Sister Wives Family Bringing Utah To Court Over Bigamy Law

| Filed under: Legal MattersLove LineReality TV

sister wives vs utah

Watch Out, Utah! Kody and his wives are coming for you!

Back in January, the Sister Wives family moved to Nevada, and at the time they SAID their reasoning was to "explore new job opportunities."

We'd say, though, that a major influence for the move was the fact that Kody Brown can live with 4 wives legally in Nevada.

While Kody and his wives may have moved on to Nevada, they're still unhappy about Utah's bigamy law, which makes their polygamous lifestyle illegal, and they've decided to fight it in court.

The Sister Wives family's attorney Jonathan Turley says their lawsuit will "challenge Utah's right to prosecute people for their private relationships."

Here's a statement from the family:

"We are not demanding the recognition of polygamous marriage. We are only challenging the right of the state to prosecute people for their private relations and demanding equal treatment with other citizens in living their lives according to their own beliefs."

This is a pret-ty big issue, but the Sister Wives family are certainly widely known, so at the very least they'll bring lots of awareness to the issue of the legality of polygamous marriage.

What do U think about this lawsuit? Do U think the Sister Wives family have a case here?

Personally, I don't agree with their lifestyle - however, I do believe in their cause - no state should have the right to dictate who/how many people you marry.

  2. 2

I think they need to stay in Nevada, and shut up. Gays can't get married, but some asshole who can't keep his pecker in one hole can marry as many women as he wants?

Right from the beginning this show has been propaganda to push for legalized polygamy. While I agree that consenting adults should be allowed to live how they see fit, polygamy opens the door for abuse and coercion of young girls. What we see on this show does not truly represent what polygamy is really like. If it becomes legal there should be an age limit - regardless of parental consent.

I think this opens the door for poor treatment of women. Their particular example isn't so bad from what we can see, but we don't know what goes on behind closed doors.

The difference between this and gay marriage is that gay marriage generally only affects two adults. In polygamy relationships, it affects large amounts of adults and the children.

Just like in Paris, how they outlawed those face coverings of muslim women faces, legally allowing polygamy would be a step in the wrong direction. It would be abused over and over again… It would do way more harm than good.

Plus, relationships like that overpopulate the world. They do not need 5 children per wife. That is silly. I think we will live in a time where the number of children you are allowed to have is restricted. They are super, super selfish for having so many children.

The united states is only 10% of the world's population, but takes up 30% of it's resources.

You can only imagine how much waste that many children in the United States will produce.

Re: girlgirl – Exactly, personally i think that the women in question have very low self esteem and didn't think they deserved any better.
This has nothing to do with religious views, just with a man's ego .

Re: jessiedee – Exactly! But let me expand just a little…

Everyone should be entitled to one marriage (with whichever gender they choose). After that, they can should be able to have a civil union with any number of persons, however, there should not be tax exemptions for spouses past the first. All spouses, however, should be able to share in inheritance, have medical leave rights, access to injured/hospitalized spouses and have access to insurance(s), as well as their children. We can let the insurance companies and lawyers figure out the bill for them. I'm sure they are up to the task.

And that's how it would be if I ruled the world.

They aren't trying to legalized polygamy…if you who are judging knew much about them..he's only legally married to Meri (first wife) and the others have been a "ceremony" but not legal marriages. I don't see how its anybody's business how other's live their lives. So they want to live in a big house as a big family…good for them! I've watched the show, and I don't think it's an egotistical thing. The kids are attached to each other like siblings and I think they have a right to live how they want.

Re: rosebud99 – But abuse and coercion of young girls can happen in what the law recognizes as "normal" marriage; the potential for abuse isn't limited to unusual situations. I agree that there should be age limits that pertain to marriage (polygamous or otherwise); I don't understand why there are established age limits that can be waived if a parent consents (I see no reason why waiving should be permitted at all). I don't believe in polygamy, but if there are consenting adults who want to live that lifestyle, I see no reason for it to be illegal. I can't make the statement that the show doesn't truly represent what polygamy is like because I've never lived the lifestyle. But no lifestyle is perfect and no lifestyle is immune to abuses, and so I say let them have plural marriage.

    What do I think?
    I think I don't care.

Re: girlgirl – I think you're over-analyzing this, as the core of this issue is simply "adults choosing to love/marry whoever they like". It's in the same equal rights bucket argument as gay marriage. Whether it's 2 consenting men, 2 consenting women, 2 consenting women + 1 consenting man, 3 consenting women, etc. It's exactly the same as the gay marriage issue - it's simply whether or not the government should dictate to consenting adults who they choose to love/how many they choose to love in their personal relationships.

