Yes, We Won, But… No Same-Sex Marriage Yet!

| Filed under: Gay Gay GayLegal MattersPolitikLGBT

We took a giant step in the right direction today, but there are those who are still standing in our way in having equal rights.

In a not so surprising but crappy move, a stay pending appeal was filed yesterday prior to Judge Vaughn R. Walker's decision today that Prop 8 is unconstitutional.

What that means is that his ruling to overturn Prop 8 cannot be filed until this appeal has been dealt with. So the good judge has granted the community a stay of court's judgment, but gay marriage will not allowed to resume immediately.

A bump in the road, but nothing we can't handle. Faith has been restored today and we know that equality will prevail!

but it will happen eventually so yay!!

  2. 2

Hey! I really wish that the "land of freedom" could hold real freedom and allow same sex marriage (actually everywhere).
I'm from Argentina and on July 15th we became the 10th country to have the nationwide law for same sex marriage after several weeks of struggle and listening to people saying the most outrageous things (God, Devil, blah blah…)

But it felt soooo nice when they approved it! (4am after 15 hours of debate!!)

Same sex marriage will never happen. Period. There's a higher power that supercedes the opinion or ruling of any country, state, court, or person. Any argument otherwise is foolish and invalid.

All you q*ueer little sickos should be exterminated!!

  7. 7

Let me understand this, the Federal judge who issued this ruling is GAY??? What the hell is that all about? Of course he isn't going to issue a ruling truthfully saying that his colleagues are perverts!!!

  8. 8

Don't celebrate too soon. The US Supreme court justices aren't gay so they'll rule on the merits of the case.

I'm glad that Prop 8 was declared unconstitutional. It doesnt hurt me in the least or physically harm me if gays want to get married.

  11. 11

  12. 12

Umm i think they should let the homos get married i mean we cant judge them, let god be the one to send them all straght to hell. I mean i know gay folks and i honestly hate them so i pretend i like them and be their freind, but deep down i hate them. But what they dont know doesnt bother them right?! Just pretend you like them and they wont call you homophonb simple as that.

  13. 13

This issue, gay marriage, is a losing issue for the the Dems, just like Obamacare turned out to be.
Obama's Regime will continue to be seen, to be governing against the will of the people, all summer.
Obama is a black Muslim. He hates gay people like he hates bitter clingers. He just panders to the gays.
Trust me. The Mongrel-in-Chief is having a bad day.

  14. 14

Hmmm…a little history is in order here:

    1) CA voters voted against legalizing gay unions under the name "marriage" - that ruling overturned by CA activist judges.
    2) Prop 8 passes, confirming that CA voters STILL oppose gay unions being called "marriages" (GLBT couples still had all the same rights as married heterosexuals unions do in thier "marriage" though). This time, an openly gay judge throws ignores popular will.

What's the point of voting? Have a nice fucking day.

  15. 15

You havent won shit! Because NO ONE will even go out with your ass!! Ha! You think some guy wants to marry you? He'd probably rather go straight!! HA!

  16. 16

    Equality for everyone. Period.

  17. 17

Re: CVDS559 – Everyone knows God isn't real! Silly

  18. 18

side note: the judge is gay. seriously.

  19. 19

Re: DaRockz – What an idiotic post.

  20. 20

i am shocked and disgusted at the amount of comments looking down their noses at gay people. you probably sin ten times over but at least you can scoff at the gays as if they're any worse than you are. you're the real sickos. straight allies for life!

  21. 21

faith what faith? your faith in god? god clearly states in the bible that it is sinful to have unnatural relations (romans 1 26-27). This country was started on christian beliefs and god blessed us for that making this country great, now that we are turning our backs on him he is allowing evil to attack us and bring this country down. You may see it as equal rights, I see it as one more step away from god

  22. 22

This is not about discimination against gays. Marriage has always been between a man and a woman, period. The judge had to be from San Francisco. I'm not surprised!!! I thought votes counted. Then why even bother putting it on the ballot? It's not over yet. As a gay marriage opponent, I'm pretty sure this will be overturned again and again and again.

  23. 23

Homos need to realize marriage is between a man and a woman not two flipping butt pirates!!!!!!!!!!!

  24. 24

7 million people voted against prop 8. If one judge can overrule it then in the future, when the state votes for something that the gay community wants, one judge will be over-rule it as well. This is a democracy, not a dictatorship. By overturning the people's vote, we are playing a dangerous game. Just sayin.

