| Filed under: Icky Icky PooRihannaLegal Matters

Photographer David LaChapelle, claims Rihanna stole images in our her S&M video - and he's suing her over it!

In a lawsuit made public on Monday, the fashion photographer claims "the music video is directly derived from and substantially similar to the LaChapelle [his] works."

In the suit, LaChapelle said Rihanna had appropriated eight of his images into the video, such as a shot where she is shown in profile against a blue background with a piece of candy on her tongue.

LaChapelle says Rihanna's video copied the "composition, total concept, feel, tone, mood, theme, colors, props, settings, decors, wardrobe and lighting."

He is suing for unspecified damages.

Rihanna's peeps have yet to comment.

Wow. Wow. Wow.

This is major!

actually, the images really do look like LaChapelles work. Rihanna's art director most likely is familiar with david's aethetic and took his ideas. It is impossible to copywrite artistic style… so this kind of "stealing" goes on all the time. they should just fess up and say they were inspired by him and apologize for copping his style.

  2. 2

Good for him! I would do that exact same way.. I'm into photography and if someone used my work, I would not be to happy!

  3. 3

Any truth to his accusations? Really, Perez?? It's pretty obvious that Rihanna stole his ideas for this music video, so stop acting like you and her are sooo above it. It's not like being walked like a dog and deep throating a banana is anything to be proud of anyway.

  4. 4

isnt' it the other way around mario? she thought it was hot as hell and stole it. Team LaChapelle!

  5. 5

she did take images out. your just saying that cause u were in the video

  6. 6

Perez sounds surprised…although he did screen shots of both videos on this site….and they were very very similiar.

Imitation is a form of flattery but does Rhianna's video director not have two brain cells to make a distinct video? Rhianna should just sing in front of a microphone…she has a voice…she is trying too hard to sell sexy to us…and her knees are not sexy.

  7. 7

and this was her honesty album! for shame..lol

  8. 8

We were all Expecting this so….

  10. 10

Ridiculous. He doesnt own anything. What a looser. Lost a lot of respect for him

  11. 11

    He's right!!

  12. 12

Madonna should do the same thing to man gaga

  13. 13

Madonna had to pay and settle a lawsuit because her 'Hollywood' music video used too many references from the work of iconic photographer Guy Bourdin. So I think David LaChapelle has a valid point and rights to protect. This is a commercial video, and the director was paid lots of money for it, if she wanted to pay 'homage', she would so with a shot or two, not with the majority of the video.

  14. 14

Seriously who cares the pictures are not the same he swears like his the only one that takes photos of colorfull backgrounds people dressing up in that case everyone in the circus buis should be suing him cuz there the ones that started taking pictures of weird stuff positions and backgrounds

  15. 15

If Rihanna's people wanted to avoid this, I'm sure all they had to do was ask LaChapelle for permission and/or creative input, he probably would've be happy to help them out, and maybe they could've created something NEW instead of just directly copying another artists work.

  16. 16

First time I saw her video I asked if Lachapelle directed it.

  17. 17

I wonder when Madonna's gonna sue Gaga!

  18. MJB12 says – reply to this

Yes, it is clear the images were stolen. But it's RIHANNA'S FAULT? Not a chance. Actually, I doubt she has even heard of LaChappelle or seen his work. Someone in her camp is responsible, but I highly doubt she herself should be held responsible.

  19. 19

Dont steel an artistest ideas! How would she like it????

  20. 20

    Re: samdavid – LOL!

  21. 21

Mario didn't you start this? You were the one who started the comparisons. Don't expect to get a call back from her. Lawl!

  22. meme says – reply to this

Good for him. Maybe Madonna will be next to sue Gaga for the same thing.

  23. 23

Everybody sing! The wheels on the bus go round and round, and Perez will throw you under. To think you were all about this video a short time ago. Show some integrity shitheels and stop trying to distance yourself from your own words.

  24. 24

If they knew they wanted to take this kind of direction with the video, why didn't they just ask David LaChapelle to direct it in the first place? Problem solved.

  25. 25

Good for him and as an artist how is she not responsible it's her image that is being sold in that video. Maybe this will teach her to be more involve in her projects.

  26. 26

Maybe Madonna isn't suing because she's just as guilty of stealing ideas.

  27. 27

    Team LaChapelle!

  28. 28

about time! and completely warranted. for anyone who is talking shit about lachappelle, ask yourself this question . . . if that were you, would you not do the same exact thing? i think you most definitely would. i don't have to be a lawyer to know that he has a really good case. serves rihanna (and the director for that matter) right. even after the backlash, she, nor the director, acknowledged it or gave thanks where thanks was most definitely do. rihanna has become such a pompous, talentless ASS, she needs to get knocked down a peg or two . . . or three. thanks david lachappelle for putting this biatch in her place and standing up for the integrity of your work and the unauthorized use of it.

  30. 30

fame world people r just so silly !! he's suing her for taking her own pics without asking him just becuz he's the one who toke the pics ? SILLLLY !
we're dyin' here !!! jerks and ur suing people for taking their own pics ?

  31. 31

Well good because she deserves it and all the people who worked on the video and fashion deserve it.. you can't steal people's shit like that and not even give them credit.. that's bs.. no one should be flattered by a stealer ..not even a copycat.. now if only Gaga would get sued already.. she deserves it too…

  32. 32

Completely warranted. The director has some explaining to do.

