Katy Perry Vs. The Beach Boys

| Filed under: Music MinuteKaty Perry

Katy Perry may be in trouble due to eight words: "I wish they all could be California girls."

The Beach Boys’ label, Rondor Music, is threatening legal action against Perry’s label, Capitol Records, unless Beach Boys Brian Wilson and Mike Love receive writing credit and royalties from Perry’s hit song California Gurls.

The boys themselves seem to be playing the good guys. Here’s what Brian Wilson’s rep had to say on the matter:

"Rondor owns the track and called Brian and Mike, saying they were going to complain. Brian likes Katy's record and doesn't know where the situation stands."

Do U think The Beach Boys Rondor Music should get what they’re asking for?

    absolutely….they're the beach boys!!

  2. 2

    first

  3. 3

there is NOTHING original about this chick. yes she owes them money……….it is their lyric…

  4. 4

well if your gunna take a line from a classic….give the credit.
The Beach Boys was the first thing i thought of when i heard that line…and i just assumed they got the rights to use it.

  5. 5

Frankly I wondered about this when the song came out. How can you write a song with the same title as a classic, quote a line from the song, and not give the original artists credit or receiving some permission? It's not like they'd be setting a precedent if they got sued–its happened before! It's a lawsuit waiting to happen if you ask me.

  6. 6

The Beach Boys are the greatest band ever to exist and gifted musicians, Katy Perry is just a pop star. She used their material and needs to pay up, simple as that.

  7. 7

HAHA!! How's it feel boys!?!?! How quickly you forget!!!
"Surfin' USA", credited as composed by Brian Wilson, was a note-for-note cover of Chuck Berry's "Sweet Little Sixteen". A lawsuit officially granted Berry writing credit and royalties from the record.

  8. 8

seriously, why do they care? its words put together to make a sentence. stop freaking out. if the beach boys are so worried about people getting credit for the sentence they create. how about they create new music to stay relevant rather than trying to stay relevant by suing popular stars

  9. 9

I don't know if taking two words from a song can be considered stealing.

  10. 10

Does anyone ever have to give credit for sampling a track? It happens all the time. She "sampled" a line. She was paying homage to recognizable legends. Why would they seek to be "given credit" when the reference was already clearly implied from the start? Unless they are trying to cash in on a mega hit they had no part in producing in that case they are just being greedy and trying to keep some fresh dough rolling in for doing zero work.

  11. 11

Unless they registered the words "I wish they all could be california girls" they should in no way get royalties…credit maybe….money absolutely not. It's not her fault they haven't come up with something in a looooong time.

  12. 12

I most certainly do think they should be paid, that could not have been a slip, it's too famous a line……..

  13. 13

Beach Boys - I wish they call could be california girls.
    *
Katy Perry/Snoop Dogg - I really wish You all could be California girls.
    *
Pretty similar, interesting to see this one play out.

  14. 14

According to Billboard, The Beach Boys are the number one selling American band of all time. They are not has-beens, they simply got older and stopped making records.

Katy Perry is a piece of shit, no talent whore that gets press by attacking real artists like Lady Gaga.

  15. 15

The Beach Boys plagarized Surfin USA from Chuck Berry so they shouldn't be complaining.

  16. 16

Yes they should get what they want. I mean, Katy Perry knows the song, so she shouldn't have even recorded three words together that are in the original "California Girls". Bad decision on her and her labels part.

  17. 17

How completely stunned do you have to be to use that line?

  18. 18

huh… musically they sound different, I cant think of any part where they are the same

  19. Caryn says – reply to this

    19

Rondor Music have no ownership of the songwriting , they just want attention

  20. 20

THE BEACH BOYS AND BRIAN WILSON MAINLY ARE TRUE HEROES FUCK SOME KATY PERRY WHO IS NO ARTIST NOT EVEN A MUSICIAN JUST A POP PROSTITUTE!

  21. 21

The beach boys california girls was a great song her song is so fucking RETARDED and I hate to use that word but thats the only word that describes that song how dare ppl call beach boys hasbeens BOW down to the music kings mother fuckers!

  22. 22

Brian is so sweet he wouldnt wanna sue a little girl though. Mike may though. Mike is a true badasss

  23. 23

why do you ALWAYS MAKE IT OUT TO BE THIS BIG FIGHT going on?????? It is a legal thing, and yes, she owes something to the writers of california girls since she obviously took it from there. Shame on her for not getting permission or seeing what she needed before she did it. These new 'singers', NONE will last because NONE have originality in them, NONE OF THEM.

  24. 24

I THINK THE SONG SUCKED WHEN KESHA DID IT.

  25. 25

get real… the songs are TOTALLY different

  26. 26

Re: ilovedancemusik – No asshole Fuck you! The Beach Boys are an American Original. Their songs are still considered anthems to this day. You think that hooker wig wearing twat can say the same in 40 years?

  27. 27

Pay up you crater faced hack!!!!!

  28. 28

    No dice!!
    .
If that phrase wasn't trademarked (which it isn't), it's all about and ONLY about $$$. The lawyers will get rich on this but Perry will prevail. If she succumbs to their pressure, it's a pay-off.