  25. 25

This is NOT a "gay issue". It's an issue of a judge going against the voters and having a dictatorship. That is very dangerous.

  26. 26

This is NOT a "gay issue". It's an issue of a judge going against the voters and having a dictatorship. That is very dangerous.

  27. 27

This is NOT a "gay issue". It's an issue of a judge going against the voters and having a dictatorship. That is very dangerous.

  28. 28

It's highly disappointing so many people jump on the "gay train" just because it's the latest fad to sweep America. The vast majority of celebrities support it so suddenly people set aside their consciences and morality to go along with them. Why do people with a mental sickness deserve the same benefits as those who are mentally healthy? The same argument can be made for pedophilia…"hey you can't help who you love, so let's embrace it." So let's let that 50 year old man take that four year old little girl home because he claims he "loves" her. No…it is morally wrong and the guy is messed up in the head. Same with homosexuality. Not to mention it is clearly not biological since gay people can't reproduce. And, if you are a Christian, you should be ashamed for discarding the teachings of your God.

  29. 29

That's why we voted, and voted against, so gays and lesbians need to respect that. You are not special people nor should you have special treatment. Funny Perez, you gave Lindsay crap for getting "special treatment" when you think that just because you are gay you should too. People voted against, thats why we have elections.

  30. 30

    At least we won! yay!!!!!!!!!!!!!!!!!

  31. 31

Gays will eventually be able to marry everywhere in America. It just takes time. A long longgg time. But it will happen one day. I have hope!

  32. 32

Re: haisinni – How the hell would wanting to marry someone you love "special treatment?" No, NO ONE NEEDS TO RESPECT A HATEFUL DECISION. A DECISION THAT WAS JUST DECLARED UNCONSTITUTIONAL!! Dipshit haters.

If you think marrying someone of the same sex is wrong THAT IS ABSOLUTELY FINE. Sad yes, but fine. Think it's wrong all you want, but that in know way means it should be illegal. How is it in anyway right for your (by your I mean everyone opposed) selfish feelings to jepordize someone elses happiness?!?! I don't get why people don't understand it. But I just have to remember it's human nature to be opposed to something different.

  33. 33

I meant tot say "how the hell would marrying someone you love be considered "special treatment". I left out the be considered part. Ugh you haters get me angry. lol

  34. 34

I meant to say "how the hell would marrying someone you love be considered "special treatment". I left out the be considered part. Ugh you haters get me angry. lol

  35. 35

So lets see, they CITIZENS voted, they voted against prop 8, but a judge who likes to interpret the constitution as he sees fit overturned a majority vote? Interesting democracy we live in, the majority have spoken yet it counts for nothing.

  36. 36

    Re: Bryan Layton

This country isn't based on Christian beliefs; in fact, it's based on religious FREEDOM and more importantly, a separation between Church and State. What your religion has to say should have no part in government.

  37. 37

    Re: irishkid77

Uh America is retarded lol, Bush was elected twice, what more proof do you need?

Also if we always listened to the majority then blacks would still be slaves to this day.

    In conclusion, stfu

  38. 38

Re: DaRockz – WTF? You're an idiot! And get a dictionary before you start adding comments. You can't even spell much less find appropriate punctiation to make your point. Yeah, you're a good defence for Prop h8.

  39. 39

Re: spazzkitty – Then stop reading his site you hypocrite. If you're so against homosexuals why do you even come here knowing full well that Perez is gay and all you others for that matter?

  40. 40

The fact of the matter remains that who you can love love should never be madated by any government. Don't forget until 1968 it was illegal for blacks and whites to marry in this country. In some other countries it's illegal for Muslims and Christians or Muslims and Jews to marry. Marriage is about who you love, not ever specifically a man and woman. And don't give me that crap how can two "queers" have kids? My 75 yr old aunt got married and I'm pretty sure she can't have kids.
If everyone is so worried about the "sanctity" of marriage then make divorce illegal. Not so keen on that are you? How many people who left a comment here have come from a divorced family or have been divorced? You need to shut the hell up if you have because you truly care nothing about marriage (or your family didn't).

  41. 41

    Re: CVDS559

Lol, you're delusional. Every year another country legalizes it, and it's only gaining momentum. Within 20 years, the only countries that won't have legalized gay marriage are Islamic theocracies and extremely poor countries.

    Re: irishkid77

The majority should never be allowed to decide what RIGHTS the minority are allowed to have. That's ridiculous and in complete contradiction of everything that America stands for. Or would you also prefer for black people to be stripped of their rights as well? How about Jews? Do you also endorse the persecution of Christians in Muslim countries?