  11. 11

Anyone should be allowed to marry whoever they want. As long as there is no fraud there is no harm in polygamy. No one who claims to support gay marriage should try to deny other forms of family the same rights as any other.

  12. 12

Re: ParalyZzzZzer – Low self-esteem is certainly a factor, but even worse is that girls in polygamist communities are raised from day one to believe that this is their role in life. Their education is limited, they are given no coping skills what so-ever for the world outside their community, and they know they will be shunned ad loose everything if they don't 'stay sweet'. Most adult women in these relationships who consent, do it because there is no option.

    Re: Meggie246624 – Amen.

  14. 14

i do think it's odd that polygamy is almost excluisively 1 man and multiple womenm, almost never 1 woman and multiple men. I fully support gay marriage, but I have to admit, what little i know about polygamy, seems to favour abuses, young girls given no choice, abuse of the welfare system and medical system, a general belief that men are better than women, which I admit, chafes me. And sister wives does little to change that perception. I realize that most polygamist relationships may not be like that and abuses happen everywhere. I live in a country where gay marriage is legal, accepted and commonplace. But i have reservations about polygamy as it stands now. Everyone has a choice.. the question is .. is that THEIR choice?

  15. 15

Re: saintlov – Good point to question 'their choice'. I think if polygamist marriage is legal, the participants should have counselling about their options. These women should be informed what is available to them should they choose to say no.

  16. 16

The state has no right to bud into people's private relationships/marriages. They are all consenting adults.

  17. 17

Re: Pretty Boys Are Forever – Consenting adults is one thing, but the children are the ones that must carry the burden of their parents relationships - I have heard of the bullying and allientation as parents don't want their children exposed to children from these homes - sad but it's the truth - not everyone plays nice.

  18. 18

I wonder if he thinks gays should have the same right to marry?

  19. MT10 says – reply to this

Re: Pretty Boys Are Forever – not all of the women in polygamous relationships are consenting…some men of this religion (very traditional men) believe it is their 'godly' duty to marry as many women and have as many children with each of them…marriage should be between just 2 people, whether that is man and woman, 2 women, or 2 men

  20. 20

no i dont agree with it. they are asking to be excused for breaking the law. i dont agree that smoking weed is as bad as the government says but where i live it is illegal so i dont smoke it. the Brethren church don't have to pay taxes here because of something to do with their religious beliefs yet they use tax paid services as we all do and this is also wrong.

  21. 21

Polygamists are sick misogynist assholes who rape their daughters, and TLC thinks promoting thing trash is acceptable.

  22. 22

they say they shouldnt be prosucutd for how they live their private lives….hmmmmm is not private when you have a tv show…..

  23. 23

Victimless 'crimes' shouldn't be prosecuted, it's a waste of police time.

  24. 24

Re: MT10 – It should only be punished if people are suffering. If they are all happy in the arrangement it is a waste of time to drag it through courts. Fair enough if abuse or coercion is going on but not if they're minding their own business…

  25. 25

Kody should be arrested simply for being so ugly and obnoxious. The wives should be arrested for being so stupid. The kids should be sent to live with Octomom.

  26. 26

I'll tell you what. If it wasn't for the comments on this website I wouldn't even bother coming here. That is the only reason I visit this site is to be entertained by all the comments that ppl post. Very entertaining. Anyways, what difference does it make if he or one marries one woman or 20 women? Most men cheat on their wives during a marriage. Some wives know some don't. How many women did Tiger have? How many did our former President JFK have? How many has Arnold had? I mean come on, what difference does it make if they are married or not. At least these girls know where there husband is if they need him. He's not lying or sneaking around every niteand if he can keep 4 women happy in the bedroom well he is better than alot of men who can't keep one woman happy. I just hope for his sake they all don't have "the time of the month" at the same time. That would be a hormonal disaster for the poor guy. Go for it Sister Wives.

As someone that's FROM Utah, let me say my bit. A lot of people when they think of Utah, think of Mormons. A lot of people when they think of Mormons think of polygamy. Can you really blame us for trying to steer AWAY from that image? Of course we set laws. We all want to jump around and say "Hey hey hey! Our ancestors were dumb and we're not like that!"

  28. 28

Who is paying for all the insurances, medical bills, food, and such for these people? I bet I know, YOU AND ME!