  29. 29

I'm pretty sure the line is (from Snoop) 'I REALLY wish YOU ALL could be California Girls'

  30. 30

yes, its called giving an 'elemental' credit, and katy certainly owes the beach boys that in the liner notes. rappers do it all the time as well as sampling and they are smart enough to pay whatever royalties are needed before they get hung out to dry in the courts.

    Re: ilovedancemusik

you watch your mouth you retarded whore, put down whatever shitty music you're listening too and get educated you dim motherfucker.

  31. 31

Katy Perry is gross and talentless.

  32. 32

    you fu.cking idiots!!

    can't you fu.cking read?

Rondor Music are the threatening with a lawsuit NOT the beach boys..

the beach boys could care less

  33. 33

I think that she shouldn't have used the lyric without credit, but if The Beach Boys aren't going to benefit from the lawsuit, I don't think there should be one. If it doesn't bother Brian Wilson, musical genius, then the record company is just looking for a buck.

  34. 34

You steal the lyrics you gotta pay!!!
    Pay the Beach Boys!!!!

  35. 35

They're taking this way too seriously. They should take it as an homage or a tribute to their classic song, not be assholes about it.

  36. 36

Give it a rest, geezers! Please, greed fucks! It's a sentence, give me a fucking break! This "ownership" and lawsuit shit is getting way too out of hand…

  37. 37

    Re: shorelinebeads

Yep it is. I don't think they should get credit/money for it. It's a sentence. And everyone plagiarizes everyone.

  38. 38

So a question that was asked Katy Perry during her interview with Lisa Nova (some exclusive thing on youtube), was : "if you could steal a song from all of music history and take it as yours, what song would it be?" and she replied: " I would probably have to take something by The Beach Boys, probably "God only Knows", so perfect and simple, or i would have to pick something by Queen…" SO i think it's kind of ironic (maybe) that this is happening to her. Although The Beach Boys are classic, I don't think anything is going to happen between them and her lyrics. Obviously she loves them, but I don't think she would steal their lyrics without giving proper credit to them.

  39. 39

It's a song that made the Beach Boys the beach Boys… and she draws "inspiration" from everybody else ahemahemkeeshaahem and others. So it'd probably be best if she gave credit where credit is due…

The Beach Boys are very deserving of royalties. I hope they get them.

  40. 40

That would be up to Rondor, if they don't want the $$$ they should have them make a one time donation to a charity of Rondor's choice.

  41. 41

lol has-beens trying to stay relevant

  42. 42

Everybody has to claim loyalties off something. Pathetic

  43. 43

ummm are you kidding me, they don't own that phrase! Bullshit! I don't like Katy's song but really, so stupid.

  44. BBFan says – reply to this

    44

Just to clarify some of the misinformation in previous posts: Brian was pretty young when the BB did the lyrics to Surfin' USA and used Chuck Berry's music (Sweet Little 16). It was resolved without any legal action. Brian turned over FULL CREDIT to Chuck Berry for the song–so it's Berry who cashes in from that song, year after year, even though he didn't write the lyrics.

  45. 45

Fuck them. They have enough money. Credit maybe. Royalties would just be greedy at this point. It would make them, and all the other has been that do this, look bad.

  46. 46

I think Snoop says "I really wish you all could be California girls"
Isn't that different from the Beach Boys lyrics?

  47. cdv says – reply to this

    47

    Re: WTFungus
Glad Im not the only one thinking this.
    TY Fungus!

and since they own the song rights, the label can sue if they choose.
Not familiar w/the new song (I usually turn her off) but if its the same, it IS iconic enough to be theft maybe even if its slightly different like someone noted. Ya gotta give credit, Katy. Cant play dumb especially since ya probably changed the spelling to avoid comparisons, Not the first time she wasnt being original just ask Jill Sobule.

  48. 48

Yes she should at least come up with something on her own if she wants to be called an artist!

  49. EddyG says – reply to this

    49

The titles can be the same, no legal infringement unless the lyrics and music are similar. A non story.

  50. 50

Re: devilish girl – It was more than 2 words, apparently she stole the whole phrase "I wish they all could be California Girls (Gurls)", although the actual band don't seem too bothered, its their record company that is taking legal action. The song is dreadful, stolen lyrics or no stolen lyrics, the biggest load of crap to hit No 1 in the UK since the abysmal Fight for this Love by Cheryl Cole. Please come back Gaga, Beyonce, Rhianna, Britney, Madonna, anyone other than this hypocritical (religious digs) no-talent bitch to take the next female number 1 hit.

  51. 51

I dont think she owes them squawt… that is soooo stupid honeslty.. its one line and who knows if actually came from the song or not.. get over it.. the beach boys music is totally beyond dead and they need something to thrive off of for another 2 minutes of fame…. she doesnt owe them crap.. and im sure that it wont make it to court and if it does it will get thrown out.. 100% i bet it will… maybe if it was the whole chours or the bridge ot a verse or the music… but no… beach boys… you lose EPICLY!
