16 & Pregnant Teen Fights To Take Custody Away From "Cokehead" Baby Daddy

It wouldn't be 16 and Pregnant without DRAMA!

If you tuned in to last night's episode, you were introduced to Jamie McKay, a now 17-year-old mother of a 7-month-old daughter. We've now learned that the teen mom has just filed paperwork to keep her child away from her father, 18-year-old Ryan McElrath, because he allegedly has a serious addiction to cocaine.

In her filing for sole custody of the child, Jamie insists that Ryan is "not responsible and not in a position to provide a stable environment" for his daughter. In the docs, she claims her baby daddy has a "history of driving while under the influence of alcohol" and a "history of cocaine abuse," two activities he hasn't let go of since he became a father.

For the time being, Jamie wants Ryan to be granted supervised visitation at the local a court-monitored facility and also be ordered to complete a parenting class. This is all after he submits to the "appropriate drug and alcohol assessments and testing and to comply with all treatment recommendations."

Kind of asking a lot without having any proof, dontcha think girl? Sure, the judge should take heed of what you are saying since there is a child's safety at risk, but let's be reasonable - you should be making all these demands AFTER the court proves he is a cokehead, not before.

    If you had actually watched the show, you'd see the guy had DUIs and lost his license, at age 17.

    He was constantly partying, lying and generally being a horrible father.

    When a parent has presented a pattern of substance abuse, the BURDEN of PROOF is ON THAT PARENT!!

    Should she wait until her baby gets into a car accident with this guy while he is under the influence or should she do everything in her power to protect her child and attempt to avoid it???

    When I actually read your commentary, you sould like such an immature idiot.

    i watched last night, and i could tell without anyone having to say anything that he was a person with a substance abuse problem. im not here to make fun of him or anything like that. i have known many ppl with the same problems, and know how to recognize the signs when i see them…his eyes seemed watery and red, his nose was rather suspicious looking as well as his behavior. i just hope that he realizes there are way more important things in life, especially now that he is a father and gets his act together not only for his sake but for his child's as well…i think the girl (jamie) is completely doing right by her child by taking the necessary precautions to protect their child from what could potentially be a hazardous situation…

    I'm sure she has enough proof.. this is not the first story out there about his awful behavior… These girls are so young and so easily influenced… (screams daddy issues) love can truly be blinding sometimes…. I feel sorry for them, people are constantly calling them whores and making snap judgements as if they have never once made a mistake in their life… I know some people older then 16 who stilll have the mind set of children who have kids..Its just sad that people don't think to protect themselves. I really hope this is a trend that starts decreasing. And Ps.. Perez he has dui's and court dates for abuse.. I think thats more then enough proof..

    Boy this show is turning into a Juvenile Delinquent Cops program. It makes me really sad. I hope this type of programming runs it's course. Making entertainment of peoples misery and problems is not a good reflection on our society. This show in particular is going down the gutter faster than you can blink.

    i've watched this show from the beginning and i have to say, theres maybe been 2 or 3 success stories?? stereotyping to the max here.. what about the other girls across america that have babies young and come out strong? macy was a peach and the other girls all defintitley have potential but sadly cave to the pressures of being a young mom. i realize that having a show glorifying teenage pregnancy is quite the stretch, but i truely wish they would showcase some young mom's who've overcome and triumphed in th end!

As someone who has known (very well) a person with a substance abuse problem, why on earth would I need a secondary source to prove to me (or anyone else for that matter) whether or not this person had such a problem? Especially since I'M the one living through the nightmare?? That last comment is so friggin' ridiculous, I just HAD to say something!

Ok…let him take the baby then, get high on coke and drink a few, put the baby in the car and drive, get into an accident, kill the fucking baby, then maybe that'll be enough "proof" for you. I think her, as the mother, is doing what ANY mother should - protecting her baby. Anyone can tell just from the episode alone that he is a crackhead.

    And on another note, I have to add that yes, she was dumb enough to sleep with him initially but having a baby makes you grow up. I'm sure she thought he was cool until a baby - HER baby - HER OWN FLESH AND BLOOD - got involved. Now that her child's life is in danger, I'm pretty sure she doesn't think he's "cool" anymore. We were ALL like that once, so don't get on her about that. Its called being a child and acting like a child. I'm just glad that she has chosen to grow up for the sake of her baby - unlike this loser of a father who can't give up alcohol and drugs for his child.

    If she needs a "secondary source" then MTV should turn over footage of whenever he was on camera for her episode. I watched last night, he showed up to the birth late after partying and was reeking of alcohol. If they need someone to attest to her "allegation" of what she said during the episode, have the crew that was filming testify to whether she was correct. She has more than just her word on her side, she has video proof.

And if he has so many documented problems (which you would know had you actually WATCHED the show) then her claim is already proven.

    Perez, I typically read your posts and get a good laugh out of them- but I don't bother commenting. This, on the other hand, is a completely ignorant and uninformed post. Did you even watch the whole episode? Or did you miss the part where he showed up to hospital and SAID that he had been up for three straight days "waiting for her to call" about the labor. The WHOLE time he keeps looking at the camera with a smirk on his face because he thinks he has us all fooled. I knew then what he had really been doing, because unlike you, I'm not an idiot. Before you comment on something that pertains to the safety of a child "let's be reasonable" KNOW what you're talking about.

Teens need to be safer and protect themselves, its like something so hard to put on their heads. They just let get driven by the situation without thinking.

    Did anyone feel like they were in a legit twilight zone watching this last night??? Omg it was just so weird to me…..and the whole time i kept telling myself "see you on teen mom" sigh, and it was sooo creepy how much he wanted to have the baby to himself, probably to show her off to his friends.
    On a funny note, her face totally TOTALLY belongs in Where the wild things are.
    And he's the real life character that Seth Green plays in almost all of his movies, down to his voice and idiot mannerisms. noooooo joke lmao

Even though they have ads during the show about the difficulty of teen pregnancy, they still have season after season of young immature girls not fully understanding what they are doing.

    Don't you have to actually petition the court for full custody before they'll insist on any substance abuse tests? Pass those, and the petition might be denied if he already has custody. I'm not certain, but think that this is the way she has to go in order to even get those substance abuse tests. You can't just ask a court to give someone with full custody random tests. You have to file for custody, and then the court can ask the custodial father to prove his is fit.
