Hyman and son Stephen were a father/son duo that made it "through multiple rounds of auditions in Miami," but couldn't get further because Hyman was too exhausted for his performance. He claims that he and his son were "made to film a segment numerous times, in which they were made to walk from a car into Miami's Bank United Center while a camera filmed multiple takes."
Hyman believes that the 96-degree-heat as well as his son's asthma caused the duo to be unable to perform up-to-par during their audition after they filmed the segment, and they say that Simon voted "no" on them as a result.
The suit claims negligence, as well as fraudulence of representation, and mental anguish. Hyman and his family want a total of $3,000,000 OR the opportunity to audition once again.
Even if they WERE given another audition, we think it'd be pret-ty difficult for Simon to get too enthusiastic about these two after all of this…unless he gives them a "yes" just to avoid legal action, and then just kicks them out soon after the competition begins.