    Re: firesoul

A child cannot comprehend the implications of a sexual relationship, which means they can never consent, so it's completely moot. In regards to the feelings of a pedophile, I know of no analogue in nature that would suggest that it's a natural attraction. On the other hand, there are over 500 documented species that exhibit homosexual behavior in the wild. Homosexuality could be a natural population control, a way to form tighter bonds in packs, or faulty wiring in the brain. In any case, being gay is out of a person's control, so they should be allowed to have the same rights as everyone else. Religious "morality" is irrelevant. Our country is secular by design.

  42. 42

    Re: Cattac
Once again, as I have said elsewhere, the point of bringing up pedophilia was to show that just because "love" is in the equation does not make it right. I would also argue that homosexuality is not a natural attraction. I am not sure why you believe that just because homosexual behavior is found in nature, that makes it acceptable. Sin, depravity, and things that have deviated from what God intended do not apply just to mankind. They permeate the entire world, including nature. Animals are capable of sin as well (look it up sometime). That being said, I have read a number of articles in which some of the so-called 500 species were, in fact, not exhibiting homosexual behavior at all. It was misinterpreted and misconstrued. Let me point out that there are estimates of about 1.5 million KNOWN species total in the world. The 500 of supposed "gay" species you mention make up about….0.0003% of all the known species. Being gay is out of a person's control the same way that being a pedophile is. In both cases, it is an abnormality and it is wrong. Our country was founded BY Christians ON Christian principles. You want to believe that America today is secular. The media tries to portray the country as that, but in fact there is a very large majority who still hold to the morals, values, and teachings of the one true God. Religion is anything but irrelevant.

  43. 43

I am so sick and tired of listening to these morons on tv talking about "real marriage". What the hell business is it of theirs to be concerned about other adults? I don't get it and I am well and truly sick of them all. Any adult should be allowed to marry whomever the hell they want no-one else goddam business. I hate these right wing pricks with nothing else to do. Get out of any bedroom/life that ain't your own.

  44. 44

is it weird to anybody else that all these small minded homophobes read and comment on perezhilton.com??? YAY FOR THE GAYS!

  45. 45

Re: MattyC – Just because we do not agree with Mario's orientation does not mean we discriminate against him. The fact that you equate the two just showcases your own ignorance. I can respect people whom I do not agree with. Labeling all of us as "small-minded" proves that you do not have the same respect for me as I might have for you.

  46. 46

It's really funny because if a politician supports it, hes basically a huge hypocrite..All politicians will claim they have moral and christian/catholic values to earn trust and votes (which is basically exploiting religion like Lady Gaga/jonas brothers do) then turn right around and support this? Uhh no, you cannot have "In god we trust" stamped on our bills then use religion as a trust builder only to support something that is a sin..Any gay or lesbian person that uses god as an argument is clearly a frigging idiot. Its a sin, according to most religions to be gay. Sorry, You can't be gay then say god loves all people. Its a sin. Being gay is a mental illness. bad wiring/chemical imbalance. Therefore it can be cured.

  47. 47

ahhahaha I read some comments and they are the same stupid reasons that retarded deputies, senators and the rest of the "people" were talking about here in Argentina before the law was approved.
But when it did, they all had to take it and eat it raw (their words, of course :P )

  48. 48

The problem I have with this is that the gay community wanted it on the ballot so they could vote on it and when they lost all of the sudden it's illegal. I'm all for equal rights and am fine with gays getting married but the people have spoken…let it go!!!

  49. 49

I h8 to be the one to break it to you (get it? get it?) but the ruling specifically excludes you, Mario. The judge ruled that you are not allowed any measure of happiness until you get down on your hands and knees and beg Evan Rachel Wood forgiveness for calling her Evan Rachel Whore, AND she accepts. (She's just the first of about a dozen, by the way)

  50. 50

I don't see why so many people are against gays having the right to marry, it's their life. If it doesn't effect you directly and it probably doesn't, who cares? As for those spewing the bible and religion, go crawl back in your hole where you came from. Everyone has the right to be happy, regardless of their alternative lifestyle. I am Hetero and see nothing wrong with gays marrying, they have rights just like the rest of us.

  51. 51

Re: BritneyBee – Yes the PEOPLE VOTED for Bush twice. I wish we could go back to that time. What has your precious Obama done for you lately. Ask all the people in the unemployment lines, I am sure that they are asking themselves how TIME FOR A CHANGE is working for them. By the way don't tell Obama what comes after a trillion - he might make that his next goal.

