Holy shiz! We guess he has some serious legal standing!

As we reported, award-winning tattoo artist S. Victor Whitmill, who is responsible for the design inked on Mike Tyson's face, recently filed a lawsuit against Warner Brothers for depicting a similar tattoo on Ed Helm's character in the upcoming Hangover, Part II, claiming that he was never asked permission for its usage.

Well, it looks like the case is moving forward, and if the judge rules in his favor, it would effectively block the much-anticipated sequel from being released!

Warner Brothers has responded to the suit in a brief to Judge Catherine D. Perry, claiming that a delay in releasing the film would incur massive costs, and asserting that Whithill charges are just a 'radical claim that he is entitled, under the Copyright Act, to control the use of a tattoo that he created on the face of another human being' and that the film's usage of the design falls under 'fair use' because Tyson and his ink are well-known in pop culture.

We're not going to lie, this case really does raise a lot of fascinating questions about intellectual property law!

But we hope that they can reach some sort of resolution - and fast!

If Warner Brothers loses this one, this movie is going to be EFFED!

    I love it….he has them by the balls and there is absolutely nothing the studio can do. What do you guys think? Does he get $50k, $250k or a cool $1M? It's definitely worth that much to Warner given the marketing costs they have sunk into this release.

    As for this post, its a tattoo…On someones face…Its not even cute and that is why they stuck it in this movie because its hilarious that ANYONE would do this to themselves willingly or unconciously…Its not that serious, but then again I guess that its just another money hungry person.

    this guy it stupid, the judge is more stupid for giving him a case. you can't claim anything on a tattoo. If that was the case then all tattoo artist would be screwed for doing the same tattoo as another. This guys is looking for a quick buck…get over it loser!

    I'm an artist, and have gone after clients for copyright infringement issues, but what this tattoo artist is claiming is ridiculous! I highly doubt he's copyrighted the design, which is based (self-proclaimed) on a tribal design. If anything, the originating tribe should go after the tattoo artist for ripping off their designs to put on high-profile celebrities. I bet if Warner Bros. dug hard enough, they could find examples of this design, even pre-dating the copyright branch of the legal profession.

    many artists are inspired by another's works…i work in interior design, and most high end furniture manufacturers have designs copyrighted so as to keep others from "knocking off' their exclusive designs. he only has a case if he copyrighted that design.

    Well I wonder if Mike Tyson asked the "artist" if he could have permission to be in the first movie since his copyrighted art is on a human face of a celebrity. Did this artist get a cut from his camo? Copyrighting old phrases and tattoos on PUBLIC PEOPLES FACE. What a joke….. I hope he looses. Next we won't be able to make jokes about certain people.

    Errrr….. As I was reading this the Hangover trailer played on the TV (in the UK) and the tattoo was shown in the trailer. It has a release date here and no cinema here seems to be worried. It doesn't seem to be as much of an issue as you think.

    Yes, it's fair. The little guy always gets boned. All to him. If he were selling tshirts with the Warner Brothers logo on it, which is a well known logo in pop culture, he would get the pants sued off him and his children would be eaten for breakfast.

    Ridiculous… So every tattoo artist that has ever given a celebrity a tattoo and seen a similar tattoo on the silver screen should file lawsuits against the movie company… Its a simple tribal tattoo, who cares?
