Boo! Prop 8 Supporters Appeal Walker Ruling Because Judge Is In A Same-Sex Relationship

Earlier this month, we were very happy to announce that Prop 8 proponents' motion to vacate Judge Vaughn Walker's ruling that Prop 8 was "unconstitutional" was DENIED!

Now, proponents of Prop 8 are once again trying to fight against the Judge Walker ruling, on the basis that he's in a long-term same-sex relationship.

Prop 8 supporters are claiming that Judge Walker never disclosed he had a same-sex partner, and therefore his ruling should be thrown out. They believe his decision is biased due to the fact that he could personally benefit from legalization of same-sex marriage in California. Ugh.

Fortunately, groups that are fighting against Prop 8 such as Lambda Legal and the American Foundation for Equal Rights are coming to Judge Walker's defense.

Here's what Lambda Legal's Peter Renn had to say about this new move against Walker's ruling by Prop 8 supporters:

"The court decisively rejected an outrageous attack on the integrity of Judge Walker, not to mention judges in general. The motion was a sideshow designed to deflect attention from the fact that the proponents had every chance to prove that Prop. 8 was constitutional, but could not do so. Prop. 8 was declared unconstitutional because it is unconstitutional — not because the judge is gay."

THANK YOU! We wholeheartedly agree!

Let's hope that these Prop 8 supporters swiftly get shut down once again.

    Interesting that they can say a judge in a same-sex relationship is bias, but a judge that is not in a same-sex relationship would NOT be bias? If they are going to go by that logic, then I guess they should get a dog or an ET to be the judge.

    The energy put into the opposition of this is just crazy. I say spread the wealth let everyone enjoy the everyday joy of a long term marriage (btw for those married > 15 yrs you probably know exactly what I mean ;) ) and economically, the marriage industry will BOOM with a boost from same sex couples. If these people all think it is a sin, let God be the final judge, not them. Remember.. Jesus washed a whore's feet, and hung out with lesser women at the well, while higher important people judge them and him and then crucified him… maybe they, like you are are just missing the point.

    What about rape cases are women judges biased as well? and all divorce hearings can any judge thats married actually preside over the case without being biased. This is the biggest bunch of BS I have ever heard of. These people need to accept that they are losing (if they have'nt already lost) and move on!

    Prop 8 was passed by the majority of the public. Love it or hate it, it's legit. You want it gone? Fight to get it on the ballot again and hope to get enough votes to overturn it. If it doesn't get the vote? Tough titties. The people have spoken.

    Try reading the United States Constitution, ASSWIPE. Amendment XIX of the Constitution protects the rights of the minority towards a majority rule. In other words, you as the "majority" can NOT vote on the rights of the "minority". That is why Prop 8 was overturned in California.

    Wow Perez, once again you are about a month behind on your "reporting"!!! This was already ruled on about 3 weeks ago, and the chief judge denied this motion. This is old news. God, you are the worst reporter ever.

    Given all that's wrong with the world: 30,000 children starve to death every day, wars, rape, child abuse and slavery, etc., is this all they have to protest about? Shows there #1 focus in life is sexuality–most likely their own.

    Yeah, this is old news and it was denied but the poster that tried to say that this was voted on by the majority. Let me just say that the civil rights of a minority should never be decided by a majority. Plain and simple!

    If that's they're argument, then it should also make sense that a religious/Christian judge should not be allowed to preside over the case, either, because they can't be trusted to not base the decision on their own personal religious beliefs. Atheist judges only.
    Of course, hopefully their b/s will not be validated by the decision being overturned.
