Rival Plastic Surgeon Swoops In For Dr. Ryan's Patients

Talk about being tactless!

A month after poor Dr. Frank Ryan tragically died on the PCH, his patients began to receive emails from the office of Dr. Gary Motykie. Dr. Gary is another prominent plastic surgeon in the Los Angeles area and it seems several of Dr. Ryan's old staff join his team after he died.

Considering that he got Ryan's employees, Dr. Gary thought he would also go after Dr. Ryan's patients! He sent an email inviting patients to an open house at his office, explaining that Dr. Ryan's staffers had joined him and he love it if they did too.

Needless to say, some of the folks were PISSED! They fired back emails letting Dr. Gary have it, writing things like:

"I have NEVER met you, nor have I ever authorized you to use my contact information for YOU or anyone else other than Dr Ryan! This is a total breach of confidentiality"

"This soliciting for business is completely unethical"

"Dr Ryan would be FURIOUS! Shame on you for trying to steal Dr Ryan’s patients"

Shameful indeed, but as far as being a break of confidentiality, not so much. The Department of Health and Human Services confirms that sharing contact information is legal "as long as it's for treatment purposes or a doctor referral," which is what officials are considering this is as.

Still pretty tasteless if you ask us!

    Makes sense. Same friendly staff and if it was his rival, then he was on top of his game. Better him than someone else with unfamiliar faces.

    Ryan's patients are going to need to go somewhere. If Dr. Gary has absorbed Dr. Ryan's staff, this seems a predictable, if uncomfortable, transition. Patients ultimately determine who they go to, not a 'here we are' campaign. Getting plastic surgery shouldn't be like buying a car; prospective patients have a duty to themselves to research any plastic surgeon's before and afters, and to check out the surgeon's medical record and reputation beforehand.

    Sounds like a smart business move and helpful for some of his patients who won't know where to turn for their next procedure. Soliciting for business is unethical? WTF?

    Dr. Ryan is dead!! These patients aren't going to be able to see him anymore, so where's the problem. Are some of these people waiting around for the second coming of Dr. Ryan.

    He'd be furious? That someone was trying to look after his patients now that he can't? Who arrogantly decides that they speak for a deceased man?

    I see nothing wrong with this new doctor wanting to introduce himself to a dead doctor's former patients. What's the big deal? It's not like the patients' contact info was made public.

    Story taken from T.M.Zee. However you only cut and pasted the copy not the doc's picture they had. By the way, a mailing list is not a breach of confidentiality. Unless he bought the practice he doesn't have their medical records, which are confidential. Anyhow, maybe he's a better surgeon. Ryan did the exact same Stepford Woman work the rest of Hollywood does and makes carbon copy faces of everyone. Maybe this guy is a bit better than that.

    There is nothing wrong with what he did. This is business. He did those patients a favor b/c it is very hard to find a good doctor in the first place. Besides, Dr. Moy-Toy is a hottie AND was on Dr. 90210. So get over it.

    Eh. All these big plastic surgeons are ending up in some form of hell someday. Cutting up people and shoving shit into their bodies for vanity can't possibly make you some sort of saint. So why not cash in while he has the time? Half the idiot broads he calls are probably dying to have more surgery anyways.

    Your wrong! sharing a (medical) patient mailing list is a violation of HIPPA. In order for a medical practice to share any patient information you must get the patient's written authorization to share any of the patients personal info.
    If a medical practice wants to market or advertise to any of their PATIENT'S using outside vendors, the "vendor and or independent contractors" must sign a Buisness Associates Agreement.

    ****FYI Dr. Gary Motykie is one of the Dr's on Dr 90210..and he is THE BEST…WAYYYYYYY more talented than Dr Ryan. If I was going to get plastic surgery I would def check into Dr Motykie. IMO Dr Ryan wasn't all that good of a surgeon judging from his celeb clients…none of them have a natural appearance…hello Heidi for one. ………sorry but truth is truth

Any fine, if incurred, might be less than the long term monies garnered from going after a plastic surgery patient list, unless all of the patients objected singularly to being contacted through information shared breaching patient confidentiality.

    I love reading all the EXPERT opinions of 16 year old girls and slobs from ohio on such things as business and plastic surgery!!!

    A. His client list is kept on his database which is property of his estate. Dr. Motykie would need the permission of the person who controls it and I promise you he doesn't (fact)

    B. It doesn't really matter who's better or whatever (idiots) because it's in poor taste what he did and it's PROVEN to be a POOR BUSINESS decision because Dr. Ryans clients are clearly not happy about it.

    C. How many of you whiz kids have ever had an elective procedure? The only Rodeo you've ever been to comes twice a year, is 2 miles from your parents Trailor park and your uncle and 3 cousins ride in it!
