Katy Perry may be in trouble due to eight words: "I wish they all could be California girls."

The Beach Boys’ label, Rondor Music, is threatening legal action against Perry’s label, Capitol Records, unless Beach Boys Brian Wilson and Mike Love receive writing credit and royalties from Perry’s hit song California Gurls.

The boys themselves seem to be playing the good guys. Here’s what Brian Wilson’s rep had to say on the matter:

"Rondor owns the track and called Brian and Mike, saying they were going to complain. Brian likes Katy's record and doesn't know where the situation stands."

    The Beach Boys was the first thing i thought of when i heard that line…and i just assumed they got the rights to use it.

    Frankly I wondered about this when the song came out. How can you write a song with the same title as a classic, quote a line from the song, and not give the original artists credit or receiving some permission? It's not like they'd be setting a precedent if they got sued–its happened before! It's a lawsuit waiting to happen if you ask me.

    The Beach Boys are the greatest band ever to exist and gifted musicians, Katy Perry is just a pop star. She used their material and needs to pay up, simple as that.

    Does anyone ever have to give credit for sampling a track? It happens all the time. She "sampled" a line. She was paying homage to recognizable legends. Why would they seek to be "given credit" when the reference was already clearly implied from the start? Unless they are trying to cash in on a mega hit they had no part in producing in that case they are just being greedy and trying to keep some fresh dough rolling in for doing zero work.

    yes, its called giving an 'elemental' credit, and katy certainly owes the beach boys that in the liner notes. rappers do it all the time as well as sampling and they are smart enough to pay whatever royalties are needed before they get hung out to dry in the courts.

    So a question that was asked Katy Perry during her interview with Lisa Nova (some exclusive thing on youtube), was : "if you could steal a song from all of music history and take it as yours, what song would it be?" and she replied: " I would probably have to take something by The Beach Boys, probably "God only Knows", so perfect and simple, or i would have to pick something by Queen…" SO i think it's kind of ironic (maybe) that this is happening to her. Although The Beach Boys are classic, I don't think anything is going to happen between them and her lyrics. Obviously she loves them, but I don't think she would steal their lyrics without giving proper credit to them.

    Just to clarify some of the misinformation in previous posts: Brian was pretty young when the BB did the lyrics to Surfin' USA and used Chuck Berry's music (Sweet Little 16). It was resolved without any legal action. Brian turned over FULL CREDIT to Chuck Berry for the song–so it's Berry who cashes in from that song, year after year, even though he didn't write the lyrics.

    Not familiar w/the new song (I usually turn her off) but if its the same, it IS iconic enough to be theft maybe even if its slightly different like someone noted. Ya gotta give credit, Katy. The song is dreadful, stolen lyrics or no stolen lyrics, the biggest load of crap to hit No 1 in the UK since the abysmal Fight for this Love by Cheryl Cole.