  33. 33

God,she's as bad as caca. What a pair of thieves.

  34. 34

she is a porn star first, did you see her dry humping on the grammys.
GROSS! Worse then a wardrobe malfunction. She has no dignity- she's a whore

  35. 35

That's what happens when you steal, I don't wish Rhianna harm but I agree that David has ever right to sue.

  36. 36

There's no doubt of the plagiarism. He should be paid for contributing to her work. If it takes a suit… then he's got a good chance of winning.

  37. 37

I know you can't own an idea but they are so clearly the same set up how can people be so in denial. I would as an artist hate if someone so obviously copied me , i know its not like he actually took the photos himself but it is staged the same way as his photos.

  38. 38

Glad to hear LaChapelle is doing something about it. Even the lyrics in this song seem to have been "borrowed"?

  39. 39

Since when it is LaChapelle's property to use bright colors?

  40. 40

Her and her "people" deserve it. It's just not fucking right.

  41. 41

Shouldn't he be suing the DIRECTOR? Oh yeah Rihanna has more money. If it were Lady Gaga or another white artist he would have no problem with it.

  42. 42

Re: TRUTH-TELLER – race has nothing to do with it! :/ people who say things (like you just said) are the racists.

  43. 43

no comments yet from her side= ovb. copied… plus have you seen the photos…I mean, come on….

  44. 44

The song sucks but that's really beside the point. You can't just work a blatant ripoff like this and expect to walk away scot-free. Now the finger-pointing begins for real to keep her image afloat after this latest blow.

  45. 45

  46. 46

ridiculous! As much as I love LaChapelle's work, I don't think he's gonna win this. It's really silly when it gets down to it. Rihanna is exploring fetishes in the video. LaChapelle does not own the rights to sexual fetishes. No one does!

  47. 47

Re: Achilles Hartsteen – Loser?? David LaChapelle?? Do you even know who he is?? One of the greatest photographers in the World!! He doesn't own anything?? Do you know about copyright laws that includes photos, Madonna did the same with Guy Bourdin images and she have to pay!! Rihanna was beat up by Chris Brown and what she did? A duet with a misogynist pig (Eminem) and a song about S&M.

  48. 48

omg, you cant be surprised, she made it completely obvious that she was ripping it of! and perez, you were her bitch in it, umm not what i would call a compliment!

  49. esbee says – reply to this

LaChapelle was a protege of Andy Warhol, the guy who brought appropriation to the mainstream art world. Andy was sued himself by a photographer over his flowers piece. LaChapelle needs to lighten up and remember the roots of pop-art and what a flattering gesture it is to have another artist appropriate and reinterpret your work; Its proof that you are influential.

Re: Captive – How is Hagdonna gonna sue anyone for copying? That's what Slutdonna has done her entire career, steal ideas from other, more talente artists. She also has systematically fucked her way through the industry. From radio and club dj's to record execs. They don't call her Whoredonna for nuthin !

  51. 51

Clearly he is broke ass poor and needs money

  52. 52

I'm Team Lachapelle too…it's the SAME thing! There is nothing new or orgininal in this video.

  53. 53

    This is a bit much.

  54. 54

THE IRONY and NERVE of this guy!!

"In 2003, following the use of dance routines from (Flashdance) by Jennifer Lopez in her music video I'm Glad (directed by DAVID LaCHAPELLE), Maureen Marder (who the film was inspired by) sued Lopez in an attempt to gain a copyright interest in the film. Although Lopez argued that her video for I'm Glad was intended as a tribute to Flashdance, in May 2003 Sony agreed to pay a licensing fee to Paramount for the use of dance routines and other story material from the film in the video." - Suzanne Herel, Chronicle Staff Writer San Francisco Chronicle June 13, 2006

    Re: ahmarie

Im also in photography and I'm team LaChapelle… I read the article and Yahoo and all I had to do was read the title of the article and see the image and I knew this was about DLC

  58. 58

Wow… way make this issue about something its not… she CLEARLY copied. I mean even a blind man could tell that its like a clone (i mean this metaphorically just in case you couldnt tell)

    Shit man…

  59. 59

    Re: Helarrys

That flashdance lady had all rights to sue them, and DLC has all rights to sue Rihanna… if its not your work.. you HAVE to give credit where credit is due… its simple not fair to the artist who did it first.

  60. 60

Totally support him on this. He got ripped off!

  61. 61

Bourdin's son dropped the lawsuit in exchange for $$$. Madonna admitted no wrongdoing. Settling was likely far cheaper & no doubt less time consuming. I feel for LaChapelle. I'm a huge fan & don't care for Rianna's work. But,his images-the actual physical (or digital) photographs HE took- are what's protected. She's not selling his photographs for her own profit. As someone mentioned, you can't copyright a "STYLE" Fashion designers, for example, are knocked off all the time. Plus if he really out & out STOLE a choreographer's work for a J Lo video….Pot, meet Kettle

  62. 62

Good. Rihanna is an overexposed twit and she needs to be called out for theft and stealing people's style. She needs to sit down and go away for about 6 months to a year.

  63. 63

i wonder whos fault is this ??? perez? lollllllllllllhahahahaaaaaaa

  64. 64

Does anyone else find it weird that her makeup artist for this video shoot is David LaChapelles BFF and is featured in several photos in his books?!?!?! Did we miss this coincidence??
