Justice! Three Homophobes Who Beat A Texas Gay Charged With Assault

| Filed under: Gay Gay GayLegal MattersSad SadLGBT

Assault doesn't even begin to cover what they did to this poor guy. They set him on fire! That's downright torture!

And for what? Really, what is the big, damn deal.

Earlier in the month, we shared a heartbreaking story about a 26-year-old gay man named Burke Burnett who was ruthlessly beaten and bloodied by three dudes in Texas. Poor Burke was shown no mercy by these fools, who also stabbed him and threw him into a fire. Now, we're hoping the same level of compassion for them as they each face charges of aggravated assault with hate crime enhancements.

The suspected assailants, James Mitchell Lasater III, Micky Joe Smith, and Daniel Shawn Martin, face a trial in the coming months, which will be detrimental to two of the guys, as they are repeat offenders. According to Texas law, aggravated assault is a second-degree felony punishable by up to 20 years in prison. However, the hate crimes enhancements would bump up the charges, making them first-degree felonies punishable by up to life in prison.

Texas does not mess around! Here's to justice being served!

Anybody who got beat up could say there gay and it automatically turns into a hate crime, they say they want equal rights but in these kinda of cases they want special treatment! Srsly y'all are messed up in the head

    Re: HAWTSTUFF – [re=5930415]

    You are a dumb cun*t.

  3. 3

For punishment they should be forced to listen to your radio or tv show. Now that's torture. Or maybe the video of you bawling like a little girl when you got your little boo-boo and thought your eye was falling out, lmfao. How about making them read The Boy with Pink Hair? Or going to a Slimey concert as your date and having them meet your Momma after? There's all sorts of cruel things that would teach them a lesson.

Re: HAWTSTUFF – So it's okay that they beat this guy up and set him on fire? Gay or not it's still assault.

  5. 5

Stab and thrown in a fire? Sounds like attempted murder to me they should be facing life in prison.

  6. 6

IF you wanna suck cock you got to be ready to take the beatings.

Re: bwilliams – Just saying it shouldn't be a "hate " crime

  8. 8

why don't you allow comments about the gay perverts at PSU

  9. 9

Re: Samson96 – So you beat up the hookers that you have to play to try and blow you?

  10. 10

Should be an attempted murder charge for the ignorant douche's that did this!

  11. 11

If you come to this site you are probably gay. If you are a homophobe you are certainly gay. OK, Samson and hawtstuff?

  12. 12

Re: HAWTSTUFF – If they are charging them with a hate crime, one would assume that the authorities have evidence to support that charge. They don't automatically add 'hate crime' just because the victim happens to be gay.

  13. 13

Re: raypearson – Dear "gayperson". Please look up the difference between being gay and being a pedophile, you waste of skin.

  14. 14

Gays shouldn't make it their #1 priority to cram their lifestyle down everyone else's throat. It use to be that people kept their sex life private. Now, they feel the need to have parades to announce what goes on in their bedroom.

Re: Lady Who? – For someone who despises Perez Hilton so much, you sure do spend a lot of time hanging around on his site. Have some self respect. Either hate the guy and leave or just shut up. You can't do both.

  17. 17

Re: HAWTSTUFF – If he was beaten up for the sole purpose of being gay, why shouldn't it be called a hate crime? Laws against hate crimes are simply there to protect people. Find some other way to push your anti-gay agenda than to try to make light of someone who was seriously and nearly fatally attacked by someone just because he isn't straight.

Re: joethehobo – Lmfao, you have made me see the light. I will now promote wellness and love, and maybe host a show called Bad Girls. Oh, and go fuck yourself.

  19. 19

Re: likewhocares – If I had a dollar for every time someone uses the "down our throats" phrase… You people share the same brain and vocabulary. Get your own words to say what you have to say. Stop preaching what you've been told. Do you believe straight couples should be punished for "shoving their lifestyle down our throats"? Stop clutching your pearls and get over it. Two people are happy and are in love. Why do you have an issue with that? The only person I see "shoving their lifestyle down other people's throats" are the homophobes who actually vote against the rights of other people. And seriously, the "throats" phrase was used during the civil rights movement and I'm sure you know which side I'm talking about. Have some self respect.

  20. 20

If they had been black guys that had beaten him up it wouldn't be a hate crime. It's only considered a HATE CRIME when white people do it. Fucked up isn't it?

  21. 21

I dun some reading on this story, and this guy was hitting on one of the three suspects, even after many times to stop this guy, all 3 guys dun what was necessary, so the moral of the story is dont shove ur gay agenda where it not wanted!

