Texas Executes Man For Murder Even Though A Different Convict Confessed To The Crime

Steven Michael Woods

Tuesday night at 6:22pm, Steven Michael Woods was executed for a murder he did not commit.

Bethena Brosz and Ronald Whitehead were shot and stabbed to death by Marcus Rhodes.

Unfortunately for Woods, Texan law allows the execution of those involved with the murder scene despite the degree of participation.

While Woods admitted to hanging out with the couple and witnessing the murder, he insisted he never had any part of it. Instead, it was act he claimed to be solely that of Rhodes.

And Rhodes confessed! Not only that, but DNA testing supported the confession. Still, Woods was convicted for his "involvement" (wherever the truth may lie in that).

Right before his death, Woods had some final words:

You're not about to witness an execution. You are about to witness a murder. I am strapped down for something Marcus Rhodes did. I never killed nobody, ever. Justice has let me down. Somebody completely screwed this up. Well, Warden, if you're going to murder someone, go ahead and do it. Pull that trigger.

Wow…

We did some more research and while it doesn't seem like Woods was by any means squeaky clean (he was involved with drug dealings as a teenager, around the same time of the crime committed), it still doesn't seem justifiable to execute a man, especially for a specific act if there's no blood on his hands.

When attempting to justify the law, Houston Victims-Rights Advocate Dudley Sharp compared it to winning the Nobel Peace Prize:

We hold people responsible for being conspirators or assisting even in good acts. We are not treating murderers any different than we would by giving a Nobel Prize to someone who began research 40 years ago even though they didn't make the breakthrough.

Umm, sorry, but we don't think anyone supporting an eye for an eye can talk about Nobel Peace Prizes…

    oh, man, this is like justin timberlate in alpha dog–but worse! the whole guilt by association needs to be reviewed. if you are in the wrong place at the wrong time, you do not deserve death. if you knowingly hold someone down so they can be murdered, then they are active participants* in the murder, and execution can be put on the table.

    Yes, he didn't do the crime but he admitted to witnessing the murder so he did technically be to blame for the crime. He could have tried and stopped Marcus but didn't or if he did, he didn't say anything. I don't think he deserved to be killed but he definitely deserved to be in prison.

There's a difference between witnessing a murder and encouraging the murder. He would be in trouble if he didn't report the murders, which I don't know if he did or was arrested on the spot.

    Under Texas law, the rules of evidence prevent certain prior criminal acts from being presented to a jury during the guilt-innocence phase of the trial. However, once a defendant is found guilty, jurors are presented information about the defendant’s prior criminal conduct during the second phase of the trial – which is when they determine the defendant’s punishment.

    During the penalty phase of Woods’s trial, jurors learned that Woods was involved in the murder of another victim in California less than two years before he murdered Whitehead and Brosz. Jurors were also informed that Woods, Rhodes, and two other accomplices planned to rob a clothing store in Deep Ellum. Jurors also learned that Woods may have planned to murder a woman who intended to purchase and resell illegal drugs.

    As said many times before, some people are just so evil that the world is a better place without them. Steven Woods is such a person. And sometime just after 6:00 pm HTT the world will be just a little better off than it was a few minutes earlier.

    so if you don't like it… go fuck yourself. don't commit a crime of this magnitude in Texas if you don't want to be punished for it. let's start clearing death row, personally i'm tired of supporting the thugs.

    I'm not one to judge, we don't know to the full extent of what this man's involvement was in the murders. But honestly, I'd prefer that those who associate with murderers are treated as murderer's themselves, as they have the power to prevent a crime and choose to withhold their information that has the potential to save innocent lives.

    All that the presence of Marcus Rhodes' DNA at the scene proves is that Marcus Rhodes was at the scene. It does not to any extent mean he was the only offender. This is not to say that Steven Woods was a sole offender either, but the absence of his DNA does not signify the lack of a definitive contribution to the crime . Most of you probably don't know anywhere near all of the facts of the case. However a jury of your peers, PEOPLE JUST LIKE YOU, were presented with enough evidence to deem this defendant guilty of his involvement - that there was evidence BEYOND A REASONABLE DOUBT that he had sufficient involvement - and they don't need your approval. These same people determined the punishment they deemed to be acceptable. Our system extensively gives the benefit of the doubt to the defendant, which is one of the main bases of the appeals process. If you have a problem with our justice system, join the legislative powers that make our laws and correlate the appropriate punishments.

