:

“Outtakes from the Real World… show that Plaintiff in fact was not in a position to provide her consent to Defendant portraying her in a false light or disclosing private facts about her.”

You sure you want to go down this road, girl? Unless they forced fed you tequila in a funnel, we don't see how you getting drunk and making a fool out of yourself is grounds to sue MTV.

You have no case. Might as well accept the shame and move on!

    Ummm, wrong again Perez. Diminished capacity can vitiate consent. Think of rape. If you are too drunk to consent to someone shoving something up your ass, it could be considered rape. Consent to contract isn't really all that different. If they knew that she was drunk, and they weren't, well, not a bad case. Probably not worth 5 large, but she could get some serious sponge cake.

    Ok, the way I see it, it wasn't rape, so I don't see why everyone is doing the "what if" thing … "what if" didn't happen so why worry about it? Regardless, she's the one who decided to get drunk and make an ass of herself. Nobody even remembers who she was, so why bring more light to the situation than need be? She just wants the money.

    I can understand that when drunk you do not make the smartest choices, but I would also be mortified if those choices were caught on tape and shown on tv. Okay yes, 5 mil is a bit much, but I'd atleast demand to have my face blurred out if I signed anything when drunk. It's pretty much the same idea of having your boss, colleagues and family seeing you drunk…we all get drunk but none of us would want certain ppl to witness us in that state. Fair and she DOES have a case. Show some humanity, not all of us are fame hungry gold-diggers.

    Ok, as for all the talk about the law of drunkenness and consent, here's the rule: To render a transaction voidable on account of the drunkenness of a party to it, the drunkenness must have been such as to have drowned reason, memory, and judgment, and to have impaired the mental facilities to such an extent as to render the party non compos mentis (“not in control of the mind”). Now, it sounds to me that she remembers quite a bit about that night. Simply being drunk is NOT enough to minimize your capacity to enter into a contract. If she were so "not in control of her mind," how would she remember so clearly the events of the night?

    In any legal binding contract, you must be sane, sober, not forced, and of age. Obviously, she wasn't sober, which voids the contract.

    ElleWoods21 - Although your text book definition is correct your assumption isn't. There are many cases where someone who was clearly under the influence of alcohol and in no condition make contractual decisions, can remember the events that took place during that time. Her lawyer will have no difficulty finding an expert witness to testify as such and they will have no problem finding enough previous similar cases decided in favor of the plaintiff to show a legal precedent. No matter how many times the phrase has been thrown around, if you have a good lawyer the law is NEVER black and white.

    It falls under, "Non compes mentas" and she has a viable case. A judge just might be willing to hear the case if she can prove that she was lacking in her faculties and that she was indeed inebriated at the time she signed the waiver.