  22. 22

Re: HAWTSTUFF – I think the moral is if you beat the shit out of someone simply because they are gay, then you can expect to spend the next few years cooling your heels in the joint.

  23. 23

Re: HAWTSTUFF – I agree with you. When they get their asses kicked how do the other people know that they are gay? They seem to only cry that to get more sympathy.

  24. 24

Re: HAWTSTUFFRe: Shelah – you both are idiots and don't know wtf your talking about.
In crime and law, hate crimes (also known as bias-motivated crimes) occur when a perpetrator targets a victim because of his or her perceived membership in a certain social group, usually defined by racial group, religion, sexual orientation, disability, class, ethnicity, nationality, age, gender, gender identity, social status or political affiliation.

The is terrible! I'm not gay but I live in Toronto which, thank God, is very live and let live. It isn't a big deal to be gay - so what? Everyone should have the right to love whom they choose. These creeps should be tried for attempted murder and put away for a long, long time. I don't understand people who are so filled with hate for others just wanting to live their lives. And, ironically enough, these are usually the same self-righteous hyprocrites that try to shove religion down everyones throats. Some of the comments here are really disturbing. The gay community wouldn't have anything to protest if they were just allowed to be. Most gays are just quiet, normal people who just want to live their lives. What the hell is wrong with that?

  26. 26

Re: HAWTSTUFF – even you could be the victim of a hate crime due to your "disability" of having no brain.

  27. 27

im all for gay rights and what these guys did was horrible but life in prison….really….that a little tooo much.

Re: raypearson – Because Mario's real last name is Sandusky.

  29. 29

This story just proves not everyone wants gay ppl and their gay agenda around!

  30. 30

Re: HAWTSTUFF – Even if this was true, stabbing and burning him alive was 'necessary'?

  31. 31

Re: Tahoe – This was a great thing to read. Thank you.

  32. 32

You should move to Texas Mario. Now that would be entertaining.

  33. 33

Re: HAWTSTUFF – You still haven't defended your argument about hate crimes. You feel so passionately that this story shouldn't be called a hate crime, yet it's clear that it is. This man was stabbed, beaten up, and set on fire simply for the fact that he was gay. You even admitted yourself that the only reason he was attacked was because he was gay and talking to them. So my question is, why should this not be treated as a hate crime? Just because you personally can't get that stick out of your ass long enough to show any sign of compassion doesn't mean that this country shares your beliefs. Has it not occurred to you yet that these laws were put into place to protect citizens from people like you? Grow a pair and admit that you want this guy to get less justice because he is gay. And for God's sake, don't spew your idiocy on this site and not have the decency or intelligence to defend it.

  34. 34

Re: HAWTSTUFF – Ok, let's explain something to you. When you say HATE crime, it doesn't mean "special treatment for gays" it's for everybody. If the only reason I stab you is because you're an american citizen, then that would be a hate crime. Same if you're black, and I attack you for that, of if you're chinese, or latin american and so on. And no, you cannot fake being gay, they need prove that THAT'S the reason you did what you did to accuse you of commiting a hate crime. Read a little before saying shit like that.

  35. 35

Re: AlvaroPizarro – LOOOOOOOOOL cant fake being gay???? hahahahahah
like blk ppl pulling the race card, this guy pulls the gay card!

  36. 36

Re: bgbreakdown – Sorry honey THEY ARE GAY PEDOS any other dumbass comments

  37. 37

if they were shouting homophobic insults whilst attacking him then it qualifies as a hate crime. Some gays can actually be very annoying and obnoxious expecially if drunk. They do hit on straight guys and provoke all kinds of trouble. Its that queer eye for a straight guy thing…it can be very dangerous.

  38. 38

Re: raypearson – Yikes. Your whole argument is lost when you don't realize you're confusing "gay" and "pedophile". How embarrassing.

  39. 39

Re: sweetkiss2233 – Oh, what would they have had to do to get life in prison by your standards? Let's see, they beat him and set him on fire-attempted murder. They are going for a life sentence - it doesn't mean they'll get that. But they should do a lot of time. Give themselves time to think about how to treat another human being.

  40. 40

I hope those guys enjoy getting raped over and over again in prison!!!

  41. 41

It is about time that low-life like this learn that they can't get away with disgusting acts of violence.

  42. 42

so just because the guy was gay they get even longer punishments? A man is a man, it shouldn't affect the crime committer's sentence if they're gay or not. I know this is horrible but the punishment is odd and somewhat unfair.

  43. 43

U poor thing!! Ugh!Damn those bullies! They should be the ones that burns in fire!

  44. 44

ok Hawtstuff… it is a hate crime if someone is specifically targeted because they are g@y!!!!! Sounds like you have some issues yourself!