  52. 52

Re: firesoul – 30-Nobody's jumping on any "gay train" this is about equality for all Americans!
It's no "fad" but serious progress made toward civil rights for a group of people, gay Americans- who are born into this world without all of the rights people born straight enjoy.
Being free to marry the person you love being one of those rights!
You wrote-"Why do people with a mental sickness deserve the same benefits as those who are mentally healthy"
By mental sickness, are you referring to those who's minds have been altered to a delusional state of hatred by religion? Didn't specify so…
"Mentally ill" people are born with equal rights! People born gay are not!
    As for your pedophilia rant-WHAT?
Pedophiles are sick vile perverts who rape children- e.g; Catholic priests.
There is nothing consentual about it which is why the states have laws for age of consent! A 50 year old man that brings home a 4 year old girl
Sex between consenting adults gay or straight is NOT to be compared!
If you were truly born straight, gay really shouldn't occupy your mind.
Yet here you are pre-occupied enough by what "other people" are doing to post an awful lot about it!
Even though it's none of your BUSINESS!
    What is wrong with you?
Oh yeah right, the mental illness often precipitated by RELIGION!

  53. 53

Marriage has existed long before the story of your god was even wrote the oldest known and recorded marriage laws is discerned from Hammurabi's Code 1790 Before Common Era or 1790 Before Christ (for you).
Marriage is a social union or legal contract between individuals that creates kinship. It is an institution in which interpersonal relationships, usually intimate and sexual, are acknowledged by a variety of ways, depending on the culture or demographic. It is not owned by your church.

  54. 54

    Re: MarioMonjack – AKA kissmyassobama
It has nothing to do with his sexuality:
The Equal Protection Clause, part of the Fourteenth Amendment to the United States Constitution, provides that "no state shall … deny to any person within its jurisdiction the equal protection of the laws"
The Equal Protection Clause can be seen as an attempt to secure the promise of the United States' professed commitment to the proposition that "all men are created equal. It makes no exception for gay people or bi people or transgender people rather it says ALL PEOPLE are to be treated equal giving the same protections of the law!
The California Constitution itself sets out two ways to alter the document that sets the most basic rules about how state government works. Proposition 8 was put on the ballot through the initiative process. But any measure that would change the underlying principles of the constitution must first be approved by the legislature before being submitted to the voters. That didn't happen with Proposition 8, and that's why it's invalid.
If the voters approved an initiative that took the right to free speech away from women, but not from men, everyone would agree that such a measure conflicts with the basic ideals of equality enshrined in our constitution. Proposition 8 suffers from the same flaw – it removes a protected constitutional right

  55. 55

    Re: firesoul
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.-First Amendment to the United States Constitution
You where a nation of Christians but you are not a Christian nation, never have you been or never will you be. The Constitution is clear:
The Establishment Clause of the First Amendment prohibits the establishment of a national religion by the Congress or the preference of one religion over another, non-religion over religion, or religion over non-religion.

    Re: firesoul

  57. 57

    Re: NookiesWA – 48
The American Psychological Association has declared homosexuality is not a mental illness and you can not be changed from gay to straight!
    Your god is a myth.
The church used to be against Interracial marriage in the past today black and whites marry in those very same churches!

  58. 58

The word "homosexual" was first used in the very late in 19th century CE. (AD for you) There was no Hebrew word that meant "homosexual." Thus, whenever the word is seen in an English translation of the Bible, one should be wary that the translators might be inserting their own prejudices into the text.
There was not even a word for 'homosexuality' or 'homosexual' in Hebrew, Greek and Aramaic, the original languages of scripture.
So many words in the bible's original text have no know meaning as the words died out. Words like “arsenokoitai” which was once thought to mean temple prostitutes then later thought to mean masturbation. At the time of Martin Luther, the latter meaning was in universal use. But by the 20th century, masturbation had become a more generally accepted behaviour, whereas many Christians were concentrating on homosexuality as a despised activity. New Biblical translations abandoned references to masturbators and switched the attack to homosexuals. The last religious writing in English that interpreted 1 Corinthians 6:9 as referring to masturbation is believed to be the [Roman] Catholic Encyclopedia of 1967.
THE BIBLE changes to suit the hate of the day.

Gay marriage or civil partnership as it is known has been legal in the UK for a long time, when will the US catch up with the rest of civilized society ie Europe??
