Equality For All! Federal Judge To Make Decision Regarding Proposition 8!

Let's all keep our fingers crossed!

Chief U.S. District Judge Vaughn Walker has heard both arguments from the opposing views, and now will be determining whether or not Proposition 8, the ban placed on gay marriage in California, is actually constitutional!

Attorneys Andy Pugno and Charles Cooper are defending the legality of Proposition 8, and Pugno writes:

"Historic marriage has its roots in pairing a man to a woman and has served as the foundation of the family and society as a whole. To change the definition of marriage… would result in such a profound change to the structure and public meaning of marriage as to severely damage society, possibly beyond repair."

AKA bullshiz!

Meanwhile, former Republican Solicitor General Ted Olsen and David Boies have represented the plaintiffs, and argue that Proposition 8 is "the result of disapproval or animus against a politically unpopular group" and represents "a backlash that stripped gays and lesbians of the rights previously conferred upon them by the California Supreme Court…and violates the equal protection clause of the Fourteenth Amendment."

Exactly!

Judge Walker isn't expected to make his decision for another few weeks, but regardless of the outcome, the ruling is expected to be appealed all the way through the system until it reaches the U.S. Supreme Court!

It's time for a change, people! Equal rights FOR ALL!

    THIS IS SO DUMB. Take a brief look back in our history. A hundred years ago, it was illegal for blacks and whites to marry. Then the process of appealing that law started. The same ol tired arguments were being used then, too. "oh, its just the way its been done forever…This isnt right to repeal a law that has worked for so long" blah blah bullshit. Maybe these people need a little wake up call to realize that OBVIOUSLY the old ways of doing things ARENT REALLY WORKING. its time to move forward.     I'm not gay but if the courts upholds the law…I'd be pretty pissed to pay state taxes to a state that doesn't offer me complete and equal rights under the law.

    This issue doesn't belong in the court system for a judge to decide. It was voted on, the people have spoken, for those who don't like the ruling, get it on the ballot again and hope for it to go the way you want. Perez, if this was an issue where you agreed with the outcome of the vote, I'm sure you would be the first one yelling, the people have spoken, keep it out of the court system. I find you to be hypocritical.

God did not make Bill for Adam and Tanisha for Eve. Marriage is sacred and religious. This tradition has been going on for many many centuries. You can't just break it like that. And anyway its not like you can't still be with your significant other. And how does Blacks and whites getting married and womens rights have to do with anything? There is no correlation.

    You have your history wrong. Traditional marriage is not one man and one woman in sacred union of romantic love. Traditional marriage is one man owning as many wives as he could afford. The woman generally had little if any say in who she married - her spouse was chosen by her parents. Sometimes the man didn't have any say either; he married who his parents told him to marry. Traditional marriage wasn't about forming a union between a man and a woman. Traditional marriage was about forming a business relationship between families. It was also a way of determining which kids a father had to be responsible for. (IE: the kids he fathered outside his marriage were SOL. He only had to pay for the "legitimate" kids.) Marriage wasn't even recognized as a sacrament until the 13th century.

    The definition of marriage has been changed many, many times throughout history. These changes have generally been good. These changes gave women an equal standing in the marriage. They gave the couple getting marriage the choice of who to marry. These changes have given children born outside of marriage a better chance in life. Now it needs to change just a little bit more. Civil rights should never be subject to popular vote. We're a democratic republic, not a democracy.

Like the other poster said, marriage started as a contract — women were sold as chattel to men. It was about property and assets gained through dowry. Plus, if you can't clue into the context of what I am saying in a previous comment, because you are too much of an idiot to scroll up, I'm not about to educate your dumb ass. Hopefully, the courts will realize that this is an important civil rights issue and vote as such — my country already HAS gay marriage.     Equal Protection arguments rarely stand up to Supreme Court muster. The voters of California have spoken. If you don't like it, put another initiative on the ballot.
