German Pop Singer Found Guilty In HIV Spreading Case

Nadja Benaissa, a German pop singer who was part of the group “No Angels,” was found guilty of causing bodily harm to her ex-boyfriend by having unprotected sex with him with the full knowledge that she was HIV positive.

Despite committing this deplorable crime, she was not sentenced to any jail time, but instead a two-year suspended prison sentence and 300 hours of community service, which essentially means she’s on probation. The maximum jail time that she could have received was 10 years.

During the trial, Nadja made a formal apology:

"I'm sorry from the bottom of my heart…I wish I could turn back time and make everything undone. But I know that he will never forgive me."

Nadja refused to make any statements to reporters after the trial, but her attorney Oliver Wallasch said that she had admitted during the trial that she thought she deserved to be punished for her actions.

We agree. She does deserve to be punished and should feel lucky to have gotten off with only a two-year suspended sentence.

As adults it's your own respsonsibilty to ensure you're being safe. Knews flash! People lie and cheat on each other ALL THE TIME! So why put your life in someone else's hands that way. I could see if he did everyting he could to prevent this for example insist on STD tests before engaging in unprotected sex. And also anyone with any shred of human decency should not even THINK of having unprotected sex with someone knowing you are infected. That's just evil. Even if she didn't want to tell him she should have at least insisted on protection. Let this be a list to everyone out there. It's up to YOU to protect your body. There are cases everyday where people in so called commited relationships bring diseases to their partners. Don't be naive. This situation is a lot more common than you may think.Protect YOURSELF because noone else is going to!!!

    I read a response that tried to shift the blame from her onto him. How could he be to blame. His girlfriend knowingly and maliciously lied to him, then infected him with a lethal disease. All because she was to immature to face the reality of her situation and give her partner a piece of information that could have saved his life. What she did is an ultimate act of cowardice that is inexcusable. She should have received at least the maximum sentence. A life sentence would be more fitting if not the death penalty. She has basically killed him. Any attempt to shift the blame from her is also a cowardly act.

    This news item does not say if the man contracted HIV or not. Did he? Female-to-male transmission is pretty rare (it's not easy to transmit HIV that way).

    Contemporary Germany has always been particularly light-handed in the sentences they pronounce. I remember Günther Parch, the nutjob that back-stabbed Monica Seles back then in 1993 to help Steffi Graf regain her top position in the wta rankings, got away with no jail time. Hard to fathom in America where a certain guy, if memory serves me well, had been sentenced to 42 years jail time for having stolen a pizza.

It isn´t an excuse, but she was drug addict at this time and underage. Because of that she can´t go to jail for life. The German Law is diffrent to the American.

    First off, I also don't believe the punishment fair. Of course the guy could've worn a condom, but she knew she was positive and she consciously decided to not inform her partners about it. For that, there's just one word: Wrong! If she didn't want him to know about her being HIV positive, she could have made up an excuse like not being on the pill or whatever. Or not slept with him.
    The reason she got off with such a light sentence is that by the time she committed what she was accused of, she was under 21. In Germany, young adults until the age of 21 can be sentenced under juvenile laws (depends on level of maturity and such things). The maximum sentence in those cases would be 10 years (for capital crimes such as murder). What she was in court for was aggravated battery and aggravated assault.

    anyone who knowingly transmits HIV should recieve the same sentence as someone who shoots their bf/gf in the head, same thing really. I live in canada and there was a case here a couple years ago where a man did the same thing to SEVERAL gfs and he ended up being convicted on 2 counts of murder in the first degree, 10 counts of aggravated sexual assault, and 1 count of attempted aggravated sexual assault….needless to say the verdict got him sentenced to life imprisonment, i dont normally agree with the canadian legal system, but i think they got this one right :)

In the western world where female circumcision in not widely practised the percentage of female to male infections through sexual intercourse are actually quite low. It is usually men who infect women. For a woman to infect a man through sexual intercourse she generally has to be bleeding and he has to have open sores that she is bleeding into.

    The man in question IS HIV positive, but I read that her lawyer was going to try and disprove that it was definitely her that infected him.

    She also slept with 3 other men - all unprotected - over the course of 4 years. These men, as far as we know, are not HIV positive.

    I think it's unfortunately pretty common to have reckless and unprotected sex - but the fact that she'd had her status medically confirmed means that she knew she could be dealing that person a life-sentence of HIV.

    She's got to live with the knowledge that she did that for the rest of her life.
