The Black Eyed Peas Sued AGAIN Over Copyright Issues!

| Filed under: Music MinuteLegal MattersFergie

Wow! We've lost count how many times this has happened now!

George Clinton, a legend in funk music, is suing The Black Eyed Peas for allegedly sampling one of his songs on their track, Shut Up.

The song was first featured on their 2003 album, Elephunk, but has spawn several remixes since then, including one that appeared on the deluxe edition of The E.N.D. album. According to Clinton's lawsuit, the group used elements of George's song (Not Just) Knee Deep on this remix.

As he insists that he never granted the group permission to use the song, he's suing will.i.am and Fergie, along with Universal Music Group for copyright infringement damages and an injunction to block further sales of the remixes.

We hate to break it to them, but George does have a point. The remix does sound a lot like his funky hit.

Take a listen to George's song and The Peas remix (above) and tell us what U think? Does George have a case?

    so sad lol

  2. 2

    Will.i.am is a hack!

  3. 3

The Black Eyed Peas are such a joke. Like what the hell, can they ever just make up their own beats.

  4. 4

Doesnt surprise me. Nothing about them is original.

  5. 5

if by "Sound a lot alike" you mean "sounds exactly alike" then yes.

There is no question they ripped off that song.

    Pathetic.

  6. 6

They must rely on their fans being dumb enough to not know the old songs. Sad.

  7. 7

    Yep he has..pay up BEP.

  8. 8

This is shocking! I wasn't aware of the fact the the B.E.P. have been sued more than once! This really is making me reconsider as to whether or not I'm going to continue being a fan of theirs! :-/

  9. 9

    ?

  10. 10

I do agree most of their songs are samples from original hits including fergie clumsy( little richard), But they are not the only one, most of the artists today prefer to use sample tracks then to be original. I do like them anyways!

  11. 11

Re: fickdichpogmothoin! – that's not the point. everyone can get to a deal with the original artist and use their beat. i wouldn't care if the b.e.p. used this guy's beat if the guy even KNEW about that. the point is that they're stealing beats and it's not the first time.
this group is really pathetic and it's sad that they have so many fans.

I can't believe the BEP are so freaking popular. They make shitty music and keep ripping off other people's songs. Clinton DEFINITELY has a case and I hope the BEP pay up.

  13. 13

There is nothing artistic about the black eyed peas. They dress nice, they have an awesome following consisting of a truck load of 14 year olds, and fergie is "kind of hot"? But, unfortunately, that is really all it takes these days to be considered an artist. If anyone wants to hear real musical pop art, check out Ronnie Spector, the Beach Boys, Exile on Main Street (Rolling stones), The white album, Lauren Hill, etc… And Perez, stop writing about these frauds!

  14. 14

Uh, do the black eyed peas make ANYTHING original??

  15. 15

Now they did … they pissed off George. He should take his P-Funk All-stars and kick his ass.

  16. 16

play the songs at the simultaneously. they didn't sample, they used the song, altered the beat, changed the key. it's the same song, redone.

  17. 17

    Yes, he has a case.

PS: Do the other two members exist? They are never on any songs not to mentioned they aren't even getting sued? LOL

  18. 18

I was really offended by their blatant ripping off of Mancry's song but this is just too much, people should really re-evaluate this band who are fans. It's not cool at all to rip off a smaller fish.

  19. 19

I hate the black eyed peas so much. This is what like the fourth or fifth time this has happened. Can they make one song without stealing it?! Apparently not. They are unorigional and they lack one thing… talent. Plus to add to that all they do is autotune EVERYTHING. In my eyes they are the most pathetic celebrities I've seen. I will never like "there" music.

  20. 20

That's not the song "Shut Up". That's a remix done by God knows who. Post the original song "Shut Up" by the Black Eyed Peas and the songs don't sound alike. I agree that they have sampled other songs to death. though.

  21. 21

This is SOP for them. Pretty much all of their music (that I have heard) is copied (sorry, sampled) from other peoples work. I can't think of anything original they have done. Maybe being meth addicts? Nah, that one has been done before too. And in response to Alice Radley above: Yes, they do rely on their fans being too dumb to know the old songs. I have talked to many BEP fans who were blissfully unaware that they had been stealing other peoples music.

  22. 22

Yes he does have a case. The black eyed peas are known for sampling and stealing beats, claiming that they're original. CAN THEY EVER MAKE THEIR OWN BEATS?!?!?!?!

