1) Why hasn't Mel simply come out and denied it? He hasn't, and given that William Morris, his agency has dropped him, I would have thought that they would be easily able to establish if the person on the tape was one of their major clients and they seem to think he is.
2) Phone records will be able to show if these calls took place. Now, true, she could still have hired someone to play Mel, but do you honestly think she would have been able to get hold of his cell phone and give it to an actor, to pull this whole stunt off?