Wood's prior history and his own personal letter he wrote shows he clearly was a coward who ran away and did not even report the murders. He knew two people were murdered and he also knew who the killer was. Instead of going to the police he ran, like a coward. I do feel for the family as it is a tragic loss. The problem I have with this case was that he was executed while the actual person who killed these people got life in prison. That is not justice at all. He also was not involved in the murder in Cali (which Rhodes also commited) but he did know about it. So once again, he was a coward. Did he deserve to be free? Hell no. But does he deserve to die while a murderer gets to live? hell no. So you are talking about "clearing the thugs" when Texas is currently allowing a murderer to serve a life sentence. Why? because he plead guilty. You don't think thats fucked up? That you can go kill whoever you want and just serve life in prison? I do agree with the death penalty for murders and rapist but as a country we should really get our priorities straight if we killed a man who did not kill yet allow a murderer to live.

Marcus Rhodes, the one who actually pulled the trigger, had the murder weapon at his home and had the murder victims belongings in his trunk confessed to the murders, plus one more murder he committed in California… he just got life in prison. His plea deal, I'm sure, was in part to his family being very wealthy and his father being friends with the local DA. That being said though, Steve Woods is in no way innocent. He claims to have seen the murders, and he drove away leaving the bodies in a field and never alerted ANYONE to what happened! (Beth was still alive when she was found and she clung to life for 36 hours afterwards!! She was an organ donor and five lives were saved because of her.) The man executed decided to not say a word about it to anyone, and went on the run. Who does that?

    I don't think anyone deserves to die for witnessing a murder, and I definitely do not think you can condemn someone for their involvement with drugs and drug dealings as a teenager, because you can easily recover from your past. Its sad to think that they executed a man who was not guilty of the crime, but a mere witness, while real murderers and serial killers still live in jail on our dime and hell some of them even get out after a short while. I think the death penalty should only be carried out in extreme cases, Charles Manson anyone?1!?!?!?!?!

I mean after all, isn't that why some people are forced into the witness protection program? maybe he didn't want that same fate- you never truly know all the outlying circumstances, but I know if I had witnessed a murder, and there was a chance I would get killed over testifying, I would run as well. In regards to our Military, maybe there is a reason you have no idea about what goes on in canada? Or just maybe, you don't care to gain any intellect in your neighbouring country. Last i checked, we have a military who went to afghanistan to help out your troops. Yes, if an attack occured, we most likely would turn to america for help, but it goes both ways.     I don't know how I feel about this. In my area, three men jumped a sixteen year old girl, cut her clothes off with her apple knife and ganged raped her. All she was doing was eating her lunch before classes resumed. They didn't murder her but she will be traumatized for the rest of her life. I would like to see something really bad happen to those men.

    1) Steven Woods was my fiance and the love of my life. He was a very non-confrontational person and was afraid to run to the cops with drugs in his system. he knew that Marcus was well connected and was afraid of what his family might do to him. The 2 guns were used because marcus put 5 bullets in victim 1, ron. Then he (marcus) ran out of bullets and saw victim 2 (beth) try to flee, so he pulled out his little self defense pistol that he carried in his pocket and shot beth behind her knee so he could go reload his gun. steven hid in marcus' car where he knew that marcus wouldn't blow his brains out. Steven was 21, terrified, on drugs, homeless, and didn't know what to do. I witnessed him die. Sept 13 was the most terrifying day of my life. I will never recover from his death and the feeling that justice was never served and a murderer (marcus rhodes) got LIFE WITH PAROLE (yep. no joke, he'll be free one day!)
    2) Steven had no involvement in the california murder and was never indicted for it. He told the police about it and helped the cops find the real killers. (his friends)
    If I was the victims' relative in this case i would like the RIGHT PERSON to get executed, if anything.

