Federal Court Rules "Don't Ask, Don't Tell Unconstitutional"!!!

A federal court in Riverside, California, ruled Thursday that the military's discriminatory "don't ask, don't tell" policy, which prohibits lesbians and gay men
from serving openly in the armed forces, is unconstitutional!
U.S. district judge Virginia A. Phillips wrote in the 86-page opinion handed down late Thursday that the DADT statute violates the Fifth and First amendments.
AMAZING!!!!!
Phillips said the policy doesn't help military readiness and instead has a "direct and deleterious effect" on the armed services.
Government lawyers argued that Phillips lacked the authority to issue a nationwide injunction and Congress should decide the policy's fate.
The U.S. House voted in May to repeal the policy, and the Senate is expected to address the issue this summer.

If one chooses to serve their country, they ought to be honored by that country, not bashed for, hell, possibly hated for who they are. At the same time I am not advocating running amock and screaming "I'm gay!" all over the place, just a little respect for the good men and women of the military, regardless of their sexual orientation.

Now that gays/lesbians are in the mix to be equal, they should be subject to the same rule.

I have a huge problem with civilian judges and the general public voicing opinions on DADT(Don't Ask, Don't Tell). Please leave these matters to the military. Our husbands don't get paid much, they have to put up with alot of BS and so many of them have died for our freedom. Please let them have this one thing. Let the MILITARY decide what happens to the future of our troops.

Bad idea. This is just going to make it very rough on those who announce they are gay. Your sexual preference does not need to be announced. It is going to target gays AGAIN because this will not go over well. I have not personally served in the military but know enough who have and still do, this is not a good decision.

It's the same thing as race in the military. You aren't black or white. You are government property. Keep your racial slurs to your self, and you're sexual preferences to yourself.
It's how it is, and people know this when they sign up. I don't feel sorry for the gays and lesbians complaining about this if they are in the military, because it's right there, in the contract they sign their lives over pretty much. They signed it. Deal with it. Peoples personal choices in their lives and in the military, it's not just a normal work force. It's very serious. My husband was in for a long time and it's kept to BUSINESS.

While this might be excellent news for those loud mouth gays & lesbians who want equal rights, & probably have no idea of the stress, courage, & bravery it takes to be out there alone & away from family fighting for the freedon everone takes for granted. This news is not good news. My husband is in Afghanistan getting bombed almost everyday, & has to carry a gun everywhere he goes. He sleeps in a huge tent with many other guys & has to use community showers. He worrys about his safety, his familys safety, & his job. Now, on top of all that stress they are already under…he has to worry about walking on eggshells & making sure he doesnt offend the gay community? Equal rights do not belong in he military. They should be one person of one mind focused on one goal. Let the military take care of itself. Besides, I am sure the gay community would not want to be outed in the military anyways. You can have equal rights, but you cant stop the angry men and women of the armed forces from kicking your asses for bringing more hassle to their already tough jobs.

He said I have no problem with gay people serving with me. He said as long as we are looking out for each other that's all that counts.

Actually, I think the people fighting and dying should vote on this for themselves. I have no problem with gays (are you kidding? I'm a chick, I looove gay men and frankly am a bit flattered when lesbians hit on me at the gay bar), however, I AM NOT in the military. I think they need to decide it for themselves. Those men literally lay their lives down for us. THEY should decide. If you can't be openly gay, well, shucks. That is what you signed up for. You knew that going in! Being in the military is one of the most important jobs you can have. If some of the men in your barracks would prefer not to know….then well….they prefer not to know.

Theyre gunna do what they want with this, the first people who should have a say is our military. Every single enlisted person should be able to vote and go from there. But that won't happen, and us civilians sure in the hell can't do anything about it. All I know is if they pass this, then they should let the people who don't agree with this, to get out of their military contracts and go back home then if they choose.
They signed with the law that was stated about this, and if they plan to change it, theyre ALSO breaching the contract. The soldiers should be able to walk out and be a civilian then.

I don't understand why Americans make such a big deal out of this. Openly gay men and women have served for years in several military units all over the world, and it hasn't been a problem. The USA has apparently no problems sending their young men and women over to areas to fight for human rights of others, while disregarding an entire 'minority' in their own country. Why do people enlist? Idealism? To defend your country? What are you defending if you deny people at home rights based on their choice of who to love. And aren't gay people allowed to defend the country they love? I live in the Netherlands. Openly gay people have been allowed to serve in the military here since 1974. Research has shown that even though the military is a man's world and that some gay people find it easier not to be too 'in your face', there are no problems because of it.
I think DADT is a good policy, I hope this is ultimately left up to Congress.
Equality is not inevitable in the military. Gays are a small faction of persons who wish to serve but are denied the honor. People with physical disabilities, diabetics, people with a whole range of things views as "imperfections" by the military powers that be are not permitted to enlist and serve. Not everyone must be in combat. The combat warriors need support services too. It is a positive step, and it is a very good thing that gays may be able to serve proudly, but there is a long, long way to go before there is "equality" for all who wish to serve. Of course, all you see is gay and nothing else counts. Par for your course you asshole.
First and foremost i will say my father was gay so I am in no way prejudice.I feel like the dont ask dont tell is to protect the gyas who serve.There are men in the military who do not see the world in a dimensional kind of veiw and I am afraid that they will end up beating up and maybe even killing a soldier because he is gay. As you know the military is run on its own time and rules not by civilian. Also each ship will have to make accomadations for the different sexual orientations which will be very costly and not to mention the lawsuit for improper discharge the payouts could cost millions. The state of the current economy would get worse and we would all suffer. I am all for equal rights but if the gays in the military had access to the same rights as everyone else but still had to not speak about their sexual orienation that would be the same. In the military you are not allowed to say lots of things if you have a mistress if you date a fellow sailor etc. It would just fit right in but still give their partners medical and benefits all the while keeping it private .

Last time I checked joining the military was a right. The military can disqualify you for many things. Also Don't ask don't tell allows people to join the military if they are gay simply because your not required to tell them you are gay.
