Back in July, we reported that Vampire Weekend was being sued by the model on the cover of their Contra album.

Now, the band is looking to get satisfaction themselves, and they're suing the photographer, Tod Brody, for alleging that he had the rights to former model Ann Kirsten Kennis' photo, which they used on the cover.

A judge has given the band permission to pursue legal action against Brody, but the photographer hasn't responded to any contact attempts thus far.

In an effort to show him how serious they are, both Vampire Weekend AND Kennis' lawyer have requested permission to "pass a summons via email or post rather than serve him papers in person."

On Nov 18, they were granted permission to do so, and Brody's summons was issued on Nov 24.

Looks like Brody will be considered "served" within 10 days of the issue date, and he'll be forced to respond to the summons by early 2011, otherwise he's liable for a default judgment.

Guess we'll hear more soon, as that deadline is fast approaching!

    Definetely…..it hurt their credibility as a band and a brand. Any good artist knows about licensing, especially on a print that is selling upwards of 1 mil copies. He broke a cardinal rule by not seeking permission. Intellectual property laws are no different than anything else.

    She is old now, she should be glad there is a hot picture of her out there. Give her some cash and stop this bullshit that has been going on for more than a year.

    claiming ignorance doesn't leave this band exempt from blame. just to be certain, why didn't they ask to see the waiver signed by the model? there's always something in writing…you don't just take someone's word for it…

    its the photographer's fault, not the band's! The photographer made them think he had permission to use the photo. Sounds like this photographer doesn't know the legalities around photos. Must be an amateur.

    This is stupid. What a grumpy bitch that model is. She should be glad her photo's famous! Crikey. It's all about the money though these days.. isn't it. Greedy fuckers.

    All that was needed was a model release form. That was it.
    The photographer should know better then anyone else that he needs one of those even if it was considered an old photo. The band should have known better then to ASK for said model release form.

    the photographer should know what he's doing. why does vampire weekend need to actually see every release that the professional photographer they hired tells them exists? the photographer is supposed to be a professional- and now he's liable for these damages.