    Texas executes a LOT of people off of Law of Parties.. which is guilty by association. Texas alos executes a lot of innocent people, proven after they have been killed by them. I have witnessed an execution there and it's not fun. Its not fun especially in Steve's case to watch his loved ones go through this and he didn't do it. There is TOO Much doubt over the death penalty and especially in TEXASS! I have friends that know Steve and are heartbroken. I went through this last year and it was beyond miserable.     Comments? Oh yes I have some but where would I start? Steve Woods is just another tragedy that can be chalked up to the state of Texas and their wanna be Hitler Gov. Perry! The death penalty is meant to be for cases that are beyond a shadow of a doubt and there are numerous cases from Texas that are so far from proven that it is sickening. What ever happened to rehabilitation? HMMMMMMMM - look at the Steve Wood case closely - he admitted to being young and hung up on drugs and a drifter! This alone says that he was rehabilitative! Sounds more like he was a scared young man with no where to go and had managed to do nothing more than to survive at the period of time that he was in and obviously that was not working for him. Why give a plea deal to the killer then convict the person that was the unfortunate witness? I think he should have received his time to rehabilitate and the ultimate punishment should have gone to the man who pulled the trigger (several times)

    Killing is wrong no matter what form it is delivered in and honestly when you look at it, any time that they have to use several combinations of drugs and have more than one person administer those drugs (and not know which one they are giving) in order to clear someones mind that they might not have been the one to kill the person, then morally you should only conclude that this is killing and is wrong! Oh yes, we talk about all the money it costs to house prisoners - well hell, if we were to stop housing all the petty crimes and just house the horrific crimes then the taxes would not be so out of bounds and prisons would be in place for what they were meant to be in place for. If you have EVER known someone that has been placed on death row or executed for a crime that you KNOW was questionable then you know how our justice system plays LOTS of favorites - statistically speaking just how many people with money end up on death row! Let it not be forgotten that the judicial system leaves in their wake many more victims when they do their legalized killing by leaving family members without their loved ones and these family members have also not committed any crimes.

    Everyone looses from the death - no matter what! My thumbs up to Perez for his backbone and support of this issue and my sympathy to Steve Woods family / friends. The death penalty is something that you never get over if you have witnessed it with someone that has been executed in what you truly believe was wrong. It leaves a scar that no plastic surgery can heal and a helpless feeling that just never goes away - R.I.P Cary Kerr #999449 another one of the state of Texas innocent people (also the first to get the "new" toxic death drug) that were put to their death wrongfully because of not having MONEY to prove his case! Appeals are worthless in most cases also because of ineffective counsel and the fact that the courts assume that most will file their appeal and they just deny them and go about their busy days. Lives are not worth anything more than the paper that the appeal was written on. DNA is a great thing in order to assist with guilt but also worthless if the courts refuse to allow it in appeals

    I just wanted people somewhere to know the truth – it’s been a long time since I’ve written about that part. The opinions that are online debunk their other lies about the trial.

    But none of them were there at rhodes’ plea hearing. None of the people who do try to argue with them were at rhodes’ plea hearing. No one but the people who were there know what rhodes said, or did not say – it’s not published online anywhere. I was there. We were there. And rhodes did not say he did it by himself. He pled guilty, and that was that. When asked if he wanted to make any statement, rhodes’ response was no.
    Now they are saying his co-defendant rhodes stood up in court when he pleaded guilty, and said he murdered Beth and Ron by himself. Does it ever stop? I guess not.
    rhodes said no such thing. He only said he understood his rights and pleaded guilty to capital murder. rhodes is guilty of capital murder – rhodes is guilty under the law of parties.
    There were several witnesses at trial that testified that woods told them he did that – that he is the one that murdered them – that rhodes was a wimp (or something that means that which I would not type here) and rhodes wouldn’t even make any of the killing shots himself. In front of several witnesses and while rhodes was there too, he was making fun of rhodes for that, when they were showing off Beth and Ron’s stolen personal items the next day.

When you plead guilty there is going to be such a sentence it does not implicate or clear Mr Woods from guilt. When facing the death penalty you would think that your fellow if innocent would have offered to plea and testified against Rhodes if he was solely responsible.
