Parents Of Deceased Gay Teen To Sue Rutgers Over Suicide

As a result of the suicide of gay Rutgers University freshman Tyler Clementi, the state of New Jersey passed the "Anti-Bullying Bill Of Rights."

Despite this, Clementi's parents are planning on suing the University, although Rutgers claims that his death is not their responsibility.

According to a notice from Clementi's parents' lawyer, Rutgers failed to protect Tyler from "unlawful or otherwise improper acts" by two of his classmates, who spurred his decision to jump off the George Washington Bridge after they broadcast a video of him having sex over the Internet.

Damages that Clementi's parents are listing in the suit include pain and suffering, loss of companionship and support, and financial costs.

Here's what Rutgers spokesman E.J. Miranda had to say about the situation:

"We at the university share the family's sense of loss of their son, who was a member of our community. We also recognize that a grieving family may question whether someone or some institution could somehow have responsibility for their son's death. While the university understands this reaction, the university is not responsible for Tyler Clementi's suicide."

According to a statement made by Clementi's family, "a decision as to whether to file suit against Rutgers University in the future has not been made."

Guess we'll see what the family decides to do.

This is an awful situation, and it continues to upset us that this happened in the first place.

We hope the Clementi family is able to find peace over time, one way or another.

    This certainly is/was tragic but I can't see how the university is responsible.

    It sounds like the lawyers have descended. Way to cash in on your son's suicide. I can see suing the bitch and bastard who put his privacy out there to humiliate him, but wtf did the University have to do with it? I'd also like to find out just how accepting these parents were of their gay son, if they're considering cashing in on it now. My guess is they weren't accepting at all.

    Am I reading this wrong Perez? You say he is in your caption and then say the family is undecided????? I'm confused. I seriously cried reading this small blurb what a tragic loss. It saddens and sickens me that people can be so cruel. I don't know how I feel about the university being responsible but I know the boys that posted the video ARE definitely responsible!

    I don't see how what these people did is any different than what Perez Hilton does. Outing a gay person is evil, no matter what the intentions or result. You're just lucky no one has killed themselves yet.

    This was a tragedy indeed.. but I don't see how Rutgers should be held responsible. I could see if it was a situation where he constantly went to professors and/or the dean & complained about being harrassed, but there wasn't anything ever mentioned about complaints filed. I can understand the parents wanting to lash out, but they're taking it out on the wrong people.

    i have aches and pains for this family's loss. i cannot n my life imagine losing a child and how the depth of pain must be. BUT i don't think law suits will make anything better. i think they should let it go, deal with thier greif in private and be a sparten in EDUCATING the world, not suing the world. it's so pointless. a university? really? are we going to start suing the gravel company when we fall off a curb and hit by a car? their pain must be so deep. At Christmas this year, i pray for their loss and God to help them thru this difficult time. money and law suites will never make it better. i just feel so bad for them.

    They haven't confirmed that they are suing the school… I don't think the school should be held responsible, unless they knew about it all before it hit the internet… But, whoever DID post it should have the book thrown at them!!! So sad… And, I also hope the parents were always supportive of his lifestyle, and not just trying to make a big deal out of it, after the fact.

    No one is responsible for suicide other than the person who commits it. It's reasonable to believe that the parents could sue the university (on their son's behalf) for not protecting him from "unlawful or otherwise improper acts". However, the result of that lawsuit wouldn't reward them monetary compensation for pain and suffering, loss of companionship and support, or financial costs. Their son did that on his own. Suicide is a selfish act.

    It wasn't the University's fault. I really hope they don't go through with this because it cheapens this young mans death.

    The people responsible and those that should be sued are the two slime that did perpetrated the act that drove him to suicide. 50% of anything they make over the next 40 years should go towards Clementi's family.
