SHAME! The Ivy Sued For Allegedly Firing Employee Who Was HIV Positive!

If this is true, well, The Ivy is in for some big trouble!

Apparently a former employee is suing them for allegedly being fired for having HIV!

It was filed at the California Superior Court in Los Angeles and is claiming that The Ivy violated the Fair Employment and Housing Act (FEHA), and discriminated against Reymundo Martinez by 'wrongfully terminating him on the basis of his medical condition at the beginning of last year.'

Here's what a senior counselor had to say about it:

”The Ivy cannot target employees with HIV for discrimination. Individuals in these vulnerable situations are in particular need of their jobs, and any employer choosing to discriminate faces the possibility of a civil suit.”


So what happened?

Apparently he worked there for five months before he was fired, and had been diagnosed with HIV in December 2010. And when you get diagnosed, you get put on meds right away.

And the meds made him sleepy one night so he asked to leave early. They let him and told him to not come back that week!

Even his doctor requested that the restaurant “please facilitate patient request on work schedule change” and CONFIRMED that he was still able to do his job!

He got the axe instead!

    Why did you connect Jennifer Love Hewitt to this story? Because there happens to be ivy in the background? Way to mislead people who just scan the headlines.

    Or he was incompetent idiot and is just using his 'medical condition' to get an easy check. Personally I do not think anyone with any infections that have the potential to spread should not be allowed to work around food. They don't allow people who are HIV positive to work in the cafeteria at a hospital. For good reason.

He was not fired for having HIV, he was fired because his illness made him sleepy on the job and they wanted him to receive special treatment for scheduling to accommodate him. I would of fired him too.

    Anyone with HIV should NOT be able to work in food service. People cut themselves in food service all the time. Maybe he was extremely careful. And not to sound like a bitch but I wouldn't want food from someone with HIV.

    If I was on the jury in that civil case, I'd be on the side of the restaurant, not the whiner expecting special favors and treatment because he's got HIV. The Ivy didn't owe it to the guy to accommodate his special scheduling needs, and I for one don't want someone with HIV handling my food and beverages. There IS a health risk involved, and unless the restaurant is informing me of the risk and giving me, the customer, an option to select someone else to serve me, I'd think they're running the risk of being sued for putting innocent diners at risk. So STFU Mario; no one cares about your gay causes and your too-obvious SPIN. And WTF does JLH have to do with this story?

    I wouldn't eat there if I knew he was working there…do you want to ruin this restaurant and their reputation? HIV is a serious disease and those with it should work (I didn't say sleep) on appropriate jobs!

    Many Americans are so ignorant with your discriminatory bullshit. People living with HIV live long and healthy lives these days and know the precautions they have to take. Why wasn't there a post about an ex-basketball player who is living with HIV that just bought a baseball team on this blog … where were all of your ignorant posts then? I think a good many of you should educate yourselves and learn a couple of things about HIV and how it is transmitted.

    Re: Ms. B Nice – Because that ex-basketball player is not directly handling people's food! I'm aware of the methods of transmission of HIV (did a project on the disease) and although the chance of HIV somehow being transmitted to another person in this situation is very slim; it is still possible. I am not comfortable with that risk or possibility with something as serious as that disease (or other communicable diseases). I'd rather not take a chance.

    They didn't fire him because he was HIV positive you moron… did you not read the story? His medication, which could have been for anything or anyone, effected his performance. I take medication for migraines and if I kept falling asleep because of it and I got fired would you report on that? NO! This has nothing to do with HIV and has everything to do with not performing to the standards of your boss.

If anyone would cut themselves you would have to clean up the area and toss the food out anyway, whether they have HIV, Hepatitis C or not… most high end restaurants take very good care of their businesses.

You clearly read his blog you are fuelling his blog and making it more popular. If you think hes too mean or fake or anything stop reading. It makes me very sad that everyone writing on this is flaming a guy we know nothing about clearly we will hear more as this proceeds and we will know the truth as far as I am concerned it does not bother me one bit someone with HIV handling my food. There is such a slim risk and we have no clue what these people have that prep our food.

    You just never know who has served you food or performed surgery on your children. I am referring to the HIV positive surgeon who performed thousands of surgeries on children and posed no risk to their patients. I am beyond excited as the scientific evidence about the spread of HIV becomes available. I doubt most individuals who are beyond education will change their discriminatory thoughts. One must always hope.
