Appeal Of Prop 8 Ruling Already In The Works!

Well, that didn't take long did it!

This afternoon, a historic decision was passed down by Chief U.S. District Judge Vaughn Walker, who decreed that Prop 8 violated the Constitution's equal protection clause under the 14th Amendment and deemed it unconstitutional.

That's right! Equal rights for all!

However, the news that the ban on gay marriage would be lifted was soon followed by an appeal from opponents of the ruling. Sources say that this feud may make its way to the U.S. Supreme Court.

You know what? BRING IT ON!!!

This cause is worth fighting for!

And we are more than ready to FIGHT FIGHT FIGHT!

    Re: ashrob25 – It would be considered unconstitutional because of past supreme court rulings such as Loving v. Virginia (interracial marriage) and because of Brown v. Board of Education (separate does not mean equal) which an example would be civil unions. They are a separate entity but it doesn't mean that its actually equal. I believe the Amendment for Brown is the 14th Amendment partly because of the Equal Protection Clause. And the Loving v. Virginia case is also the 14th Amendment. If you use these 2 landmark cases and others such as Lawrence v. Texas which I believe violated the 4th Amendment (Right to Privacy), and the 14th Amendment Romer v. Evans (same thing) there is a strong case for same sex marriage.

    This is the Amendment in question:
    "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws"

    You people screaming "But the people voted" really need to understand how the Constitution protects minorities. The will of the majority cannot create laws that discriminate against the minority. That is the very foundation of this country. And as others have pointed out here, this is not the first instance of a law being declared unconstitutional for discriminating against a minority group. Prop 8 as a law is unconstitutional, regardless of how many people voted for it. Therefore, a judge can overturn it.

Gay couples were afforded the same opportunities in civil unions. Why is it so important to call it marriage? Honestly, I could give a shit less if gays marry or have a civil union. I just don't like the topic shoved down my throat. I voted yes on prop 8. Why? Not because I don't believe that gays shouldn't be married. I was totally turned off by the campaign that was run. When the head of the CA schools used tax payer money to run an ad in favor of it, when the state of CA is completely broke, it pissed me off. When I lived in CA I had to supply basic supplies to the TEACHERS, ie, paper, white board markers, tissue, etc. That's bullshit! Most CA taxpayers didn't even get a tax refund check this year. But, they used all this money to repeal this law to make a group of people happy. I'm glad I was never a resident of CA (we're military) and I will never be one either. That state is fucked up beyond repair.

Over in Europe, the Catholic Church was pretty much intertwined with the majority of the monarchies and there was so much religious persecution (that's why so many people came over here). People wanted to get away from having religion in the Government, so they created the Separation of Church and State. As for your "biological comment", pedophilia is different from homosexuality. the ending "philia" means that pleasure is derived from a specific stimuli which in this case, is children. Homosexuality as well a heterosexuality are within the same category, for they are an identity, and sexuality. A philia is a different thing. It is something that does not produce complete attraction, but only pleasure sexually.

    Re: firesoul – As for your media comment, it isn't so much the media that is influencing people to go for or against gay marriage as it is religious institutions. Many religions say homosexuality is wrong and condemn it. Followers then think: oh, those gays are unnatural and are perverted. They shouldn't be allowed to marry. Yes, someone may have formal education, but they can still be a complete idiot. Many people value religion (and that's fine) to a point that exceeds thae value of education that it takes over in terms of reality. The real issue that needs to be addressed though is equality. LEAVE RELIGION OUT OF THE EQUATION. That is where it should be. OUT. Keep your religion to yourself and be happy with it, but do not even dare to bring it into the lives that are supposed to be protected by a Constitution that forbids religious influence on laws.