  23. 23

holy FUCK yes!! that's really messed up

  24. 24

Hey remember when you called WillIam the same slur you always callout straight people out for using?

  25. 25

those bastards. love knee deep. love it. cool to sample it. but, without even asking. come on will.

  26. 26

I heard this the other day on the radio, I think! Yup. Definitely SIMILAR…

  27. 27

They're such a joke. They should just stop doing music seriously… I don't even understand how they have fans..?!

  28. 28

    Oh hell yeah

  29. 29

I knew he had a case when the first 5 seconds came on. That is exactly his song and he deserves his money for it. Also sadly as it is this is not the first time George Clinton has been ripped off. He hasn't been paid for years for his work and people use his work without asking him. He has to still do concerts just to pay bills becuase he can't even get royalties due to his record company srewing him over. I find it sad that people can take advantage of a person who paved a way for a whole genre or sub genre and whose original music that involved creativity and effort can be taken advantage of. He's not the first nor will he be the last.

  30. 30

Re: mikett – they released this remix on their album.

  31. 31

Hear what GEORGE has to say about all this… and a whole a lot more at: Funkprobosci.org & youtube.com/funkprobosci

  32. 32

i hate B.E.P it was/IS an disgrace to HIP HOP that they won,..best HIP HOP album..are you kidding me! HIP HOP, this is why HIP HOP is dead and will remain dead, thats like giving Justin Bieber Break through HIP HOP artist….B.E.P are not HIP HOP they are POP/DANCE, i hate their music but i LOVED fergie solo

  33. 33

I hope they get sued and lose in court.. that’s when they will stop stealing others sound..

  34. 34

This should prove to be an open and shut case - pay up now and move on.

  35. 35

It sounds similar but it's CLEARLY not sampled. Last I checked it was not illegal to write a similar song to some one else…

  36. 36

I only had to listen to the first 2 seconds of the Black Eyed Peas remix to know they sampled George!
As a P-Funk fan, I'm appalled such a terrible group has used his music, especially without paying him for it!

  37. 37

Re: savannah92able – I've met George and he still loves performing, so it's not a travesty that he still tours, but I agree he's been screwed over and deserves to get paid, especially considering the immense influence he's had on music.

  38. 38

no wonder will.i.am loves korea! both of them do nothing but rip better things off!

  39. 39

    Big time rip off!

  40. 40

NOT THE FIRST TIME, MARIAH RIPPED OFF ATOMIC DOG FOR FANTASY, AND PAID DEARLY FOR IT. I DON'T UNDERSTAND WHY UNTALENTED SONG WRITERS JUST DON'T SAY "SAMPLE" AND PAY UP. DIDDY DOES IT AND SO DOES JANET, ONE THING IS TO PAY HOMAGE, ANOTHER IS TO CHANGE THE WORDS TO A SONG AND CLAIM IT AS YOU OWN WHEN THE MUSIC IS EXACTLY THE SAME. AFTER ALL, IF YOU CHANGE THE WORDS TO "MARY HAD A LITTLE LAMB" THE MELODY WILL ALWAYS BE THE SAME! PLAIN STUPID, HOPE MR. CLINTON GETS ENOUGH MONEY TO TEACH WILL.I.AM A LESSON!

  41. 41

wow its the exact same song!!! the whole beginning is ripped off! yeah Id totally sue too. BEP never come up with their own stuff!

  42. 42

Re: mikett – BEP made the remix themselves…it was released on their album…

  43. 43

First of all, let me briefly school some of you people that are oblivious to "sampling music". This has been done for a long time. Such artists as famous as Elvis, Zeppelin, The Beach Boys, Michael Jackson and etc have taken songs and lyrics and made them his/her own from other artists like Muddy Waters, Big Mama Thornton, Chuck Berry and etc. Btw, these artists were eventually sued by the original artists too. It's real hard to be truly original being many artists' work is inspired by another, though when you find that gem it truly is greatly appreciated or not. You can love BEP or not and this isn't meant to be in their defense. I think anyone should have permission when profiting from another's music. But let's not be too quick to judge them exclusively and praise other artists out there like someone commented on The Beach Boys. Do some research first before you make your point, ok?

  44. 44

Re: klingchad – Just an fyi, The Beach Boys had this same issue regarding music taken from Chuck Berry and were eventually sued for copyright infringement. Just my two cents. Regardless, they have made good music and paid their dues. Just feel if you're going to use other artists that are "original" make sure not to mention a group or two in your list that did the same as BEP. Thanks :)
